The joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino was called to order by Mayor/Chairman Morris at 5:09 p.m., Tuesday, June 28, 2011, in the Economic Development Agency Boardroom, 301 N. "E" Street, San Bernardino, California. Roll Call Present: Mayor/Chairman Morris; Council Members/Commissioners Marquez, Brinker, Shorett, Kelley, Johnson, McCammack; City Attorney Penman, City Manager McNeely; City Clerk Clark. Absent: None Vacant: Second Ward. 1 06/28/2011 1. Closed Session Pursuant to Government Code Section(s): A. Conference with legal counsel - existing litigation - pursuant to Government Code Section 54956.9(a). B. Conference with legal counsel - anticipated litigation - significant exposure to litigation - pursuant to subdivision (b) (1), (2), (3) (A -F) of Government Code Section 54956.9. C. Conference with legal counsel anticipated litigation - initiation of litigation - pursuant to subdivision (c) of Government Code Section 54956.9. D. Closed Session - personnel - pursuant to Government Code Section 54957. E. Conference with real property negotiator - pursuant to Government Code Section 54956.8. The Mayor and Common Council did not recess to closed session during this meeting. 2 06/28/2011 2. Budget Workshop and Deliberations - Fiscal Year 2011/12 - City, Capital Improvement Program, and EDA Budgets (Continued from June 23, 2011) Public Works The following document was distributed and a PowerPoint presentation was made by Robert Eisenbeisz, City Engineer: • City of San Bernardino FY 2011-2012 / 2015-2016 CIP (Capital Improvement Program) Council Member/Commissioner McCammack declared that she had a conflict with any items in the CIP relating to sbX and Omnitrans as they are clients of her business. Council Member/Commissioner Brinker declared a conflict on the Hunts Lane Grade Separation as he lives within 500 feet of that project. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner McCammack, that the City of San Bernardino FY 2011- 2012 / 2015-2016 CIP be approved. City Attorney Penman stated that a formal resolution would be forthcoming that would contain the Council CIP conflicts and recommended that no action be taken until that time. The motion and second were withdrawn. Community Development The following document was distributed and a PowerPoint presentation was made by Margo Wheeler, Director of Community Development: • Community Development Fiscal Year 2011-12 Preliminary Departmental Budget. Police The following documents were distributed and a PowerPoint presentation was made by Keith Kilmer, Chief of Police: • Police Department Fiscal Year 2011-12 Preliminary Departmental Budget; and Summary of Year -To -Date Part I Crime - June 2011. 3 06/28/2011 Fire The following document was distributed and a PowerPoint presentation was made by Michael Conrad, Fire Chief: • Fire Department Fiscal Year 2011-12 Preliminary Departmental Budget. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner McCammack, that the Emergency Medical Services (EMS) fee be put back into the Fire Department rather than the General Fund in order to alleviate staffing issues. Council Member/Commissioner McCammack made a substitute motion that subcategories be added under the general fund line item to show how much revenue departments receive from each program. Council Member/Commissioner Brinker suggested that this issue be sent to the Ways and Means Committee for further discussion. City Attorney Penman stated that they don't really have a program budget because legal costs and costs of litigation are not figured into any of the departments. Council Member/Commissioner McCammack suggested that whatever revenues come in from those account numbers that help determine what the budget for that department will be, based on the revenue they bring in, should be listed under the line item under (C) for funding sources, maybe as a subcategory of the general fund. Council Member/Commissioner McCammack amended her motion, seconded by Council Member/Commissioner Kelley, that any funding sources that have some subcategories that are being included as part of the general fund contribution be listed under funding sources. Council Member/Commissioner Brinker stated that he didn't like the fact that there is no specific line item for pensions and health care benefits in this budget and he repeated his desire that this issue be discussed at the committee level. Council Member/Commissioner McCammack amended her motion, seconded by Council Member/Commissioner Kelley, that the addition of pension expenses, health benefits and revenue line items to the budget summary page be added to the final program budget. The motion failed with Marquez, Brinker, Shorett and Johnson voting "no." 4 06/28/2011 Council Member/Commissioner Brinker made a motion, seconded by Council Member/Commissioner Shorett, that the addition of pension expenses, health benefits and revenue line items to the budget summary page of future budgets be referred to the Way and Means Committee for further discussion. The motion carried with McCammack voting "no." Parks, Recreation and Community Services The following documents were distributed and a PowerPoint presentation was made by Kevin Hawkins, Director of Parks, Recreation and Community Services: • Parks, Recreation and Community Services Department Fiscal Year 2011- 12 Preliminary Department Budget; and Parks brochure City of SanBernardinonews. Discussion ensued regarding Landscape Maintenance Districts (LMDs). Council Member/Commissioner Kelley stated that he would like to explore the option of contracting out some of the LMDs and shifting those employees over to the parks side in order to improve the level of services at the parks. He recommended that this matter be discussed at the committee level in order to look at ways of finding an additional revenue source. Council Member/Commissioner McCammack requested that staff look into the possibility of allowing private companies that have an office in the City and hold a valid business registration to pay to sponsor the site in exchange for advertising at the site. Barbara Pachon, Director of Finance, stated that parks maintenance workers have to be funded from revenues that come into the general fund and LMD revenues can only be used in LMD areas. Council Member/Commissioner Brinker stated that they should consider changing the landscaping entirely to something that requires little or no maintenance. Council Member/Commissioner Johnson stated that this was a good opportunity to partner with some of the neighborhood organizations to look at some adopt -a - park programs and to expand conservation efforts to other parks. Library The following document was distributed and a PowerPoint presentation was made by Deborah Clark, Interim Library Director: • Library Department Fiscal Year 2011-12 Preliminary Departmental Budget. 