2 RESOLUTION OF THE CITY OF SAN BERNARDINO RELATING TO
COMPULSORY RETIREMENT OF MISCELLANEOUS MEMBERS.

WHEREAS, Assembly Bill 568, Chapter 852, Statutes 1977,

which became operative September 16, 1977, adds Section 20983.6
6
to the Government Code permitting every local miscellaneous
7
member who has attained age 67 to continue in employment upon
8
certification of the member's competence in the member's position
9
by the department or agency head or other appropriate supervisor
10
pursuant to rules and regulations adopted by the governing body;
11
and
12
WHEREAS, Section 20983.6 shall not apply to any contracting
agency unless and until the agency elects to be subject to said
13
14
section by amendment to its contract; and
15
WHEREAS, the Mayor and Common Council, as the governing
16
body of the City of San Bernardino, desire to become subject
17
to Section 20983.6 by appropriate contract amendment,
18
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO that the Mayor is hereby
19

directed to negotiate an appropriate amendment to its contract
21
with the Public Employees' Retirement System under which the City
22
of San Bernardino will become subject to Section 20983.6 of
the Government Code,

BE IT FURTHER RESOLVED, that the City Clerk is hereby
25
26
directed to file a certified copy of this Resolution with the
Board of Administration, Public Employees' Retirement System.

I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
