Recommended motion:
1. That the Director of Public Works/City Engineer and the City Clerk are au-
thorized to proceed with the proposed vacation of the EastfWest alley lying
between Evans and Magnolia and between "E" street and "F" Street, and the
South leg of the North/South portion of the alley along "E" Street, and as
a "City-initiated" alley vacation the vacation processing fee be waived.
2. That Plan No. 9167, showing the proposed vacation of the EastfWest alley
lying between Evans and Magnolia and between "E" Street and "F" Street and
the South leg of the North/South portion of the alley along "E" is
approved.

STAFF REPORT
A request was received from the City of San Bernardino Police Department to vacate
the East/West alley lying between Evans Street and Magnolia Street and between "E"
Street and "F" Street and the South leg of the North/South portion of the alley
lying along "E" Street.
The North leg of the East portion of the alley was vacated in March of 1992, and at
this time the homeowner at the East end of the East/West portion of the alley took
access to his carport from the alley. The vacation of the Southl'ortion of the
East leg of the alley would result in a long deadend alley and it was decided not
to vacate any but the requested portion (the North leg).
Approximately 6 months after the North leg was vacated, the American Red
wanted to vacate the South portion of the East leg but they could not work
compromise with the above property owner and at this time their vacation
remains at a standstill.

The current request by the San Bernardino Police Department, along with the cooper-
ation of the Code Enforcement Department, effectively eliminates the access prob-
lems and allows the City to vacate all the EastjWest portion of the alley, as well
as the South portion of the East leg of the alley. The only portion of the alley
which will remain open to public use is the West leg closest to "F" Street.

The San Bernardino Police Department is requesting the City initiated
vacation of the East/West alley North of the 500 block of West Magnolia.
This request is due to the question of Public Safety. There has been a total
of 58 calls for service in the past six months and one PC187 (Homicide).
These problems are a direct result of the alley. This alley gives no access
to the occupied residences to the North and South of the alley. There is
also no garbage pick up in this alley.
