HomeMy WebLinkAbout2011-305 RESOLUTION NO. 2011-305 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AMENDMENT NO.2 TO THE CONSULTANT SERVICES AGREEMENT BETWEEN ATKINSON, ANDELSON, LOY A, RUUD AND ROMO AND THE CITY OF SAN BERNARDINO FOR LABOR NEGOTIATOR SERVICES IN THE HUMAN RESOURCES DEPARTMENT. 3 4 S WHEREAS, the City of San Bernardino has an existing Consultant Services Agreemen 6 with Atkinson, Andelson, Loya, Ruud and Romo to provide labor negotiator services in th 7 Human Resources Department; and 8 WHEREAS, the City wishes to continue labor negotiator services; and 9 WHEREAS, the cost for the contract extension will be $30,000; 10 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMO II COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 12 13 SECTION 1: The City Manager of the City of San Bernardino is hereby authorized an IS Andelson, Loya, Ruud and Romo to provide labor negotiator services at a cost of $30,000. 14 directed to execute Amendment NO.2 to the Consultant Services Agreement with Atkinson 16 copy of said Amendment is attached hereto as Exhibit "A" and incorporated herein by reference. 17 SECTION 2: The Purchasing Manager is authorized and directed to issue a Chang 18 Order to increase Purchase Order No. 303525 in an amount not to exceed $75,000. 19 SECTION 3: The authorization to execute the above-referenced Amendment No.2 an 20 21 Change Order to Purchase Order No. 303525 is rescinded if the parties to the Amendment do n 22 execute it within sixty (60) days of the passage of this Resolution. 23 11/ 24 /11 2S 2011-305 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AMENDMENT NO.2 TO THE CONSULTANT SERVICES AGREEMENT BETWEEN ATKINSON, ANDEL SON, LOY A, RUUD AND ROMO AND THE CITY OF SAN BERNARDINO FOR LABOR NEGOTIATOR SERVICES IN THE HUMAN RESOURCES DEPARTMENT. 3 4 I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the Mayor and 5 Common Council of the City of San Bernardino at a ;oint regular meeting thereof, 6 held on the 21st day of November , 20 II, by the following vote, to wit: 7 COUNCILMEMBERS: AYES NA YES ABSTAIN ABSENT 8 MARQUEZ JENKINS BRINKER SHORETT KELLEY JOHNSON MC CAMMACK x 9 x x 10 x 11 x 12 x 13 x 14 ~1.1.~,....k Rac el G. PENMAN, City Attorney By: ~ f.f~ V 21 22 23 24 25 2 2011-305 1 AMENDMENT NO 2 TO THE CONSULTANT SERVICES AGREEMENT BETWEEN ATKINSON, ANDELSON, LOYA, RUUD & ROMO AND THE CITY OF SAN BERNARDINO 2 3 4 THIS AMENDMENT TO THE CONSULTANT SERVICES AGREEMENT is made and 5 entered into this 21st day of Novembe-;-2011 ("Effective Date"), by and between the City of 6 San Bernardino, a charter city ("CITY"), and Atkinson, Andelson, Loya, Ruud & Romo 7 ("CONSUL T ANT). 8 WIT N E SSE T H: 9 WHEREAS, parties hereto entered into a Consultant Services Agreement dated May 10 17, 2010, for Chief Negotiator services in labor negotiations with the Police Safety and Fire 11 12 Safety bargaining units; and 13 WHEREAS, parties hereto entered into Amendment No.1 to the Consultant Services 14 Agreement on December 6, 2010; and 15 WHEREAS, CONSULTANT represents that it continues to hold all necessary licenses 16 to practice and perform the services herein contemplated; and 17 WHEREAS, Sections 5.1 and 5.14 of the aforesaid Consultant Services Agreement 18 allow such Agreement to be amended by a written agreement executed by the parties; and 19 20 WHEREAS, the parties desire to enter into Amendment No.2 to the Consultant 21 Services Agreement; and 22 NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS: 23 The amendment to the Consultant Services Agreement amends only those terms contained 24 herein; such terms not covered by this Amendment shall remain in full force and effect as set 25 forth in said Consultant Services Agreement dated May 17,2010. 26 Costs for Services. CONSULTANT will be compensated at the rate of $250.00 27 1.2 28 per hour for all services rendered to the CITY. The amounts expended under this Agreement EXHIBIT" A" 2011-305 for consultant fees shall not exceed $75,000 without further approval of the Mayor and 2 Common Council. This is equal to $45,000 above the approved compensation amount in the 3 consultant services Agreement.
