3ynopsis of Previous Council action:
06-15-94 -- Notices mailed to all affected owners of proposed increases in the
94/95 Parking District assessments, and of dates for meeting and
hearing set to hear protests of the increases.
07-05-94 -- Public meeting held on increased Assessments proposed for 94/95
Assessment Rolls for both the primary district (RollI) and for the
expansion of facilities district (Roll 2), and all protests were
carried over to the August I, 1994 meeting.
Recommended motion:
Motion 1:
That the hearing be closed and the protests, if any, be overruled, and that the 93/94
Assessment Rolls be approved as the 94/95 Assessment Rolls for both the primary roll and
for the expansion of facilities roll.
Motion 2:
Adopt the Resolutions.

STAFF REPORT
This is the time set for the hearing to hear and pass on any protests relative
to the increases in the two Parking District assessment rolls proposed for FY
1994/95. A public meeting was held on July 5, 1994, and the protests were
carried over to this hearing.
The necessary Resolutions and the 1994/95 Assessment Rolls attached thereto as
Exhibit "A" were attached to the previous Request for Council action/agenda item
dated June 13, 1994 for your consideration at the Public Meeting set for the
July 5, 1994 Council Meeting. Now is the time for your consideration of said

As required, the proposed 94/95 Assessment Rolls were submitted to the Central
City Parking Place Commission for approval at their meeting of 7-14-94, however,
after some discussion of the proposed increases a motion was made and so
approved "not" to approve the proposed increases, but to approve the 93/94
Assessment Rolls as the 94/95 Assessment Rolls, with said revisions to be made
where needed in the two Assessment Rolls and Resolutions, and that said changes
be presented to the Mayor and Council for their consideration and approval at
the 8-1-94 scheduled Public hearing on this matter.
staff recommends the approval of the 93/94 Assessment Rolls as the 94/95
Assessment Rolls, and that the substituted Resolutions Confirming the 94/95
Assessment Rolls be adopted.
Note: The amount(s) on Page 2 and in the Exhibit "A" attachment have been
changed by substitution of said Page 2 and said Exhibit "A" in both of the
Resolutions dated 6-13-94 as previously submitted for your consideration at the
July 5, 1994 public meeting held on this matter.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1994-95 ASSESSMENT
ROLL, EXPANSION OF FACILITIES FOR THE CENTRAL CITY PARKING DISTRICT.
WHEREAS, by Resolution No. 12613, the Mayor and Common Council
found that the public interest, convenience, and necessity required the
formation of a parking improvement district: and
WHEREAS, by said Resolution No. 12613 the Mayor and Common Council
of the City of San Bernardino formed a parking improvement district for the
purpose of providing public off-street parking facilities in the City of San
Bernardino pursuant to the provisions of Ordinance No. 3589 relating to the
establishment, financing, operation, and maintenance of vehicle off-street
parking within the City: and
WHEREAS, said Resolution No. 12613 declared that all the land
included within the boundaries of said parking improveaent district will be
15 benefited by the parking improvements to be constructed; and
16 WIlRVEAS, by Resolution No. 79-208, the Mayor and Co_on Council
:17 found and determined that the public convenience and necessity required the
18 acquisition and installation of property improvements for providing addition-
19 al off-street public parking facilities within the Central City Parking
20 District: and
21 WHEREAS, by Resolution No. 79-207, the Mayor and Common Council
22 declared that an annual ad valoro assesslltlnt shall be levied on all land
23 within the District to provide aoneys for any or all of the purposes set
24 forth in Section 2 of the off-street Parking Ordinance and in particular to
25 pay all or any part of the costs and expenses of providing such additional
26 parking place improvements: and

WHEREAS. an Assessment Roll has been prepared totaling S 30.299.43
which sets forth the individual assessments for the Expansion of Facilities
to be levied on each of the parcels of land within the Central City Parking
District;
NOW 'rIIElmFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Co.on Council do hereby find and
determine that the proportionate costs to be levied for the Expansion of
Facilities against the parcels of land within the Central City Parking Dis-
trict are correctly set forth on the 1994-95 Expansion of Facilities for the
Central City Parking District Assessment Roll. designated as Exhibit "A" and
attached hereto. and do hereby confirm said assessments.
SECTION 2. That the City Clerk is directed to cause a copy of this
Resolution to be transmitted to the Office of the Auditor-Controller for the
County of San Bernardino with the request that the individual assessments be
placed on the subject 1994-95 property tax bills for collection together
with all other property taxes.

4 WHEREAS, by Resolution No. 12613, the Mayor and Common Council

funding for the acquisition and improveaent of parking spaces, the lIain-
tenance and operation thereof and the furnishing of security therefor; and
WHEREAS, by Resolution No. 79-207 the Mayor and Common Council
declared that an annual advalorem assessment shall be levied to provide
moneys for any and all of the purposes set forth in Section 2 of the Off-
Street Parking Ordinance and in particular, to pay all or any part of the

costs and expenses of providing additional parking place improvements; and
WHEREAS, pursuant to Resolution No. 79-207 and that certain "Park-
ing Facilities Lease" dated for convenience as of February I, 1977 between
the City and the Redevelopment Agency (RDA), any assessment levy necessary to
pay the rent due from the City to the RDA of the City of San Bernardino shall
be a separate and distinct assessment. In determining said annual assess-
ment, the Mayor and Common Council may include in addition to other costs of
providing the addition of parking place improvements an amount necessary for
the establishment, maintenance and replenishment of reasonably required
reserve funds; and
WHEREAS, an Assessment Roll has been prepared totaling
$ 137,426.97, which sets forth the individual assessllents to be levied on
each of the parcels of land within the Central City Parking District;
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and C080n Council do hereby find and
determine that the proportionate costs to be levied against the parcels of
land within the Central City Parking District are correctly set forth on the
1994-95 Central City Parking District Assessment Roll, designated as Exhibit
"A" and attached hereto, and do hereby confirm said assessments.
