6 WHEREAS, the City of San Bernardi~o4.-.njcipal corpora-
7 tion, is the owner of the hereinafter~e8cr:~,..,..rcel of real
8 property situated in the City of san Bernardino, State of
9 California; and
10 WHEREAS, the Mayor and Common Council of the City of San
11 Bernardino find and determine that there is no further need or
12 necessity for the use of said real property; and
13 WHEREAS, the Mayor and Common Council of the City of San
14 Bernardino believe it to be in the best interest of the said City
15 that said parcel of real property be sold, leased, or leased with
16 an option to purchase at the highest price obtainable in the open
17 market,
18 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
19 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Notice is hereby given inviting competitive bid
proposals for the sale of the following real property, more
particularly described in and subject to the terms of specifica-

tions No. 4859 on file in the Office of the Director of Public
24
works/City Engineer, Real Property Section, City Hall, 300 North
25
"D" Street, San Bernardino, California, and generally described
as follows:

"An irregular shaped rectangular parcel of land
,t.otalling approximately 11,500 square feet con-
taining an old fire station building of approxi-

mately 2986 square feet and located at 269 South
Mt. Vernon Avenue in the City of San Bernardino."

SECTION 2. The minimum acceptable bid for said real
4 property to be sold, leased, or leased with an option to purchase
5 by said City is established as follows:
6
(a) $20,000 cash selling price, or
7

(b) In the alternative, a lease with an option to purchase~
i
8 in a form satisfactory to the City. The. terms for the option to
9 purchase shall include a provision that 10\ of the total selling
10 price, with $20,000 as the minimum selling price, be paid to
11 the City at the commencement of the lease term as and for con-
12 sideration for the option to purchase. The lease shall be for
13 a term of 12 years. Lease payments shall be paid in advance
14 at the rate of $150.00 per month. At the end of the 12 year
15 lease term, if the lessee exercises the option to purchase,
16 he shall be credited toward the purchase price from monthly
17 lease payments already paid at the rate of $125.00 per month
18 for the full 12 year term, in addition to the 10% of the purchase
19 price paid to the City for the option to purchase. If at the
20
expiration of the 12 year lease term, the lessee declines to
exercise the option to purchase, or at any time prior to the
expiration of the lease term that the lessee shall breach the
terms of the agreement, the 10% paid .to the City for the option

to purchase and all lease payments made to the City, shall not be
refundable to the lessee. Lessee shall pay all taxes upon
the property during the terms of the lease; or

(c) In the alternative, a lease in form satisfactory to
28 the City for a lease term of five years, or more, providing for

i lease payments at a minimum rate of eighteen hundred dollars

! ($1800.00), or more, per year.
SECTION 3. Each competitive bid or proposal.shall be

4 delivered to the Office of the City Administrator, City Hall,

I 300 North "D" Street, San Bernardino, California,

at which time said sealed bids or proposals shall
be opened and
on or before

8 publicly declared. The highest of said bids or.proposals shall
9
be submitted to the Mayor and Common Council at the hour of 2:00
10
p.m., at the Council Chambers, City Hall, 300 North "D" Street,
11
San Bernardino, C011'O'ita at their oext reqa1ar1y "cbodo1ed

time said Mayor and Common Council may receive oral bids, in

$250.00 increments, provided that the initial oral bid shall be
15

an amount not less than the highest written bid plus $250.00 and
accompanied by cash or check in an amount of $2590.00, non-refund-
17
able; and oral bidding for the sale of property shall be continued
in the same manner and bids received orally until all bidding
18
19 shall have been completed. In the alternative, with respect to
20 the lease of the property, in three hundred sixty dollar ($360.00)
21 increments per year lease payments; provided that the initial oral
22 bid for the lease of the property shall be in an amount not less
23 than the highest written bid plus a three hundred sixty dollar
24 ($360.00) increment per year for the proposed lease term and
25 accompanied by cash or check in the amount of $1800.00, non-
26 refundable, and oral bidding for the lease of the property shall
27 be continued in the same manner and bids received orally until all
28 bidding shall have been completed. In respect to the alternative

of a lease with an option to purchase, oral bids for the full
purchase price may be made in $250.00 increments, provided
that the initial oral bid shall be in an amount not less than
the highest written bid plus $250.00 and accompanied by cash
or check in an amount of 10% of the purchase price as payment
for the option to purchase, non-refundable if bid is accepted
by the Mayor and Common Council. Oral bidding for the lease
with an option to purchase shall be continued in the same manner
and bids received orally until all bidding shall have been
completed.
The Mayor and Common Council of the City of San Bernardino
reserve the right to make, in their sole discretion, a determina-
tion as to whether the property shall be sold, leased, or leased
with an option to purchase.
SECTION 4. Attention of bidders is directed to "Descrip-
tion of Property, Requirements of Bidders, Requirements of Sale
and the Official Bid Form" which may be obtained at the office of
the Director of public Works/City Engineer, Real Property Section,
Room 405, City Hall, 300 North nD" Street, San Bernardino,
California.
SECTION 5. All written bids or proposals shall be signed,
sealed and delivered. No'bid proposal which fails to contain a
sum equal to or greater than the minimum acceptable bid price
established herein or which is filed at a later time or at a
different place or with a different person than required shall
be valid or considered for award unless there is substantial com-
pliance herewith as determined by the City Administrator in his
sole discretion; and the Mayor and Common Council' reserve the

right to reject any or all bid proposals for any reason.
SECTION 6. This resolution shall be posted on or near the

3 door of the Council Chamber, City Hall, San Bernardino, California
4 and shall be published not less than once at least 10 days prior
5 to the date for filing bid proposals with the City Administrator
6 in the Real Estate Section of the San Bernardino Sun Telegram,
7 a newspaper of general circulation published and circulated in
8 said City.

SECTION 7. Resolution No. 12945 is hereby repealed.
