DESCRIPTION) Finance: Councll Notes: Agenda Item No. 21 }5.0262 CITY OF SAN BERNjIi&RDINO - REQUEST r-vR COUNCIL ACTION STAFF REPORT Complaints were received by this department, and after inspection by the Vehicle Abatement Officers, legal ten (10) day notices were issued and mailed to land owners. Upon no response to the abatement orders, the abandoned vehicles were abated by the City. Cost were incurred by the City for abatement and properties are being liened. 75-0264 1 2 RESOLUTION NO. RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING 3 CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF ABA TEMENT OF PUBLIC 4 NUISANCES (ABANDONED VEHICLES) ON SAID PROPERTIES 5 the City of San Bernardino, pursuant to its authority WHEREAS, 6 under Chapter 8.36 of the San Bernardino Municipal Code, did lawfully give 7 notice of and thereafter abate public nuisances found to exist on the 8 properties listed below; and 9 pursuant to the San Bernardino Municipal Code, the WHEREAS, 10 Superintendent of Public Buildings served notice to all property owners of 11 the abateC1en t costs for removing abandoned, wrecked, dismantled, and/or 12 inoperative vehicles or parts thereof from the property; and 13 WHEREAS, opportunity for a hearing before the Board of Building 14 COC1missioners to protest the abatement costs was afforded the property 15 owners, with no response forthcoming; 16 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 17 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 18 SECTION 1. The above assessments shall be paid to Public Buildings/Parking Control, basement of City Hall, 300 N. "D" Street, San Bernardino, CA. 92418, within thirty (30) days after notice of this resolution is mailed to all parties with an interest in the above properties. All assessments not fully paid in thirty (30) days shall become a lien on the property pursuant to the San Bernardino Municipal Code and shall be collected as a special assessment thereon. SECTION 3. If the above assessment is not paid as hereinabove provided, A City official is directed to file a certified copy of this resolution \lith the Auditor of the County of San Bernardino, State of California, directinG that said assessment be entered as a lien against the property as it appears on the current assessment rolls. The assessment shall be collected at the same time and in the same manner as the general property taxes for the City of San Bernardino including penalties and interest for delinquent payments. The City Clerk shall also present for recording appropriate notices of the imposition of these liens with the County Recorder.
