STAFF REPORT
Bids for this project were opened at 2:00 p.m., Tuesday,
9-26-89.
The contract documents were prepared to solicit bids for
the Basic Bid plus Alternate "A" (box culvert) or the Basic Bid
plus Alternate "B" (5 storm drain pipes). A contract will be
awarded for the lowest bid for the Basic Bid plus either of the
alternates.
A total of 9 bids were received, ranging from $244,404.77
to $340,722.00 (Basic Bid plus one of the alternates). The low
bid of $244,404.77 is 24.4% under the Engineer's Estimate of
$323,500.00.
Listed below is an estimate of the total project cost,
based upon the actual low bid price:

The agreement with the Redevelopment Agency provided for
the City to be reimbursed up to $220,000 for costs incurred on
this project. The First Amendment to the Agreement increased the
maximum reimbursement to the City from $220,000 to $475,800.
Also, a new paragraph is added that provides the City will use
its best efforts to establish a procedure to collect fees from
developments that will benefit from this project. All such fees
wiLl be paid to the Redevelopment Agency.
We recommend that a contract be awarded for the low bid.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BOB BRITTON, INC. FOR STREET AND CHANNEL IMPROVEMENTS
AT 48TH STREET AND DEVIL'S CREEK CHANNEL.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Bob Britton, Inc. is the lowest responsible
bidder for Construction of Street and Channel Improvements at
48th Street and Devil' s Creek Channel, in accordance with Plan
No. 7543, for the total amount of $244,404.77, and a contract, is
awarded to said bidder accordingly, but such award shall be
effective only upon the contract being fully executed by both
parties; all other bids therefore are hereby rejected; and the
Mayor is hereby authorized and directed to execute said contract
on behalf of the City; a copy of the contract is attached hereto,
marked Exhibit "A" and incorporated herein by reference as fully
as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements,
amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3.
This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
