HomeMy WebLinkAbout46-Mayor 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ~;;". :)LTERNATIVE '-" 1 ORDINANCE NO. 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 2.64.050 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO FEES 3 FOR APPEALS 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 SECTION 1. Section 2.64.050 of the San Bernardino 6 7 Municipal Code is hereby amended to read as follows: 8 9 "a. The notice of appeal shall be in writing and shall set forth (a) the specific action appealed from, (b) the 10 specific grounds of appeal, and (c) the relief or action sought from the Common Council. The notice of appeal shall be accompanied by a non-refundable appeal fee of Seventy- five Dollars ($75.00). In the event any notice of appeal fails to set forth any information required by this section or to include the specified appeal fee, the City Clerk shall return the same to the appellant with a statement of the respects in which it is deficient, and the appellant shall thereafter be allowed five days in which to perfect and refile his or her notice of appeal. "b. No fee as established by subdivision a. of this section shall be charged to any elected officer of the City of San Bernardino filing an appeal in his or her official capacity. "c. No fee as established by subdivision a. of this section shall be charged to any person who declares under penalty of perjury (1) That he or she is receiving benefits pursuant to the Supplemental Security Income (SSI) and State DAB/ses September 27, 1989 1 ~ 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 7 8 9 10 ,#""~, j ......., ,,,,' 1 ORDINANCE OF THE CITY OF SAN BEHNARDINO AMENDING SECTION 2.64.050 OF THE SAN BEHNAHDINO MUNICIPAL CODE HELATING TO FEES FOH APPEALS 2 3 4 5 6 Supplemental Payments (SSP) programs (Sections 12200- 12205.2 of the Welfare and Institutions COde), the Food Stamp program (7 United States Code 2011-2027) or Section 17000 of the Welfare and Institutions Code, or (2) That his or her monthly income is 125 percent or less of the current monthly poverty line annUally established by the Secretary of Health and Human Services pursuant to Omnibus Budget Reconciliation Act of 1981, as amended, and who submits a financial statement setting forth each item which makes up his or her monthly income in support of the averment as part of the deClaration.
