REQUEST
The appellant, vicki Flanders, is appealing the approval of
Tentative Tract No. 14209 by the Planninq Commission. The
appellant requests that the Mayor and Council reconsider this
approval and deny Tentative Tract No. 14209.

plans to build an elementary school named North Verdemont on
Little League Drive.
Tentative Tract No. 14209 is within the Kimbark Elementary
School jurisdictional area at the present time. As of Sep-
tember 29, 1989, Kimbark Elementary had an enrollment of 718
students. The school is now on a year-round program because
of last year's over-capacity problem. Kimbark's Functional
Maximum capacity (FMC) is about 823 students for its year-
round program. (Schools can increase their FMC by about 25%
to 33% by going year-round.) The Principal of Kimbark Ele-
mentary School thought that the school would be at or above
capacity from the new development in the Verdemont Area by
the end of the school year.
All subdivision proposals are routed to the affected school
district for their recommendations and comments. The
standard response received is, "The project will be subject
to school facility fees as determined by the Board of Educa-
tion. Fees must be paid prior to issuance of a building
permit... This response does not address a couple of serious
issues. The first issue is that the development fees are
inadequate. The City's General Plan indicates that the
development fees that are paid only provide about one-third
of the full cost of needed school facilities generated by
that development. At the present time, the school facility
fees are $1.56 per square foot of residential development.
The second issue is that the appropriate timing of when
school facilities should come on line in relation to the con-
struction and occupation of new residences is not addressed.
These financing and timing issues are an on-going problem
that should primarily be addressed by the school district in
conjunction with the City. It is difficult for the City to
support development denial or delay, if the school district
does not request such denial, some type of construction,
timing condition, or extraordinary fees (as permitted by law).
Drainaqe Issue
The Planning Department relies on the Public Works Department
to analyze the on-site and off-site drainage problems and to
condition the project appropriately. A drainage study was
prepared and reviewed by the City. Mitigations included by
the Public Works Department were:
* The construction of storm drains and overflow out-
lets.at the end of each cul-de-sac, and each drain
must be designed to carry lOO-year flood flows.
* The Chestnut Storm Drain must be constructed prior
to occupation of any residences (interim protec-
tion measures were not allowed).

* A scour wall was required along the Cable Creek
right-of-way line. The six foot screen wall on top
of the scour wall must be designed to resist mud
flows to a height of three feet.
The combination of the Chestnut storm Drain and proper drain-
age from the subdivision into Cable Creek was determined to
adequately protect the pUblic'S health and safety.
Traffic Issue
The Planning Department relies on the Public Works Department
to analyze the on-site and off-site traffic circulation
impact. The additional traffic at the intersection of Palm
and Washington from 41 homes was judged not to be significant
to warrant a traffic signal. This intersection will be
improved with a curb, gutter and sidewalk at the southwest
corner. In .addition, the subdivision area is in the proposed
assessment district to construct the traffic signal at Palm
Avenue and Kendall Drive; and curb, gutter and sidewalks will
be constructed on the south side of Washington as mitigation
measures for increased traffic.

I am appealing the decision of the planning commission
in the matter of tract 14209, in the Verdemont area. As a
resident directly impacted by this , and other development
in the Verdemont area, I feel neighborhood concerns over
immediate health and safety issues were not adequately
addressed by the commission. If you will note the
commissioner for the area involved, Hr.Stone, voted
AGAINST the tract.
The school issue addressed in my letter to the planner
et111 exi8t6. w1th the addition of over 600 new apartment
units due for completion soon, and the new homes being
completed at the far north end of Palm, and the two new
tracts above Irvington which are in plan check, the planners
have effectively continued to stretch our educational system
to bursting. It is a reasonable assumption when you purchase
a quarter of a million dollar home that your children can
attend your local school. Will the developers and sales people
of these new homes tell the buyers that their children can not
go to the local school and IF there is room can attend another
school perhaps 10 miles away? I think not.
We must start somewhere to take control.We owe it to the
existing homeowners and to our new residents.