5 06/28/2011 R3. Budget Adoption Fiscal Year 2011-2012 - Economic Development Agency (Continued from June 23, 2011) Resolution of the Mayor and Common Council of the City of San Bernardino, California, authorizing the funding of various City of San Bernardino Fiscal Year 2011-2012 public improvement expenditures and making findings and determinations pursuant to Health & Safety Code Sections 33445 and 33445.1 as to the benefit to the various redevelopment project areas for undertaking public improvements in connection with these various City expenditures. (R3A) Resolution of the Mayor and Common Council of the City of San Bernardino, California approving the execution and delivery of an Agency - City 2011-2012 Loan Agreement and 2011-2012 Note of the City of San Bernardino ("City") payable to the Redevelopment Agency of the City of San Bernardino ("Agency") in the principal amount equal to $1,356,250 for the repayment of the $1,332,925 principal amount of the 2010-2011 Note payable from the City to the Agency. (R3B) Resolution of the Mayor and Common Council of the City of San Bernardino, California approving a Master Services Agreement for Fiscal Year 2011-2012 by and between the Redevelopment Agency of the City of San Bernardino ("Agency") and the City of San Bernardino ("City") and authorizing the Agency's payment to the City for the performance of certain functions by City Departments for the benefit of the Agency. (R3C) Resolution of the Community Development Commission of the City of San Bernardino, California, approving the Economic Development Agency's budget for the Fiscal Year 2011-2012 with any such amendments, changes and modifications that may be specifically authorized by said Commission, except for those portions of certain budget lines which are related to the Central City Projects Redevelopment Area and the Uptown Redevelopment Project Area. (R3D) Resolution of the Community Development Commission of the City of San Bernardino, California, approving the Economic Development Agency's budget for those portions of certain budget lines which are related to the Uptown Redevelopment Project Area for the Fiscal Year 2011-2012 with any such amendments, changes and modifications that may be specifically authorized by said Commission. (R3E) 6 06/28/2011 Resolution of the Community Development Commission of the City of San Bernardino, California, approving the Economic Development Agency's budget for those portions of certain budget lines which are related to the Central City Projects Redevelopment Project Area for the Fiscal Year 2011- 2012 with any such amendments, changes and modifications that may be specifically authorized by said Commission. (R3F) Resolution of the Community Development Commission of the City of San Bernardino, California, authorizing the funding of various City of San Bernardino Fiscal Year 2011-2012 public improvement expenditures and making findings and determinations pursuant to Health & Safety Code Sections 33445 and 33445.1 as to the benefit to the various redevelopment project areas for the undertaking of various public improvements. (113G) Resolution of the Community Development Commission of the City of San Bernardino, California, approving the Economic Development Agency's analysis and determination of the appropriateness of the planning and administration expenditures of the Low- and Moderate -Income Housing Fund for the Fiscal Year 2011-2012 Agency Budget. (R3H) Resolution of the Community Development Commission of the City of San Bernardino, California, approving a Master Services Agreement for Fiscal Year 2011-2012 by and between the Redevelopment Agency of the City of San Bernardino ("Agency") and the City of San Bernardino ("City") and authorizing the Agency's payment to the City for the performance of certain functions by City Departments for the benefit of the Agency. (R3K) 7 06/28/2011 Resolution of the Community Development Commission of the City of San Bernardino, California, authorizing the Economic Development Agency to continue expenditures for those portions of certain budget lines, which are related to the Central City Projects and Uptown Redevelopment Project Areas, at the budgeted level for the 2010-2011 Fiscal Year, with allowance for those budgeted items having prior Commission approval, pending final approval of the 2011-2012 budget. (R3L) There was no discussion or action taken regarding the Economic Development Agency budget. This item was continued to the budget meeting of June 29, 2011. 4. City of San Bernardino Budget Adoption - FY 2011/12 Resolution of the Mayor and Common Council approving and adopting the City of San Bernardino's final budget document for Fiscal Year 2011-2012 and proclaiming the continuation of a fiscal emergency and establishing the City's appropriation limit as required by Article XIII B of the California State Constitution. (4A) Resolution of the Mayor and Common Council of the City of San Bernardino, California, proclaiming the continuation of a fiscal emergency and authorizing the City of San Bernardino to establish 2011/2012 expenditures for the month of July, 2011 only, at one -twelfth the actual levels contained in the adopted budget for 2010/2011 Fiscal Year, or as needed to pay the authorized costs incurred for the month of July, 2011 only pending final approval of the 2011-2012 budget. (4B) No discussion or action was taken regarding the City's budget. This item was continued to the budget meeting of June 29, 2011. 5. Adjournment At 9:20 p.m., the meeting adjourned to 5 p.m., Wednesday, June 29, 2011, in the Economic Development Agency Boardroom, 201 North "E" Street, San Bernardino, California, to discuss the FY 2011/12 City and EDA budgets. The next joint regular meeting of the Mayor and Common Council/Community Development Commission is scheduled for 1:30 p.m., Tuesday, July 5, 2011. RACHEL G.
