Synopsis of Previous Council action:
01-04-87 -- Resolution No. 87-35 adopted authorizing execution of
Development Agreement with State.
June, 1987- Allocation of $2,330,408 approved in 1986/87 Budget
for design and construction.
09-19-88 Plans approved and authorization granted to advertise
for bids.
03-20-89 Resolution No. 89-85 adopted, awarding a contract for
the low bid price of $2,018,625.32.
05-15-89 -- Addition of underground electrical services and a
restroom building to the contract for Phase I-B approved.
06-19-89 Change Order No. One approved, increasing the contract
price by $29,555.00 from $2,018,625.32 to $2,048,180.32.

Recommended motion:
That Change Order No. Five to the contract with Marina Contractors,
Inc., for the construction of Seccombe Lake Park, Phase I-B, in
accordance with Plan No. 7444, be approved; to authorize the Con-
tractor to install heavy duty plastic toilet partitions in lieu
of laminated metal toilet partitions, within the three restroom
buildings, for an increase in the contract price of $10,468.75,
from $2,116,197.72 to $2,126,666.47/A..

RIEQUIEST QR COUNCIL ACTION
STAFF REPORT
The contract documents prepared by the Architect for this
project specified laminated metal toilet partitions for the
restroom buildings. The Parks and Recreation Department has re-
quested that heavy duty plastic toilet partitions be installed,
due to greater durability and resistance to vandalism.
The Contractor has quoted a price of $10,468.75 for sub-
sti tuting heavy-duty plastic partitions in lieu of laminated
metal. This price has been verified by the Parks and Recreation
Department as being consistent with the difference in prices for
these two materials.
Change Order No. Five will authorize the Contractor to
install the heavy duty plastic partitions, in lieu of laminated
metal, for an increase in the contract price of $10,468.75.
An amount of $106,000 has been transferred from Account
No. 243-363-57528, "Patton Park Development," to Account No. 243-
363-57502, "Seccombe Lake Restroom & Electrical Work." These
funds can be used to finance the cost of this change order, since
the restroom building will not be constructed by this contract.
Costs for repair of vandalism will be significantly less
for the plastic partition. It is expected that the difference in
cost can easily be recovered during the life of the restroom
buildings. Therefore, we recommend that Change Order No. 5 be
approved.
SYNOPSIS OF PREVIOUS COUNCIL ACTION Continued:
07-17-89 - Change Order No. Three approved, to authorize the in-
stallation of electrical service, for an increase of
$27,057.60 in the contract price, from $2,048,180.32
to $2,075,237.92.
URGENCY CLAUSE
Due to the long lead time required to procure the partitions, the
decision to install the toilet partitions should be made as soon
as possible, in order to avoid any potential delays in the com-
pletion of the project.

Gentlemen:
You are hereby authorized and directed to furnish and install
Santana heavy duty, solid plastic toilet partitions, in lieu
of laminated metal partitions, in the restroom/concession
buildings. and the picnic restroom building, at an additional
cost of $10,468.75 to the contract price.
Toilet partitions shall be installed in accordance with the
manufacturer's recommendations, and as directed by th&
Engineer.