Drainage is a problem in Verdemont and continues to
worsen as development to the north goes on. In the 100 year
rain, the area on the east side of parcel 1261-182-27 is
the "natural" way the water reaches cable creek flood channel.
The area proposed for tract 14209 is a small flood plane .
The commission approved the tract by having our flooding
problems magically taken care of by developments proposed
to go in north of Irvington Ave. That weak assurance does
not sooth my fearsl What if said development runs out of
money, or a number of things can prevent projects from being
completed as planned. Then we will have a big problem of
tract 14209 up to their hoo-haws in mud and water. This
scenario has already happened in the last 10 years to the
existing ho~s that are well back from the channel. I do
not want to be in a special assessment district to pay for
all the new flood control measures that are now needed due
to unbridled growth in the area.
Traffic is a real battle in this area, especially since
Washington is the southern most residential street to exit
onto Palm before freeway access.Increasing traffic by more
than 500~on Washington is not in the best benefit of the residents.
The roads are so bad already that in a small storm, the. entrance

to Washington Av.is completely obscurred by mud
and debris. The current exit for the 300 unit apartments on the west
side of Palm is directly opposite Washington Av.
Won't that be a nightmare at peak traffic hours,
and almost sure to be suicidal in bad weather?
I believe there are more than enough "maybes" checked 1n
environmental impact checklist ALONB to ask that the council
seriously take a look at rejecting Tract 14209 as proposed.
As you can see the majority of the residents are opposed to
this development as planned. We ask that the council
reconsider this approval, until immediate health and
safety concerns have been met.

In a galaxy far, far, away,the city "Master Plan
Wars" had finally reached an end. Weary commlssloners, tired
councilmen and neighborhood watchdogs finally breathed a sigh
of relief. It was over, smooth salling, the homelands will be
protected with the best interest of the people in mind. Job
well done !
. Thanks and praise were offered in the Verdemont area,
whose residents had been battling the city, some for over
12 years, to preserve the rural atmosphere and open spaces
of the area. Residents spoke of their land with pride and of
great r.sponsibility .s caretak.rs of the land that we share.
It was a gr.at r.li.f to b. a.sured that the lif..tyle of a
rurall urban area could b. maintained, and that the clty
fath.rs und.rstood the d.. ire to maintain that kind of
neighborhood. P.ace r.igned throughout the land, until.....

As a resident greatly affected by this proposed development,
I highly recommend that you reject it for a number of reasons.
1. Area elementary schools are operating at capacity plus,
and are already on year round schedules. The next
elementary school scheduled to be built to serve the
area, will be North Verde.ont School, on Little Leaque
Dr. It's approximate opening date vill be in 1991. It
will OPEN as a year round school and at capacity plus.
The next promised school for the area is only air. No
monies exist for it, there is no land purChased, and if
a bond issue on next years state ballot fails, it vill
NIVER be built. If it passes, the school vill be at least
seven years dovn the road at best. It is an unconscionable
act by the planning department, and the city council, to
force the children of BXISTINO familie. to endure
substandard educations in San Bernardino city schools
due to overcrowding that 1s a direct result of over - development
before city services and schools are in place to serve the new
residential tracts.
Will all potential buyers of homes in the Verdemont area
be told that we have no room for their children and they
may be bused twenty to thirty miles or more a day to school
if the school district can even find any room for them???
Our secondary schools are also bulging.....

Verdemont remember.
In the Bnvironmental evaluation attached vith proposed tract
14209 ite. 10a.b. is of vital impact to our area
It says '"The, proposal could impact the fire and police beyond
their present capability to provide adequate levels of service."
The fire chief has stated that in the event of another
catastrophic fire the area would be indefensible.
Under the proposed plan for tract 14209, in the event of
another "Panorama fire", residents of said tract would have to
escape by only one route, north to Washington, which would be
escaping into the path of fire. Also item 6c.d. in same report,

Homeowners of tract 14209 must first go into the fire
path to escape, then they will face the added burden of battling
all other Verdemont citizens to get out on Palm Ave. which is
the only trunk route for ALL residence to exit.
In addition, egress and ingress of said tract 14209 is
not in the best interest of the existing ho..s. Using
the figure. of 12 trips per hou.ehold per day,
approving this tract will increa.e the traffic on
washington st. from approximately 70 trips to almo.t

in the master plan? V. wanted to have all properties
west of Palm zoned one acre re.idential, but during
the constant battle of ju.t keeping the zoning on our
EXISTING homes at an one acre, we ran out of time.

