MOTION C: That the Community Development Commission award a bid in the amount of
$239,500 to N.B.I. General Contractors of San Bernardino for the construction
of tenant and parking lot improvements at 532 North "D" Street for the Mexican
Consulate and authorize $15,200 for engineering and inspection services.
Further authorize staff to administer and execute change order, limited to the
amount of the contingency ($38,205).
MOTION D: That the Community Development Commission authorize the Executive Director
to draft and execute a lease and all other necessary document swith the consulate
of Mexico for the lease of 532 North "D" Street.

Award of Trade Bid - Mexican Consulate Teuant Imorovement
This staff report requests Commission approval to award a bid for tenant and parking lot
improvements at 532 North "D" Street for the relocation of the Mexican Consulate from its
current address at 588 West 6th Street.
Background
On May 16, 1994, the Community Development Commission appropriated $325,000 in bond
proceeds to finance the code required improvements and tenant improvements related to the
relocation of the Mexican Consulate to 532 North "D" Street. The Commission also took action
in February and May of 1993 to conceptually approve the proposed relocation of the Consulate.
Mexican government officials have accepted terms of .90 cents a square foot gross for a five (5)
year lease. On July 26, 1994, four (4) bids were received and opened by the Public Works
Department.
Low Bidder
Bids received for the subject project range from $240,500 to $308,267. Of the four (4) bids
received, N.B.I. General Contractors of San Bernardino was the apparent low bidder with a base
bid of $240,500. Staff has accepted a bid alternative for interior finishes which produced a credit
of$l,OOO.OO, which reduced the bid to $239,500.
Subsequent to the review ofN.B.!. submitted materials by staff and the City Attorneys office, it
was determined N.B.!. showed adequate evidence of "good faith effort". While the developer did
not achieve the Agency "goal" of fifteen (15%) Minority Business Enterprise (MBE) and five
(5%) Women Business Enterprise (WBE) participation, its good faith efforts to meet these goals
were present, as evidenced by media solicitation, attendance at relevant meetings, solicitation and
responses by letter and direct contact with state governmental entities. Such efforts resulted in
projected MBE utilization of twelve (12%) and WBE utilization of three (3%).

The second lowest bidder, Gridiron Construction, was disqualified from bidding because its
individual unit bid prices did not equal or add up to its total bid price, which must occur in order
to have a completed and responsive bid. The third lowest bidder, Wyatt Construction, met the
minimum MBE/WBE goals, but its base bid is $56,000 more than the low bid. Staffhas
consulted with Agency Counsel and is advised that it is appropriate to bring forward the low
bidder, N.B.I., for the Commission's consideration.

Mutual Benefit Findings
Whenever a project is completed in a specific project area and that project area lacks sufficient tax
increment or bond proceeds from which to fund the project, the Common Council and
Community Development Commission are required to adopt mutual benefit resolutions if tax

increment or bond proceeds are the only funding source available. The adoption of mutual benefit
resolutions allows the Agency to use tax increment or bond proceeds from one project area for
the benefit of another project area lacking sufficient funds.
The findings in the attached, and more detailed, mutual benefit resolutions deal with the recent
change in redevelopment law which stipulates that the Council and Commission find that the
project in the recipient project area Central City North eliminates a blighting condition in other
project areas. Since blight by definition can be economic as well as physical, staff contends that
the tenant and parking lot improvements will enhance the Consulate's ability to better serve its
broadly located patrons. Currently, the Consulate occupies a very cramped building with no
available visitor parking. The office layout for the tenant improvement provides a more efficient
means of processing various service needs. Due to the ability of the Consulate to improve its
service ability, citizens of Mexican origin, throughout the city and by extention region, will be
able to better assimilate into the San Bernardino community and obtain the right to work in the
United States. As a result, the income of those served by the Consulate will increase, helping to
alleviate economic blight in the project areas in which they live. Further, the provision of such
services via a more efficient facility will be a benefit to the area and viewed by investors
positively, thus promoting investment throughout the city and within the various project areas.
Recommendation
The construction of tenant and parking lot improvement at 532 North "D" Street will reactivate a
formally dormant comer. For years, the northwest comer of 5th and "D" Streets has been a
vacant, blighted comer in need of a tenant or development. The relocation of the Mexican
Consulate is a positive step in our redevelopment efforts.
Staff recommends adoption of motions "A", "B", "C" and "D".

AGENCY (532 NORTH "D" STREET BUILDING)
WHEREAS, the City of San Bernardino, California (the
"City"), is a municipal corporation and a charter city duly
created and existing pursuant to the Constitution and the laws of
the State of California; and
WHEREAS, the Community Development Commission of the
City of San Bernardino (the "Commission") on behalf of the
Redevelopment Agency of the City of San Bernardino (the
"Agency"), is a redevelopment agency, a public body, corporate
and politic of the State of California, organized and existing
17 pursuant to the Community Redevelopment Law (Part 1 of
Division 24 commencing with Section 33000) of the Health and
Safety Code of the State of California (the "Act"); and
WHEREAS, pursuant to Section 33445 of the Act, the
Agency may, with the consent of the Mayor and Common Council of
the City (the "Council"), pay all or a part of the cost of
installation and construction of any building,
facility,
structure or other improvement which is publicly owned either
within or without the boundaries of a redevelopment project area
if the Council determines: (1) that such buildings, facilities,
structures or other improvements are of benefit to the

