~UTION OF THE CITY OF SAN BERR~INO AUTHORIZING THE
EXECUTION OF AJi AGREEMEtfl' WITH THE RED~LOPMENT AGENCY OF THE
CITY OF SAN BBRNARDINO, CALIFORNIA, RELATING TO THE INSTALLATION
OF STREET LIGHTS IN THE SOUTH~ST INDUSTRIAL PARK.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and ~irected to execute on behalf of said City
an Agreement with the Redevelopment Agency of the City of San
Bernardino, California, relating to the installation of street
lights in the Southeast Industrial Park, a copy of which is
attached hereto, marked Exhibit "I" and incorporated herein
by reference as fully as though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at

/) THIS AGREEMENT is made and entered into this /91fi day of
~.bAJ , 1977, by and between the REDEVELOPMENT AGENCY
OF THE CITY OF SAN BERNARDINO, CALIFORNIA, a local public agency,

hereinafter referred to as "RDA", and the CITY OF SAN BERNARDINO,
a municipal corporati.on, hereinafter referred to as "City".

WHEREAS, th~ RDA is responsible for installing street

lighting in the area of the Southeast Industrial Park; and

WHEREAS, the City will install the street lighting system
for the RDA,

NOW, THEREFORE, the parties hereto do agree as follows:

1. The City agrees to supply the materials and perform all
15 work and services to install street lights for the Southeast
16 Industrial Park in the vicinity of Tippecanoe Street, Victoria
17 Street, Richardson Street, and San Bernardino Avenue, in San
18 Bernardino, California, as shown on the Plan, attached hereto as
19 Exhibit "A" and incorporated herein by reference.
2. The RDA shall pay the sum of nine thousand one hundred
21 fifteen dollars ($9,115.00) to City as and for full payment for
22 City's performance hereunder not later than thirty (30) days
23 after the date of execution of this agreement.

3. The City shall use its best efforts to complete the
25 installation of said street lighting on or before February 15,
26 1978.

4. The RDA hereby agrees to, and shall, hold the City,
28 its elective and appointive boards, commissions, officers, agents

and employees harmless from any liability for damage for personal

2 injury, including death, as well as claims for property damage
3 which may arise from City's operations under this agreement.
4 The RDA agrees to and shall defend City and its elective and
5 appointive boards, commissions, officers, agents and employees
6 from any suits or actions at law or in equity for damages caused,
7 or alleged to have been caused, by reason of any of the City's
8 operations hereunder.
9 IN WITNESS WHEREOF, the parties hereto have executed this
10 Agreement on the date first hereinabove written.
