HomeMy WebLinkAbout12695 ., 1 RESOLUTION NO. //;;{ ~ 9.s- / 2 RESOLUTION OF THE CITY OF SAN BERNARDINO OPPOSING ASSEMBLY BILL NO. 351 AS IT RELATES TO THE APPROVAL OF THE USE 3 OF A CANDIDATE'S PARTISAN POLITICAL AFFILIATION IN THE STATEMENT OF QUALIFICATIONS AUTHORIZED FOR TRANSMITTAL TO 4 VOTERS. 5 WHEREAS, the present law of the State of California 6 authorizes a candidate for a municipal office to prepare a 7 statement of qualifications which is included in a voter's 8 pamphlet and distributed with sample ballots for city elections; 9 and 10 WHEREAS, the law as it presently exists prohibits a 11 candidate from including in the candidate's statement of 12 qualifications any reference to membership or activity in a 13 partisan political organization; and 14 WHEREAS, it is desirable that municipal elections be 15 conducted on a non-partisan political basis; and 16 WHEREAS, Assembly Bill No. 351 removes the aforesaid 17 prohibitions and permits the use of a candidate's partisan 18 political affiliation or activity in the statement of 19 qualifications; and 20 WHEREAS, Assembly Bill No. 351 would inject partisan 21 political considerations in campaigns for non-partisan offices; 22 and 23 WHEREAS, said Assembly Bill No. 351 would destroy the 24 historical tradition of local non-partisan elections in 25 California in contravention of Article 2 Section 5 of the 26 California Constitution which states that " . . . City offices 27 shall be non-partisan"; and 28 WHEREAS, a hearing has been set before the Assembly 1 2 3 II. :1 I, !: " 'I [, 1 1 I i [ I I committee on Elections and Reapportionment for Wednesday, March 9, 1977; and WHEREAS, it is desired that the City of San Bernardino 4 express its opposition to Assembly Bill No. 351, 5 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 6 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. The City of San Bernardino opposes Assembly 8 Bill No. 351 9 SECTION 2.
