SUBJECT: Referendum Petition Filed by "We, The People" to repeal
Ordinance No. MC-90S (No-Smoking)

Although proponents of a referendum petition to repeal Ordinance
No. MC-90S (No-Smoking) were not successful in obtaining the
required number of signatures, I would like to present this report
for your information and request that the report be received and
filed.
On June 6, 1994, the Mayor and City Council adopted Ordinance No.
MC-90S, "An Ordinance of the City of San Bernardino Amending
Chapter 8. 72 of the San Bernardino Municipal Code Relating To
Smoking" .
Pursuant to Section 121 of our City Charter, members of an
organization called 'We, The People" initiated a referendum
petition protesting the passage of Ordinance No. MC-90S. Section
121 of the City Charter requires that a referendum petition must be
signed by electors of the City equal in number to at least 30% of
the entire vote cast for all candidates at the last Mayoral
election and that the petition be filed within thirty days.
The last Mayoral election took place in May 1993 and a total of
18,OS6 votes were cast for all Mayoral candidates in that election.
Thirty percent (30%) of that number equals S,417, which was the
minimum number of signatures required for the referendum petition
initiated by We, The People.
Wednesday, July 6, 1994, was the deadline for the referendum
petition proponents to file the petition. At S:16 p.m. on July 6,
1994, Ms. Jean Kennedy, representing We, The People, filed the
petitions, stating that she believed they had 4,929 signatures and
lacked the required number of signatures; however, she requested
that the petitions be accepted for filing as a matter of public
record.

Utilizing the resources of our lobby volunteers, this office has
tallied the total number of signatures and has determined that the
referendum petition was signed by 4,859 registered voters, 558
signatures short of the 5,417 required. Please note that a review
of 100 signatures showed that 18 out of a random 100 signatures
were non-city residents.
Since the referendum petition is deficient in the required number
of signatures, there is no need to conduct the verification of
signatures; however, the petitions are on file in the City Clerk's
Office.
If any additional information is requested, please do not hesitate
to let me know.