are homes with BIGGER lot. and more a..nitie..
4. The very real danger exist. that de.troying mature trees
on the site at pre.ent, and replacing them with housing so dense,
present wildlife will surely be permanently dis-
placed or terminated. Pre.ently in addition to our many
domesticated animals, both large and small, the
neighborhood has proudly observed many forms of
wild animals. Recent sightlng have included what appears
to be a second pair of Cooper haWks, skunks, racoon, coyote.,
snakes, jack rabbits, roadrunners, quail, a herd of beautiful
white sheep and their .hepherd, and most recently an
eaglet
It is al.o a very real concern of existing homeowners
that higher density housing will force the. to give up

their animals that larger lots allov. We have many
chickens, geese, goats, horses, cats, d09S, etc.
Many animals like horses are not allowed on smaller
lots. Those homeowners vith smaller lots,
vill surely complain about noise, smell, flies,
what have you, and ve the ORIGINAL residence vill have
our established rural lifestyles lost to denser housing
concerns.
We have a chance to save this nov by not approving this
tract as proposed

5. If proposed tract is approved, the existing homeowners
vill be eventually be forced, throuqh any action that requires
a buildinq permit,Ce.g. a room addition) by the city to hook up
their homes to the new sewer line that tract 1(209 will brinq
up the street. This action will force financial hardships upon
existinq homeowners whose septic tank systems are fine and vorkinq
properly. This 1nvolves getting a permit, trenching from
the1r home to the sewer 11ne in the m1d4le of the street,
a street cut, all pluabing from house to main sewer
11ne, digqinq up the1r mature landscaped front yards to
pump out their septic tanks and t~en to fill them with
cement or sand, sewer hook up fee, a new assessment on
their property, filling in and replacing landscaping,
to the tune of .everal THOUSANDS of dollars. In the last year,
,2/3rds of the existing homes have made major septic
improvements, and asking for the. to bear the cost of
a service that 1s not needed at this time In that area
i. an injust1ce.
6. In addition to all of this, the BXISTING homeowners vill
be forced to join the Chestnut Avenue storm Drain Assessment
district. This assessment as established in City Council
resolution 89-146, is being cast upon the people because
" the development of the area in the vicinity of Chestnut
Avenue 1s continqent upon the construction of the Chestnut
Avenue Master Plan storm Drain and Debris Basin." This
assessment district vill be felt by "ALL DSVBLOP"BNT" within
the district. This means that existinq homes could be
assessed upwards of $2000 per year imperpetuity.
Our rights as existing homeowner. see. to be being ignored by
our planners and council. It is ludicrous to expect existing
neighborhoods to foot the bills for new development.
We are by no means opposed to development, or to making
a profit'in real .state, but we are MIGHTILY opposed to
planninq that does not allow for schools and other vital
city services to be in place BBrORB development of

FINDINGS OF FACT'
1. The requested subdivision is in accordance with the
m1n1mum lot development standards of the R-1-10,800
Single-Family Residential zone and is consistent with
the General Plan adopted by the Mayor and Common Council
on June 2, 1989, in that the density of the proposed
tract is 2.682 dwelling units per gross acre while the
plan will allow 3.1 dwelling units per gross acre.
2. All lots created meet Municipal Code requirements in
that each rectangular lot has a minimum width of 80 feet
and depth of 100 feet. The irregular lots meet Code
requirements.
3. Tbe design of the subdivision and proposed improvements
are not likely to cause substantial environmental damage
or cause serious public health problems, in that devel-
opment will occur according to the prescribed mitigation
measures which are included as conditions of approval
and standard requirements contained in this report.
4. The proposed tract meets or exceeds the minimum require-
ments of the City's Subdivision Ordinance (Title 18) and
the State Subdivision Map Act. All lots will have
frontage on dedicated streets.
5. All proposed streets meet the minimum requirements of
the Department of Public Works for street improvements.
6. The design of the subdivision will not conflict with
easements acquired by the public at large for access

Common Council on June 2, 1989, as shown in Attachment A.
4. CALIFORNIA ENVIRONMENTAL QUALITY ACT STATUS
An Initial Study was prepared by staff and presented to the
Environmental Review Committee on July 20, 1989. The
committee recommended a Negative Declaration. The report was
advertised and made available for public review and comment
from July 27, 1989 to August 9, 1989. No comments were
received. See Attachment E - Initial Study.
5 . BACKGROUND

The application for this tentative subdivision was filed on
December 13, 1989. Revisions to the plans were required for
conformity with the Verdemont Area Plan. In addition,
special studies were mandated for drainage, liquefaction,
archaeological, noise and biological impacts. The
application was deemed complete by the submission of these
studies on July 7, 1989.

