HomeMy WebLinkAbout13085 RESOLUTION NO. / J;;(}fs 1 A RESOLUTION OF THE MAYOR AND CO~ON COUNCIL OF THE CITY OF SAN 2 BERNARDINO DECLARING THE FACT THAT THE OWNERS OF ALL THE LAND IN CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO SAID CITY HAVE REQUESTED ANNEXATION TO S THE CITY OF SAN BERNARDINO, AND APPROVING THE ANNEXATION OF DISTRICT NO. 309 (LAFC 1740). 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the Mayor and Common Council of the City of San Bernardino have duly received a request by the owners of all the land within certain uninhabited territory contiguous to said City, as shown on the records of the San Bernardino County Assessor, and asking that said territory be annexed to the City of San Bernardino; and WHEREAS, at its meeting of November 9, 1977, the Local Agency Formation Commission of San Bernardino County approved the proposed annexation and gave consent to proceed without notice, pursuant to Government Code Section 54797.1. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That pursuant to Chapter I, Article I, Section 35015 of the Government Code, the annexation of that certain uninhabited territory contiguous to the City of San Bernardino, designated as Annexation District No. 309 (LAFC 1740), be and the same hereby is approved in accordance with the conditions of LAFC Resolution No. 1338. Said territory is described as follows: That portion of Government Lot 6, Section 9, Township 1 North Range 4 West San Bernardino Base and Meridian in the County of San Bernardino, State of California, according to the Government Survey, and that portion of said section lying within the Rancho Muscupiabe, as per plat thereof recorded in Book 7 of Maps, page 23 in the Office of the County Recorder of said County, if said Section lines were extended across said Rancho, and those portions of the adjoining streets described as follows: PARCEL NO.1: Beginning at a point on the Present Corporate Limit Line of the City of San Bernardino, said point being the intersection of the East line of said Section 9 and the Northerly line of said Rancho; 1 2 3 4 5 6 7 8 9. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 thence North along said City Limit line, a distance of 465 feet more or less to its intersection with the Northeast corner of Parcel No. I, as contained in the document to Hayworth, et UK, recorded as document No. 766 on November 5, 1976, in Book 9048, page 1140 Official Records of said County; thence leaving said City Limit line North 660 04' 30" West along the Northerly line of said Parcel No. I, a distance of o 223.27 feet; thence South 70 11' 30" West, !Jlong said Northerly line of said Parcel No. I, a distance of 156.85 feet; thence South 040 19' 10" East, along the West line of said Parcel No.1, a distance of 330.75 feet to its intersection with the Northerly line of said Muscupiabe Rancho; thence Northwesterly along said Rancho line a distance of 55 feet more or less to the Northeast Corner of Parcel No. 1 in the deed to the San Bernardino County Flood Control District recorded April 23, 1940, in Book 1415, page 37 Official Records of said County; thence South l~ 03' 30" West along the East line of said Parcel No.1, a distance of o 442 feet; thence South 72 56' 30" East, a distance of 96 feet more or less to the intersection of a line that bears North 00 16' West from the most Northwesterly Corner of Annexation No. 306 to the City of San Bernardino; thence South 00 16' East along said line, a distance of 466 feet more or less to said Northwesterly corner of Annexation No. 306 and being the present corporate limit line of said City; thence East along said City Limit line a distance of 110 feet to an angle point therein; thence North along said City Limit line, a distance of 35 feet to an angle point therein; thence East along said City Limit line, a distance of 310 feet to an angle point therein; thence North along said City Limit line, a distance of 880 feet more or less to the Point of Beginning. Containing 12.60 acres. That portion of Section 9, Township 1 North, Range 4 West, San Bernardino Base and Meridian, if said section lines were extended across the Rancho Muscupiabe as per plat thereof recorded in Book 7 of Maps, page 23, records of the County Recorder of San Bernardino County, State of California, and those portions of the adjoining streets described as follows: PARCEL NO.2: Beginning at an angle point in the Present Corporate Limit line of the City of San Bernardino, said point being on the South line of said Section 9, and 40 feet West of the centerline of "H" Street; thence Northwesterly along said City Limit line, a distance of 636.74 feet to an angle point therein; thence Westerly along said City Limit line a distance of 1597.35 feet to an angle point therein; thence Northeasterly along said City Limit line, a dis- tance of 440.67 feet to an angle point therein; thence Northerly along said City Limit line a distance of 1308.10 feet to the most Northwesterly corner of that. parcel of land conveyed to the San Bernardino County Flood Control District by document recorded in Book 4229, page 497 Official Records of said County; thence South 740 05' 48" East along the NOrtherly line of said Flood , - 2 - ., 1 2 3 4 5 6 7 8 ~. 10 11 12 13 14 15 16 17 18 19 2D 21 22 23 24 25 26 27 28 Control land, a distance of 1143.34 feet; thence continuing along the Northerly line of said Flood Control property, o North 60 03' 27" East a distance of 563.37 feet to its intersection with the Northerly line of the Rancho Muscupiabe; thence Southeasterly along said Northerly line of said Rancho, a distance of 1395 feet more or less to the Northeast Corner of Parcel No. 1 in the deed to the San Bernardino County Flood Control District recorded April 23, 1940 in Book 1415, page 37 Official Records of said County; thence South 170 03' 30" West along the East line of said Parcel No.1, a distance of o 442 feet; thence South 72 56' 30" East, a distance of 96 feet more or less to the intersection of a line that bears North 00 16' West from the most Northwesterly Corner of Annexation o No. 306 to the City of San Bernardino; thence South 0 16' East along said line, a distance of 466 feet more or less to said Northwesterly corner of Annexation No. 306 and being the present corporate limit line of said City; thence South along said City Limit line, a distance of 665 feet more or less to the South line of said Section 9 and an angle point in said City Limit line; thence West along said City Limit line, a distance of 955 feet more or less to the Point of Beginning. (Containing approximately 94.18 acres) SECTION TWO: That the described property will be subject to taxation equally with the property within such municipal corporation to pay its proportion of the following bonded indebtedness of the City of San Bernardino, which said bonded indebtedness was outstanding or theretofore authorized and is outstanding at the time of said annexation, to wit: A bonded indebtedness of $490,000.00 incurred for the acquisition and construction of a public library, including additions to and enlargements of the public library system of said city, the outstanding indebtedness thereon being $30,000.00, bearing interest rates of 4-3/4%, 3-1/4%, and 3-1/2% per annum; A bonded indebtedness of $1,116,000.00 incurred for the acquisition and construction of additions to; relocations of and replacements of the fire fighting system of said city, the outstanding indebtedness thereon being $355,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% per annum. SECTION THREE: That the property herein annexed is dec lared to be - 3 - 1 a part of Ward 5, the boundaries of Ward 5 hereby altered to include said 2 annexed territory, and said annexed territory admitted to the City in the 3 R-1-7200 Single Family Residential District, except for that parcel designated 4 as Tax Code Parcel No. 265-061-14, owned by the San Bernardino County Flood 5 Control District, which parcel is to be zoned "0" Open Zone. 6 SECTION FOUR: That the area included in the above annexation is 7 hereby detached from County Service Area No. 38, Improvement Zone "G" of 8 9. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 'Zl 28 CSA 38, CSA #70, and Improvement Zone A of CSA #70.
