'-'" STAFF REPORT As required by the provisions of Chapter 12.92 of the Municipal Code and Chapter 27 of the California streets and Highways Code. the annual assessment roll relative to the In-fill Street Improvement Project (1990-03) at various locations within the City of San Bernardino. has been prepared and is attached to the Resolution. This roll is the second of three annual assessment rolls to be processed under this project. The original assessment roll and assessment amounts were approved as set out in Exhibit "A" of Resolution No. 93-127. The roll for 1994-95 totals $ 8,064.59 and is submitted to your Honorable Body for action as required. 07/11/94 2 5.0264 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 c "'"' -...) 1 RESOLUTION NO. 2 A RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1994-95 ASSESSMENT ROLL FOR THE 1990-03 IMPROVEMENT PROJECT UNDER CHAPTER 27 OF THE IMPROVEMENT 3 ACT OF 1911 AND CHAPTER 12.92 OF THE SAN BERNARDINO MUNICIPAL CODE. 4 WHEREAS, pursuant to the provisions of Chapter 27 of the 5 Improvement Act of 1911 and Chapter 12.92 of the San Bernardino Municipal 6 Code, the Mayor and Common Council of the City of San Bernardino did on the 7 11th day of March, 1991, order the construction of certain improvements by 8 property owners of various properties within the City of San Bernardino, 9 which construction was to be commenced by January 25, 1991; and 10 WHEREAS, the said construction was not commenced by said date and the Director of Public Works/City Engineer caused said work to be done; and WHEREAS, by Resolution No. 93-127, the Mayor and Common Council declared that all of the properties listed in the Engineer's Report that reaained unpaid for five (5) days from the date of said Resolution would be assessed for the costs as listed in said Engineer's Report over a period of three years until the said sums with interest at the rate of 77. per annum on the unpaid balance are paid in full; and WHEREAS. an Assessment Roll has been prepared totaling $8.064.59, which sets forth the individual assessments to be levied on each of the parcels of land within Chapter 27 Project No. 1990-03 for the fiscal year 1994-95. including interest. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO RESOLVE AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that the costs to be levied against the parcels of land within Chapter 27 Project No. 1990-03 for the fiscal year 1994-95. designated as Exhibit "A" and incorporated herein by reference. are correctly set forth and do hereby confirm said assessment. SECTION 2. That pursuant to Section 5893 of the Streets and Highways Code of the State of California. the City Clerk is directed to cause a copy of this Resolution and a list of the unpaid assessments for 1994-95 including interest. to be transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the request that the individual assessments be placed on the subject property tax bills for collection together with all other property taxes.