elevation of 1,736 feet at the northwest corner of the site
to 1,700 feet at the southeastern portion of the site. The
site is bordered by Washington Avenue to the north and Cable
Creek Flood Control Channel to the south. The fauna and
flora of the site are characteristic of a disrupted habitat.
The site is located within the Verdemont Area and within the
High Wind, High Fire Zone, Greenbelt Zone C, and an
archaeologically sensitive area. It is also in a high noise
area and within the biological overlay district.
Lot Characteristics
The project site consists of approximately 15.65 gross acres.
proposed to be divided into 41 single family lots. The 41
lots range in size from the required 10,800 to 20,000 square
feet. Thirteen of the lots are irregular "and twenty-eight
area rectangularly-shaped. All of the rectangular lots have
a minimum lot depth of 100 feet and minimum lot width of 80
feet, as required by the Urgency Ordinance adopted June 2,
1989. The 13 irregular lots meet the Municipal Code
requirements for irregular lots. All lots are deep enough to
meet the 35 foot minimum front setback and maintain the
minimum 20 foot rear setback required by the land use dis-
trict.
Surrounding Area
The site is bordered by single-family homes to the north, the
Cable Creek Flood Control Channel to the south and vacant
land to. the west. Chestnut Avenue, which has been vacated
north of Irvington Avenue, dead-ends at the northwest corner
of the site. The storm drain proposed for Chestnut will join
the Cable Creek Flood Control Channel at this intersection.
Density and the General" Plan
The General Plan allows a density of 3.1 units per gross acre
with a minimum lot size of 10,800. This project proposes a
density of 2.62 per gross acre, well below the General Plan
requirement.

have been designed to meet the requirements of the Verdemont
Area Plan and the City Engineering Department.
Environmental Concerns
The project abuts the Cable Creek Flood Control Channel. As
stated above, the area is located within Flood Zo~e B, a High
Wind area, a High Fire area, Greenbelt Zone C and an archae-
ological sensitive area. Conditions of Approval have been
added to mitigate the potential hazard of being located
within these zones. The Flood Control District normally
suggests a 100 foot building setback from a channel. Twelve
lots in this tract are within the 100 foot setback. To
mitigate this potential problem, the City Engineering Depart-
ment will require a scour wall behind lots 43, 44, 45 46, and
47. Also, a six foot mud wall, above the scour wall, will be
required to protect the lots from any flood damage. Standard
mitigation measures are included to mitigate impacts of being
within the high wind, high fire and for the Greenbelt Zone C.
An archaeological survey was done by a consultant. No
evidence of any cultural remains was discovered. However, a
condition of approval has been added to require that pro-
fessional archaeologists be called on site should anything be
uncovered during grading or construction. See the Initial
study Attachment "F" for complete information on the
environmental concurs.
Drainage
This project is located within the Assessment District being
formed for the Chestnut Storm Drain. The property owners
will be required to join the assessment district as a condi-
tion of approval of. this map.
Noise
~::e Interstate 2.15 is located south of the proposal. A noise
s~udy was required for this proposal as the Interstate was
identified by the General Plan potentially causing noise
levels above 65 decibles~ A noise study was prepared for the
project. That study recommends that a 6 foot wall be placed
along the southern boundary of the site, along Palm Avenue
and between the lots delineated on the map attached to the
Initial Study, to mitigate the potential noise levels above
65 dB. A Condition of Approval has been added requiring a
six foot decorative block or woodcrete wall along the

7. BIOLOGICAL OVERLAY DISTR~CT
A biological survey of the project provided by Dr. Robert
Flanders, Ph.D. found no trace of endangered species of
plants or animals. The report stated that the area way is
typical of a distrubed habitat and required no mitigation.
8. COMMENTS RECEIVED
All City Departments reviewed the proposal at the Environ-
mental Review Committee meeting. The Engineering, Water,
Parks and Recreation Departments have attached Standard
Requirements. The County Flood Control Department's
recommendations have been reviewed by the Engineering Depart-
ment and included as conditions of approval where appropriate.
The San Bernardino Unified School District commented that the
project would be subject to school facility fees. The
Southern California Edison Company (SCEC) commented that the
developer would be required to furnish two copies of the
final map prior to recordation and comply with all rules and
regulations of the SCEC as filed with the Public utilities
commission for the installation of underground or overhead
electric utilities within this tract. The following agencies
recommended approval without comment: City Public Services,
County Health Department, and the Southern California Gas
company.
9. RECOMMENDATION
It is recommended that the Planning Commission:

Approve Tentative Tract NO. 14209 subject to the
following Findings of Fact (Attachment B), Condi-
tions of Approval (Attachment C), and Standard

