On December 6, 1993, Resolution of Intention No. 93-432 was adopted which instituted formal proceedings to form an assessment district in the Mill and Burney street area for the maintenance of landscaping. The Resolution of Intention included the assess- ing of the first year's estimated maintenance and incidentals cost as a deposit from which to fund the first actual maintenance contract and those incidental costs which will come after a one year plant guarantee period by the Developer. On July 18, 1994, a Public Meeting was held and on August 15, 1994, a Public Hearing is set to hear objections and protests to the proposed assessment. All the requirements of Chapter 12.90 of the Municipal Code were fulfilled, and on January 10, 1994, the Resolution Ordering work was adopted. The first year's esti- mated maintenance costs have been prepared and the total charges, including inciden- tals, for the 1994-95 tax roll total $11,060.00. The attached Resolution and As- sessment Roll, marked Exhibit "A" are to be placed on the 1994-95 tax roll and are presented for your confirmation. The procedural costs for establishing the District have also been spread and are attached to the Resolution as Exhibit "B". These costs total $4,181.60, and will be paid from the up-front deposit made by the Developer. " 07-28-94 -2- '5-0264 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE FIRST ASSESS- MENT ROLL FOR ASSESSMENT DISTRICT NO. 1012, FOR THE MAINTENANCE OF LANDSCAP- 3 ING ALONG PORTIONS OF POPLAR STREET, MILL STREET AND BURNEY STREET, IN THE CITY OF SAN BERNARDINO, AND APPROVING ASSESSMENT DIAGRAM MAP NO. 1012. 4 5 WHEREAS, the Mayor and Common Council of the City of San Bernardino 6 on December 6, ]993, adopted its Resolution of Intention No. 93-432, to order 7 the work described therein to be done under the provisions of Chapter 12.90 8 of the San Bernardino City Municipal Code; and 9 WHEREAS, the Mayor and Common Council on December 6, 1993, approved 10 the Engineer's Report on the proposed assessment district, which report 11 includes an estimated assessment roll and Assessment District Map relative to 12 Assessment District No. 1012; and 13 WHEREAS, pursuant to Section 54950 et seq of the Government Code, a 14 public meeting was set for July 16, 1994, and a public hearing was set for 15 August 15, 1994, at which time and place written objections and protests to 16 the proposed assessment were heard, considered and overruled; and 17 WHEREAS, an assessment roll, attached as "Exhibit B" for the cost 18 of proceedings has been prepared totaling $4,161.60, which costs will be paid 19 from an up-front deposit made by the Developer, and an assessment roll, 20 attached as "Exhibit A" has been prepared totaling $11,060.00, for the first 21 year's est_~mated assessment, including incidental expenses, which total costs " 22 are hereby approved. The spread of these costs by individual parcels is 23 established herein on Exhibits "B" and "A" attached hereto and incorporated 24 herein by reference, which sets forth the individual assessments to be levied 25 on each of the parcels of land within Assessment District No. 1012, and as shown on said assessment diagram map to meet the total procedural costs and 26 27 28 first year's maintenance costs; and WHEREAS, recognizing that the estimated first year's assessments 06/27/94 -1- 06/27/94 RESOLUTION CONFTn~ING ASSESSMENT ROLL - ASSESSMENT DISTRICT NO. 1012 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 must be collected prior to the actual maintenance by the District pursuant to said Resolution of Intention as a deposit from which to fund the actual first year's maintenance, the Mayor and Common Council do hereby determine that $11,060.00 to cover the first year's actual maintenance contract and inciden- tal costs, must be spread to individual parcels for 1994-1995, and have been spread over the individual parcels as set forth in Exhibit "A", attached hereto, which together with Exhibit "B", is hereby declared to be the Assess- ment District No. 1012 Roll for 1994-1995 for the Mill/Burney Area Landscape Maintenance District; NOW, THEREFORE, THE MAYOR AND THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO RESOLVE AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that the proportionate costs to be levied against the parcels of and within Assessment District No. 1012 are correctly set forth on Assess- ment Roll No. 1012 for the fiscal year 1994-1995, Mill/Burney Area Landscape Maintenance District, designated as Exhibit "A" for the first year's main- tenance costs, including incidentals, and as Exhibit "B" for the spreading of the total procedural incidental costs, for establishing the District, respec- tively, over the individual parcels, which Exhibits are attached hereto and are incorporated herein by reference, and the Mayor and Common Council do hereby confirm said assessments. SECTION 2. That said " Assessment Diagram Map No. 1012 is hereby approved. SECTION 3. R COUNCIL ACTION STAFF REPORT As required by the prOViSions of Chapter 12.90 of the Municipal Code and pursuant to the Brown Act, meeting and hearing dates were scheduled for the 3rd Monday in July, (July 18, 1994), and for the 3rd Monday in August (August 15, 1994) to hear protests on the first assessments for Assessment District #1012. This is the time set for the meeting to hear any protests relative to the first assessments on Assessment District #1012. No action can be taken on the pro- tests at this time and all protests are to be carried over to the hearing sched- uled for August 15, 1994. Notices were mailed to all affected property owners on June 29, 1994, stating the amount of the assessment and the dates and place of the meeting and hearing. The reason for the two different amounts shown on the Request for Council Action is as follows: Amount #1 of $4,181.60 is the cost of the proceedings to establish the district which will be paid from the deposit made by the Developer. Amount #2 of $11,060.00 is the Engineer's estimate of cost for the first year's maintenance contract to be assessed up-front as provided for in the Resolution of Intention.