redevelopment project area or the immediate neighborhood in which
the project is located, regardless of whether such improvement is
within another project area, or in the case, of a project area in
which substantially all the land is publicly owned that the
improvement is of benefit to an adjacent project area of the
Agency, (2) that no other reasonable means of financing such
buildings, facilities, structures or other improvements is
available to the community, and such determination by the Agency
and the Council shall be final and conclusive, and (3) that the
payment of funds for the cost of the facilities, structures or
other improvements will assist in the elimination of one or more
blighting conditions inside the project; and
WHEREAS, the City and the Commission have previously
approved and adopted Redevelopment Plans (collectively
hereinafter referred to as the "Redevelopment Plans") for various
redevelopment project areas within the City which project areas
include: the Meadowbrook-Central City Project Area, Central City
North Project Area, Central City East Project Area, Central City
South Project Area, Central City West Project Area, Tri-Cities
proj ect Area, Southeast Industrial Park Redevelopment proj ect
Area, South Valle Project Area, State College Project Area,
Northwest Project Area and the Mt. Vernon Project Area; and
WHEREAS, it is in the interests of the present
landowners within the various project areas subject to the
Redevelopment Plans (the "proj ect Areas") and the residents, both
within the Project Areas and within the City generally, that the

Agency causes the construction and rehabilitation of a certain
publicly owned commercial office building of the Agency located
at 532 North "D" Street in the City (the "Project"); and
WHEREAS, the Project Areas presently suffer from a high
degree of impaired investments and depreciated values along with
high business vacancies which conditions are being exacerbated by
the lack of economic opportunities within the various Project
Areas; and
WHEREAS, the Project Areas also suffers from factors
which prevent or substantially hinder the economically viable use
or capacity of buildings and lots; and
WHEREAS, in order to ensure continued investment and
growth in the Project Areas, the residents and occupants of the
Project Areas are having to avail themselves of economic
opportunities and services in the central business district which
opportunities and services are often provided by governmental
offices located in the central business district; and
WHEREAS, the proj ect, which consists of the
construction and rehabilitation of the Agency's office building,
will allow for the rental and occupancy within said building by
the Consulate General's offices for the Government of Mexico; and
WHEREAS, the population of Mexican nationals within the
City accounts for approximately thirty-five (35%) of the entire

population of the City according to recent census information;
and
WHEREAS, the Mexican Consulate General provides a full
range of social and economic services and opportunities to the
community, including but not limited to, the issuing of visa's,
the initiation of cultural and economic exchanges, the provision
of relocation assistance, the assistance in criminal and civil
investigations and the intervention of legal matters, which
services are relied upon by residents and occupants of the
Project Areas and the City generally; and
WHEREAS, the Project is located within a portion of the
central city area of the City of which suffers from a lack of
business opportunities as well as inadequate and deteriorating
office space facilities and which area is patronized by residents
and occupants of the Project Areas who pursue employment, seek
business opportunities and who rely on the provision of economic,
social and civic services provided by governmental businesses
including the Mexican Consulate; and
WHEREAS, the central city area suffers from high
vacancy rates and the location of the Mexican Consulate within
such area will help alleviate such vacancy rate both from its own
occupancy of office space as well as the occupancy of nearby
space by businesses and offices that typically congregate in
proximity to Consul offices; and

WHEREAS, the undertaking of the Project in the downtown
area of the City, wherein residents of the Project Areas and the
City generally may avail themselves of economic opportunities as
well as civic and commercial services, will provide a benefit for
the Project Areas and the residents of the adjacent neighborhoods
who participate in activities or who are employed in the downtown
area; and
WHEREAS, in order to promote the City's health, safety
and welfare, it is important that the Project be financed in
order to ensure the orderly development of the Project Areas and
neighboring areas; and
WHEREAS, it is appropriate at this time for the Council
to make certain findings and determinations and take certain
action with respect to the undertaking of the Project.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO, CALIFORNIA, DO HEREBY FIND, RESOLVE,
DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Recitals hereinabove are true and
correct and are incorporated herein by this reference.
SECTION 2. The Council consents to the payment by
the Agency of the costs of the Project to be undertaken in the
central business district which are of benefit to the Project
Areas and other neighborhoods within the City for the reasons set

forth in the Recitals hereinabove. The Council also finds and
determines that no other reasonable means of financing of the
Project is presently available to the City and that the City and
the Agency require the use of revenues generated from the various
Project Areas in order to fund the Project. The Council further
finds that the Project will enhance the desirability of the City
for economic investment which in turn will enhance economic
viability in the Project Areas thereby eliminating existing
blighting conditions in the Project Areas.
SECTION 3. The construction of the Project in the
downtown area will make the central business district more
economically viable through the reduction of otherwise high
vacancy rates and elimination of factors hindering the economic
viability of downtown buildings which will thereby make the
entire City and the Project Areas more desirable for development
which will in turn help eliminate blight within the Project Areas
and other areas of the City.
SECTION 4. The City Clerk is hereby authorized and
directed to cause this Resolution to be transmitted to the Agency
for consideration in connection with appropriate action by that
body.