1. The requested subdivision is in accordance with the
minimum lot development standards of the R-1-10,800
Single Family Residential Zone and is consistent with
the General Plan adopted by the Mayor and Common Council
on June 2, 1989, in that the density of the proposed
tract is 2.682 dwelling units per gross acre while the
plan will allow 3.1 dwelling per gross acre.
2. All lots created meet Municipal Code requirements in
that they and each rectangular lot has a minimum width
of 80 feet and depth of 100 feet. The irregular lots
meet code requirements.
3. The design of the sUbdivision and proposed improvements
are not likely to cause substantial environmental damage
or cause serious public health problems, in that
development will occur according to the prescribed

Minor amendments to the plan shall be subject to approval by

Perimeter walls and walls required along the rear of all double

south of Washington Avenue and west of Palm Avenue. The
project is bordered by Cable Creek on the south. The site is
approximately 3/4 mile southwest of the San Andreas fault and
approximately 2-1/2 miles northeast of the San Jacinto fault.

plan has been submitted for routing of trucks
hauling imported soil. If cut is to be exported or
fill imported above that available from the
proposed site of TT 11291, the following mit!gation

The City'S Technical Background Report (TBR)
prepared for the General Plan notes the suspected
location of the Kendall fault as near this project.
The TBR suggests further study would be required if
critical facilities were to be located nearby. The
Geological Report No. 116 submitted in 1978
preformed seven trenches on the fault. The study
found no conclusive evidence of the fault. Dr.
Williams, the City'S Consultant Geologist, reviewed
the reports and concurred with the findings. No
further studies are required of this project.
The proposal will result in development within the
High Wind Hazard area. The Verdemont Area Plan
designates this areas as a high wind area and
requires that tile roofs with hurricane clips be
installed. This is a Building and Safety
Department standard requirement for the high wind
areas.

the Biological Resources Overlay District. The
site has been bulldozed and disked. A cultural
assessment field survey found creosote bush (Larrea
tridentata), buckwheat (Eriogonum faciculatum),
white sage (Slavia apiana), elderberry (Sambucus
mexicana), cottonwood (Populus fremontii), oak
trees (Quercus sp.) and a variety of annual
grasses. None of these species require additional
study. A biological survey was conducted by Robert

fauna and flora of the site are characteristic of a
disrupted habj. tat. Disturbances appear to have
occurred repeatedly over the past several years.
The absence 'of endangered/threatened species", the
consequences of previous disturbances, the close
proximity of existing housing, and the presence of
several pest species strongly, suggest that
development of this site would not lead to the loss
of significant native habitat." .
The project could result in the exposure of people
to exterior noise levels over 65 dB. A noise study
was prepared by J. J. Van Houten & Associates. The
study found that a wall 6 feet above the elevation
of the pad would reduce the noise to below 65 dB. A

Engineer and the project does not meet the minimum
criteria for a traffic impact study as established by
the Traffic Policy Paper. The additional trips from the
proposed project are not sufficient to cause a
significant impact on the adjacent street system. Total
traffic volume will be less than the .street design
capacity. Specific design details and conditions of
approval will be considered the development review
phase. However, this project falls within the
assessment district for signalization of Palm and
Kendall and for a box culvert across Palm Avenue at the
Cable Creek Channel. A conditions of approval will be

beyond their present capability to provide adequate
levels of service. The City Fire Department reports
that'the station at 1640 Kendall Drive serves this area.
Response time is approximately four minutes. The city'
has Class II fire insurance rates because of the level
of service available t!!:rou"JIro~t)"; . . . the Ci ty. As
development continues in the Verdemont area a new
station location will be chosen. A new station is not
warranted with this development. The City Police
Department has recently moved a mobile unit to the 900
block of Kendall Drive in the Shannon Hills Shopping
Center to serve this area. Emergency calls are handled
from City Hall and the closest patrol car is sent in
response to an emergency call. Response time will vary
with the nature of the call. Names on street must be
.submitted to the Engineering Department for approval.
10.c.d. The project could impact the area schools and parks
beyond their present capabilities. Both the School
District and the City Parks Department have development
fees designated for providing services as an area
develops. .
11.a. The proposal will not require the construction of new
utility facilities. The City Water Department will
require that capacity rights be purchased. Water is
available at both Washington and Palm Avenue.
The project could result in the alteration of
destruction of prehistoric or historic archaeological
sites.. A cultural assessment was performed by Victor c.
de Munck. The study found no prehistoric or historic
cultural resources during an on-foot survey of the
study area. The report finds .no need for further
cultural resource assessment of the area. However, a
conditions of approval will be added:
