The Mayor of the City of San Bernardino is 7 authorized and directed to execute on behalf of said City a First 8 Amendment to Right of Way Contract with Earl K. Sherratt and 9 Halley B. SHERRATT, husband and wife, hereinafter referred to as , I Ii "Grantors". !i ii ,. 11 WHEREAS, on June 11, 1976 City and Grantors entered into a II Right of Way Contract relating to the acquisition by City of a II certain parcel of real property described in said agreement and I identified as Parcel 8 B, for street and highway purposes. Said WIT N E SSE T H: ---------- acquisition of said parcel was for the purpose of providing right of way for the Mill Street Separation, and a copy of said agree- ment is attached hereto, marked Exhibit "A" and incorporated herein by reference; and WHEREAS, in said agreement City agreed to deliver to Grantors grant deeds for two surplus parcels of real property identified in said agreement, and City agreed to make certain improvements to Grantors' properties both as retained and as granted by the City as aforesaid all as consideration for Grantors granting Parcel 8 B to City; and WHEREAS, said contract provides in paragraph 4 that if City subsequently determined that the two parcels agreed to be conveyed to Grantors were needed for public purposes, that the contract will be amended so as to provide other compensation to Grantors for their Parcel 8 B conveyed to City pursuant to the agreement and for the loss of one driveway opening caused by City's public ---_._~------ ----"-----.---- I 1 improvements upon the said property; and 2 WHEREAS, City has determined that the two surplus parcels 3 of real property are needed for street and highway purposes and 4 the parties hereto desire to amend said right of way contract to 5 provide for alternate compensation to Grantors for Parcel 8 B and 6 for the loss of the one driveway opening; and 7 WHEREAS, the parties desire to amend their aforesaid right 8 of way contract to provide that City's construction of certain 9 improvements as hereinafter provided shall be the entire con- 10 sideration to Grantors for said Parcel 8 B and for the loss of 11 !the driveway opening, I 12 NOW, THEREFORE, it is agreed as follows: 13 1. Paragraph 2 of that certain right of way contract 14 dated June 11, 1976, by and between City and Grantors, is hereby 15 amended to read as follows: 16 "2. The City shall: (A) Subject to the approval of the Mayor and Common I Council of the City of San Bernardino, in exchange for Parcel 8 B, I perform the following items of work and make the following improvements in, upon or near the remaining property of Grantors: 17 18 19 20 21 1. At no cost to Grantors, install an extension 22 to the storm drain, shown by a dashed blue line on Exhibit "B", 23 attached hereto and incorporated herein by reference, from the 24 present terminus to a point westerly of relocated Bordwell Avenue, 25 as shown by a solid blue line on Exhibit "B". 26 2. At no cost to Grantors, remove Grantors' 27 existing chain link fence, as shown by a dashed brown line on 28 Exhibit "B", attached hereto, and reinstall at the approximate -2- 27 28 ---~----- --------_.~._._----- , 1 alignment indicated by a dashed green line on Exhibit "B", said 2 alignment being the vicinity of Grantors' new property line. 3 3. At no cost to Grantors, construct an on-site 4 catch basin, at the approximate location shown in black on Exhibit 5 "B", attached hereto, and resurface the existing paved area to 6 drain, the approximate limits of such resurfacing are delineated 7 in yellow on said Exhibit "B". 8 City's accomplishment of the foregoing shall constitute the 9 entire consideration to Grantors for Parcel 8 B. The parties 10 hereto understand and agree that City's cost for the construction 11 of the aforesaid improvements is currently estimated to be 12 approximately three thousand two hundred dollars ($3,200.00). I I I , then I 13 (B) Pay all escrow and recording fees incurred in 14 this transaction, and, if title insurance is desired by City, 15 such title insurance shall be at City's expense. 16 (C) Bear the costs of all the foregoing and hold 17 Grantors free and harmless for all charges therefor, provided 18 that City shall not be liable for any costs or expenses except 19 those enumerated herein. 20 This transaction will be handled through an escrow with 21 Safeco Title Insurance Company of San Bernardino, California, 22 under its Order No. 517068." 23 2. Paragraph 5 of that certain right of way contract 24 dated June 11, 1976, by and between City and Grantors, is hereby 25 amended to read as follows: 26 . . . . . -3- 24 25 26 27 28 1 "5. permission is hereby granted to the City or its 2 authorized agent to enter upon Grantors' land for purposes of 3 highway construction and accomplishing all necessary incidents 4 thereto and upon Grantors' land, where necessary for purposes of 5 accomplishing the work described in Clauses 2 (A) 1, 2 and 3 of 6 this contract. 7 Grantors understand and agree that upon completion of the 8 work described in Clauses 2 (A) 1, 2 and 3 of this contract, any 9 of said paved areas, private drainage facility, and chain link 10 fencing located upon the Grantors' land shall be considered as the 11 sole property of the Grantors, the maintenance and repair of said 12 property to be that of the Grantors." 13 3.
