A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
ORDERING THE VACATION OF A PORTION OF COLTON AVENUE AT SCENIC DRIVE AND A
PORTION OF SCENIC DRIVE AT COLTON AVENUE, IN THE CITY OF SAN BERNARDINO.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San Ber-
nardino, having heard the evidence offered in relation to the proposed vacation

of a portion of Colton Avenue at Scenic Drive and a portion of Scenic Drive
9
at Colton Avenue, more particularly described in Resolution of Intention,
Resolution No. 10711, hereby finds from all of the evidence submitted that a
portion of Colton Avenue at Scenic Drive and a portion of, Scenic Drive at
Colton Avenue proposed to be vacated by said resolution is unnecessary for

present or prospective public street purposes.

SECTION 2. That the Mayor and Common Council of said City do hereby
order the vacation of a portion of a portion of Colton Avenue at Scenic Drive
and a portion of Scenic Drive at Colton Avenue, described as follows:
PARCEL NO. 1
The Southeasterly 15 feet of Lots 6, 7, 8 and 9 in Block 10,
Map of Urbita as per plat thereof recorded in Book 3 of Maps,
Page 54, records of the County Recorder of San Bernardino
County, State of California.
PARCEL NO. 2
A strip of land, within Lots 3, 4, and 5 in Block 10 of Urbita
Subdivision, as per plat recorded in Book 3 of Maps, page 54,
records of said San Bernardino County, described as follows:
Beginning at the most Southerly corner of said Lot 5; thence
North 390 17' 42" East, 41.09 feet along the Southeasterly line
of said Lot 5 to the most Southerly corner of the property con-
veyed to the State of California, by deed recorded November 18,
1955, in Book 3791, page 530, Official Records of said County;
thence along the Westerly line of the property conveyed to the
State of California on a tangent curve concave Westerly with a
radius of 142.00 feet through an angle of 120 35' 09", a dis-
tance of 31.19 feet to a point of compo~ curvature; thence
continuing along said Westerly line and along the Northeasterly
line of the property conveyed to the California Electric Power
Company by Deed recorded September 5, 1963 in Book 5982, page
754, Official Records of said San Bernardino County, along said
compound curve concave Westerly with a radius of 157.00 feet,
from a tangent bearing North 260 42' 33"'East through an angle
of 510 00' 33", an arc distance of 139.77 feet; thence tangent
to said curve, North 240 18' 00" West, 14.00 feet to the begin-
ning of a tangent curve concave Southerly and having a radius
of 42.0 feet, and which curve is tangent at its Westerly terminus

with the Northwesterly line of said Lot 3; thence Westerly along
said curve, through an angle of 1160 24' 18", an arc distance of
85.33 feet to the Northwesterly line of said Lot 3; thence along
the Northwesterly line, of said Lots 3 and 4, South 390 17' 42" West,
a distance of 20.00 feet to a point on the Northwesterly line of
said Lot 4; thence North 760 09' 53" East, a distance of 25 feet
to the beginning of a non-tangent curve concave Southerly, having
a radius of 27 feet, a radial line through said point bears North
500 42' 18" West; thence Easterly along said curve through an
angle of 1160 24' 18", a distance of 54.85 feet; thence South 240
18' 00" East, a distance of 14.00 feet to the beginning of a
tangent curve concave Westerly; thence along said curve having a
radius of 142.00 feet through an angle of 510 00' 33", an arc
distance of 126.42 feet to a point of compound curvature; thence
along said compound curve, concave Westerly having a radius of
127.00 feet, from a tangent bearing South 260 42' 33" West,
through an angle of 1:20 35' 09" a distance of 27.90 feet; thence
South 390 17' 42" West, a distance of 41.09 feet to the Southwest-
erly line of said Lot 5; thence along the Southwesterly line of
said Lot 5, South SOil. 42' 18" East, a'distance of 15.00 feet to
the point of beginning.

PARCEL NO. 3
That portion of the Southern Pacific iailroad Company's property
which is located Southeasterly of Lots 7, 8 and 9, Block 10,
Urbita as per plat thereof recorded in Book 3 of Maps, page 54,
records of the County Recorder of San Bernardino County, State of
California and which is described as follows:
Beginning at the intersection of the Northwesterly line of Colton
Avenue, 60.00 feet wide and the Northwesterly prolongation of the
Northeasterly line of Scenic Drive, 50.00 feet wide as said Streets
are delineated on the Map of Tract 1963 as per plat thereof re-
corded in Book 28 of Maps, page 52, records of the County Recorder
of said County; thence continuing Northwesterly along said North-
westerly prolongation of the Northeasterly line of said Scenic
Drive, a distance of 40.00 feet to the Northwesterly line of said
Railroad property; thence Southwesterly along said Railroad property
a distance of 50.00 feet to its intersection with the Northwesterly
prolongation of the Southwesterly line of said Scenic Drive; thence
Southeasterly along said prolongation a distance of 40.00 feet to
the Northwesterly line of said Colton Avenue; thence Nort~asterly
along said Northwesterly line a distance of 50.00 feet to the Point
of Beginning.

And also described in said Resolution 10711.
SectLopo3. That the City Clerk of the City of San Bernardino shall
26 cause a certified copy of this resolution to be recorded in the office of the
27 County Recorder of the County of San Bernardino.

SECTION 4. That the City Clerk shall certify to the adoption of this
29 resolution and thenceforth and hereafter the same shall be in full force and
30 effect.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DECLARING THE FACT THAT THE OWNER OF ALL THE LAND IN CERTAIN
TERRITORY CONTIGUOUS TO SAID CITY HAS REQUllTED ANNEXATION TO THE CITY OF
SAN BERNARDINO, AND APPROVING THE ANNEXATION OF DISTRICT NO. 267 (LAFC 989).

WHEREAS, the Mayor and Connnon Council of the City of San Bernardino
have duly received a request by the owner of all the land within certain
territory contiguous to said City, as shown on the records of the San

Bernardino County Assessor, and asking that said territory be annexed to the

City of San Bernardino; and

WHEREAS, at its meeting of April 28, 1971, the Local Agency
Formation Connnission of San Bernardino County approved the proposed annexation
and gave consent to proceed without notice, pursuant to Government Code
Section 54797.1.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION ONE: That pursuant to Chapter 1, Article 1, Section 35015
of the Government Code, the annexation of that certain territory contiguous to
the City of San Bernardino, designated as Annexation District No. 267 (LAFC
989), be and the same hereby is approved.
Said territory is described as follows:
Lots 1 and 2, Block 20, Map of West Highlands as per plat
thereof recorded in Book 5 of Maps, Page 77 Records of the
County Recorder of San Bernardino County, State of California,
and that portion of Lime Street vacated and also that portion
of the Southeast one-quarter of Section 19, Township 1 North,
Range 3 West, San Bernardino Base and Meridian, more particularly
described as follows:
Beginning at a point on the Present Corporate Limit Line of
the City of San Bernardino, said point being the intersection
of the center line of Belvedere Avenue and the North line of
Piedmont Drive, said point also being on the East line of that
certain parcel of land, described as Parcel No. 1 in the deed
to Martin H. Swanson et-ux, recorded May 23, 1945, Document
No. 12 in Book 1783, Page 153 Official Records of said County;
thence following said Corporate Limit Line the following
courses and distances; thence North 332 feet more or less
to an angle point; thence North 600 12' West, 124.4 feet
more or less to an angle point; thence South 730 08' West,
141 feet more or less to an angle point; thence North 830 12'
West, 251 feet more or less to an angle point; thence North
660 32' West, 343 feet more or less to an angle point; thence
North 820 32' West, 133 feet more or less to an angle point;
thence South 566 feet more or less to the Southwest corner of
said Parcel No. 1 described in said deed to Martin H. Swanson

et-ux; thence leaving said Corporate Limit Line East along
the South line of said above mentioned Parcel No. 1 being
also the North line of Tract No. 7055 as per plat thereof
recorded in Book 89, of Maps, Pages 1 and 2, records of the
County Recorder of said County, a distance of 880 feet more
or less to said center line of Belvedere Avenue; thence North
along said center line, 41.25 feet more or less to the point
of beginning.
(Containing approximately 9.31 acres)

SECTION TWO: That the described property will be subject to
7 taxation equally with the property within such municipal corporation to
8 pay its proportion of the following bonded indebtedness of the City of San
9 Bernardino, which said bonded indebtedness was outstanding or theretofore
10 authorized and is outstanding at the time of said annexation, to wit:
11 A bonded indebtedness of $490,000.00 incurred for the acquisition
12 and construction of a public library, including additions to and enlargements
13 of the public library system of said city, the outstanding indebtedness thereon
14 being $240,000.00, bearing interest rates of 4-3/4%, 3-1/2% and 3-1/4% per
15 annum;
16 A bonded indebtedness of $1,116,000.00 incurred for the ~cquisition
17 and construction of additions to, relocations of and replacements of the
18 fire fighting system of said city, the outstanding indebtedness thereon being
19 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
20 per annum.

SECTION THREE: That the property herein annexed is declared to be
22 a part of Ward 4, and the boundaries of Ward 4 are hereby altered to include
23 said annexed territory, and said annexed territory is placed and declared to
24 be in the R-l-lO,800 Single Family Residential zoning district.

SECTION FOUR: That the area included in the above annexation is
26 hereby detached from County Service Areas No. 38, 70 and SL-l.
27 I HEREBY CERTIFY that the foregoing resolution was duly adopted by
28 the Mayor and Common Council of the City of San Bernardino at a
