7 WHEREAS, the City of San Bernardino, a municipal corpora-
8 tion, is the owner of the hereinafter described parcel of real
9 property situated in the City of San Bernardino, State of
10 California; and
11 WHEREAS, the Mayor and C01II1l\On Council of the City of San
12 Bernardino find and determine that there is no further need or
13 necessity for the use of said real property; and
14 WHEREAS, the Mayor and Common Council of the City of San
15 Bernar~Q believe it to be in the best interest of the said City
16 that said parcel of real property be sold, leased, or leased
17 with an option to purchase, at the highest price obtainable in
18 the open market,
19 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
20 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Notice is hereby given inviting competitive
22 bid proposals for the sale, lease, or lease with an option to
23 purchase, of the following real property, more particularly des-
24 cribed in and subject to the terms of Specifications No. 5074 on
25 file in the Office of the Director of Public Works/City'Engineer,
26 Real Property Section, City Hall, 300 North "0" Street, San
27 Bernardino, California, and. generally described as follows:
28 "A rectangular parcel of land totalling approximately

17,535 square feet containing a vacant library type
building of approxirna.tely 2,435 square feet and
located at the southwest corner of Home Avenue and
Muscott Street in the City of San Bernardino."
SECTION 2. The minimum acceptable bid for said real pro-
perty to be sold, leased, or leased with an option to purchase,
by said City is established as follows:

in a form satisfactory to the City.
The terms for the
purchase shall include a provision that 10% of the total selling
price, with $50,000 as the minimum selling price, be paid to

13 the consideration for the option to purchase. The lease shall be
14 for a term of 15 years. Lease payments shall be paid in advance
15 at the rate of $300.00 per month. At the end of the 15 year

lease term, if the lessee exercises the option to purchase,
"he shall be credited toward the purchase price from monthly
i lease payments already paid at the rate of $250.00 per month
! for the full 15 year term, in addition to the 10% of the purchase

Ii price paid to the City for the option to purchase. If at the
! expiration of the 15 year lease term, the lessee declines to

!i exercise the option to purchase, or at any time prior to the

!i expiration of the lease term that'the lessee shall breach the

I! terms of the agreement, the 10% paid to the City for the option
II
II to purchase and all lease payments made to the City, shall not be

: refundable to the lessee. Lessee shall pay all taxes upon

i, the property ductng the term of the lease; or

(c) In the alternative, a lease in a form satisfactory to

City for a lease term of five years, or more, and providing for
lease payments at a minimum rate of three thousand dollars

($3,000.00), or more, per year.
SECTION 3. Each competitive bid or proposal shall be

5 delivered to the Office of the City Administrator, City Hall,
6
300 North DO" street,

8 at which time said sealed bids or proposals shall be opened and
9 publicly declared. The highest of said bids or proposals shall
10 be submitted to the Mayor and Common Council at the hour of
11 2:00 p.m., at the Council Chambers, City Hall, 300 North "0"

street, San Bernardino, californ~' at their next regularly
scheduled meeting being Monday, r2.3 /97 T

at which time said Mayor and Common Council may receive oral bids,

with respect to the sale of the property, in $250.00 increments,
provided that the initial oral bid shall be an amount not less
than the highest written bid plus $250.00 and accompanied by cash

or check in an amount of $2,500.00, non-refundable; and oral
19
bidding for the sale of the property shall be continued in the
20
same manner and bids received orally until all bidding shall have
been completed; in the alternative. with respect to the lease of
the property, in six hundred dollar ($600.00) increments per
year lease payments; provided that the initial oral bid for the
21
lease of the property shall be in an amount not less than the
highest written bid plus a six hundred dollar ($600.00) increment
per year for the proposed lease term and accompanied by cash or
check in the amount of $3,000.00, non-refundable, and oral bidding
for the lease of the property shall be continued in the same

: manner and bids received orally until all. bidding shall have been

I completed; in respect to the alternative of a lease with an

option to purchase, oral bids for the full purchase price may be
made in $250.00 increments, provided that the initial oral bid
shall be in an amount not less than the highest written bid plus
$250.00 and accompanied by cash or check in an amount of 10% of

the purchase price as payment for the option to purchase, non-
refundable if bid is accepted by the Mayor and Common Council.
Oral bidding for the lease with an option to purchase shall be
continued in the same manner and bids received orally until all

bidding shall have been completed.
The Mayor and Common Council of the City of San Bernardino
reserve the right to make, in their sole discretion, a determina-
tion as to whether the property shall be sold, leased, or leased

with an option to purchase.
SECTION 4. Attention of bidders is directed to "oescrip-
17 tion of Property, Requirements of Bidders, Requirements of Sale
18 and the Official Bid Form" which may be obtained at the office of
19 the Oirector of puelic Works/City Engineer, Real Property section,
20 Room 405, City Hall, 300 North "0" Street, San Bernardino,
21 California.

SECTION 5. All written bids or proposals shall be signed,
23 sealed and delivered. No bid proposal which fails to contain a
24 sum equal to or greater than the minimum acceptable bid price
25 established herein or which is filed at a later time or at a
26 different place or with a different person than required shall be
27 valid or considered for award unless there is substantial com-
28 pliance herewith as determined by the City Administrator in his

Ii sole discretion; and the Mayor and Common Council reserve the

II' right to reject any or all bid proposals for any reason.

II SECTION 6. This resolution shall be posted on or near the

to the date for filing bid proposals with the City Administrator

in the Real Estate Section of the San Bernardino Sun Telegram, a
newspaper of general circulation published and circulated in said

City.

SECTION 7. Resolution No. 12950 is hereby repealed.
