2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DETERMINING THAT CERTAIN EMPLOYEES IN THE POLICE
3 AND FIRE DEPARTMENTS HAVE A COMMUNITY OF INTEREST IN THE UNIT OF
SAFETY MEMBERS OF THE SAFETY EMPLOYEES JOINT NEGOTIATING COUNCIL
4 OF THE CITY OF SAN BERNARDINO.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Pursuant to Resolution No. 10584 the Mayor and
Common Council find and determine that animal control officers
in the Police Department and mechanics and dispatchers in the
Fire Department of the City of San Bernardino are not safety
members but nevertheless have a community of interest with other
members in the unit of safety members of the Safety Employees
Joint Negotiating Council of the City of San Bernardino.
SECTION 2. The request, contained in Special Petition For.
Determination of the Proper Unit of Representation for Petitioners
is granted and approved.
SECTION 3. Nothing contained herein shall be construed at
any time or place, or in the interpretation of any document or
statement, or in any threatened or actual litigation, or in any
meeting and conferring, consultation or negotiation, or in any
other matter whatsoever, without any limitation, as an admission,
assertion, declaration or any other type of representation,
utterance or agreement by the City that the employees affected
hereunder are "safety employees" within the meaning of any law,
statute, charter, rule or program of the State of California or
the City of San Bernardino, and this resolution is adopted in
reliance upon Paragraph "J" of the Petition of the Safety
Em-
ployees Joint Negotiating Council of the City of San Bernardino
and confirming oral representations made in reference thereto..'
