1 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO,
A MUNICIPAL CORPORATION, GRANTING AN EASEMENT BY THE CITY OF SAN BERNARDINO TO
2 MERLE DEAN PAGEL AND VELMA J. PAGEL.
3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDIN
AS FOLLOWS:

SECTION ONE: That the City of San Bernardino does hereby grant an Easement
for ingress and egress to Merle Dean and Velma J. Pagel, husband and wife as
joint tenants, for a parcel of property located in the City of San Bernardino,
described as follows:
A portion of Lot 8, S. W. Little Tract, in the City of San Bernardino,
as per plat thereof recorded in Book 9 of Maps, Page 12, records of
said County, and a portion of Government Lot 2, Section 13, Township 1
North, Range 4 West, San Bernardino Base and Meridian, more particularly
described as follows:
BEGINNING at a point in the West line of Lot 8 of said S. W. Little
Tract, said point being 399.26 feet southerly of the North corner
of said Lot 8; thence North 0007' East a distance of 330.38 feet;
thence South 89053' East a distance of 20.00 feet; thence South 0007'
West a distance of 330.38 feet more or less to a point bearing south
89053' East, and 20.00 feet distant from the point of beginning;
thence North 89053' West a distance of 20.00 feet to the point of
beginning.
and that the granting of this Easement is necessary to provide access to
grantee's property.
SECTION TWO: That a copy of said Easement, containing an appropriate legal
description of the parcel of real property, is attached, marked Exhibit "A",
and made a part hereof as fully as though set forth at length herein.
BE IT FURTHER RESOLVED that the Mayor of the City of San Bernardino is
hereby authorized to execute said Easement on behalf of the City of San Bernar-
dino.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted b the

EXHIBIT "B"
1.) There shall be no parking at any time within this twenty
foot (20.0') wide strip of land.
2.) The Water Department shall not be liable for roadway
maintenance to any extent.
3.) Grantee shall install and maintain a bridge over the
existing ditch and waterway lying within the westerly five
(5.0) feet of said right-of-way, and shall construct a conduit
to transport water under said bridge in accordance with specifi-
cations and of such materials and size as may be satisfactory to
the Grantor.
4.) Grantee shall hold the Grantor harmless in the event of
any damage to person or personal property arising out of the use
of said right-of-way.
5.) Any damage to property of Grantor arising and resulting
from any act of Grantee, or his negligence, in the maintenance or
use of said bridge shall be the responsibility of the Grantee.
6.) All of the covenants and conditions contained herein shall
apply to and be the obligation of each and every assignee,
transferee, trustee, personal representative, or any other succ-
essor in the interest of Grantee.
