2 RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE
VACATION OF A PORTION OF THE WEST SIDE OF PICO STREET LOCATED
3 GENERALLY SOUTH OF RIALTO AVENUE IN THE CITY OF SAN BERNARDINO,
AND RESERVING PUBLIC UTILITY EASEMENTS THEREIN.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor and Common Council of the City of
7 San Bernardino, having heard the evidence offered in relation
8 to the proposed vacation of that certain portion of the west
9 side of pico Street, generally located south of Rialto Avenue and
10 north of Belleview Street, more particularly described in City
11 Resolution of Intention No. 12643, hereby find from all of the
12 evidence submitted that such portion of the west side of pico
13 Street proposed to be vacated by said resolution is unnecessary
14 for present or prospective public street purposes.

SECTION 2. The Mayor and Common Council of said City do
16 hereby order the vacation of that certain portion of the west
17 side of pico Street, located generally south of the south line
18 of Rialto Avenue, and north of the north line of Belleview
19 Street, more particularly described as follows:

That portion of the West side of pico Avenue, South
of the South line of Rialto Avenue, and North of
the North line of Belleview Street, described as
follows:

The West 20.00 feet of pico Avenue (California
23 Street) as delineated on the Map of Murray and
Payne's Subdivision of the Metcalf Tract as per
24 plat thereof recorded in Book 4 of Maps, page 27,
records of the County Recorder, county of San
25 Bernardino, State of California, and lying between
the South line of Rialto Avenue (1st Street) and
26 the North line of Belleview Street (Atlantic Street)
as said streets are delineated on the map of said
27 Subdivision.
28 And as also described in said Resolution No. 12643.

SECTION 3. This resolution shall reserve, and nothing

herein shall in any way affect or disturb, each and every
existing easement for sanitary sewer and appurtenant facilities
and for public utility purposes belonging either to the City
of San Bernardino or to any public utility, and there is further

reserved for present and future general public utility purposes
7
and for this City an easement reasonably necessary eo locate
8
sanitary sewer, public utility and appurtenant facilities over,
9
in, under or across all of the real property described herein-
before along with the right to use, install, maintain, repair,
replace or renew such facilities and those reserved in City
Resolution of Intention No. 12643.
SECTION 4. The City Clerk of the City of San Bernardino
14 shall cause a certified copy of this resolution to be recorded
15 in the office of the County Recorder of the County of San
16 Bernardino.