Northwest Project Area and the Mt. Vernon Project Area; and
WHEREAS, it is in the interests of the present
landowners within the various project areas subject to the
Redevelopment Plans (the "Project Areas") and the residents, both
within the Project Areas and within the City generally, that the

1 Agency causes the construction and rehabilitation of a certain
2 publicly owned commercial office building of the Agency located
3 at 532 North "D" Street in the City of (the "Project"); and
4
5 WHEREAS, the Project Areas presently suffer from a high
6 degree of impaired investments and depreciated values along with
7 high business vacancies which conditions are being exacerbated by
8 the lack of economic opportunities within the various Project
9 Areas; and
10
11 WHEREAS, the Project Areas also suffer fron factors
12 which prevent or substantially hinder the economically viable use
13 or capacity of buildings and lots; and
14
15 WHEREAS, in order to ensure continued investment and
16 growth in the Project Areas, the residents and occupants of the
17 Project Areas are having to avail themselves of economic
18 opportunities and services in the central business district which
19 opportunities and services are often provided by governmental
20 offices located in the central business district; and
21
22 WHEREAS, the proj ect, which consists of the
23 construction and rehabilitation of the Agency's office building,
24 will allow for the rental and occupancy within said building by
25 the Consulate General's offices for the Government of Mexico; and
26
27 WHEREAS, the population of Mexican nationals within the
28 City accounts for approximately thirty-five (35%) of the entire

1 population of the City according to recent census information;
2 and

4 WHEREAS, the Mexican Consulate General provides a full
5 range of social and economic services and opportunities to the
6 community, including but not limited to, the issuing of visa's,
7 the initiation of cultural and economic exchanges, the provision
8 of relocation assistance, the assistance in criminal and civil
9 investigations and the ir,tervention of legal matters, which
10 services are relied upon by residents and occupants of the
11 Project Areas and the City generally; and
12
13 WHEREAS, the Project is located within a portion of the
14 central city area of the City of which suffers from a lack of
15 business opportunities as well as inadequate and deteriorating
16 office space facilities and which area is patronized by residents
17 and occupants of the Project Areas who pursue employment, seek
18 business opportunities and who rely on the provision of economic,
19 social and civic services provided by governmental businesses
20 including the Mexican Consulate; and
21
22 WHEREAS, the central city area suffers from high
23 vacancy rates and the location of the Mexican Consulate within
24 such area will help alleviate such vacancy rate both from its own
25 occupancy of office space as well as the occupancy of nearby
26 space by businesses and offices that typically congregate in
27 proximity to Consul offices; and

1 WHEREAS, the undertaking of the proj ect in the downtown
2 area of the City, wherein residents of the Project Areas and the
3 City generally may avail themselves of economic opportunities as
4 well as civic and commercial services, will provide a benefit for
5 the Project Areas and the residents of the adjacent neighborhoods
6 who participate in activities or who are employed in the downtown
7 area; and
8
9 WHEREAS, in order to promote the City's health, safety
10 and welfare, it is important that the Project be financed in
11 order to ensure the orderly development of the Project Areas and
12 neighboring areas; and
13
14 WHEREAS, it is appropriate at this time for the Agency
15 to make certain findings and determinations and take certain
16 action with respect to the undertaking of the Project.

18 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION
19 ACTING ON BEHALF OF THE REDEVELOPMENT AGENCY OF THE CITY OF
20 SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
21 FOLLOWS:

23 Section 1. The Recitals hereinabove are true and
24 correct and are incorporated herein by this reference.

26 Section 2. The Agency approves the payment by the
27 Agency of the costs of the Project to be undertaken in the
28 central business district which are of benefit to the Project

1 Areas and other neighborhoods within the City for the reasons set
2 forth in the Recitals hereinabove. The Agency also finds and
3 determines that no other reasonable means of financing of the
4 Project is presently available to the City and that the City and
5 the Agency require the use of revenues generated from the various
6 Project Areas in order to fund the Project. The Agency further
7 finds that the Project will enhance the desirability of the City
8 for economic investment which in turn will enhance economic
9 viability in the Project Areas thereby eliminating existing
10 blighting conditions in the Project Areas.

12 Section 3. The construction of the Project in the
13 downtown area will make the central business district more
14 economically viable through the reduction of otherwise high
15 vacancy rates and elimination of factors hindering the economic
16 viability of downtown buildings which will thereby make the
17 entire City and the Project Areas more desirable for development
18 which will in turn help eliminate blight within the Project Areas
19 and other areas of the City.

21 Section 4. The Agency Secretary is hereby
22 authorized and directed to cause this Resolution to be
23 transmitted to the City for consideration in connection with
24 appropriate action by that body.

DETERMINATIONS AS TO THE BENEFIT OF CERTAIN IMPROVEMENTS FOR THE

Section 5.
The findings and determinations herein
shall be final and conclusive. This Resolution shall take effect
upon the date of its adoption.
