Dept: Public Works/Engineering Date: June 13, 1994 Synopsis of Previous Council action: 08-02-93 -- 1993-94 assessment rolls approved for Assessment District No. 947 by Resolution No. 93-281 for the Central City Parking District, and by Resolution No. 93-299 for the Expansion of Facilities. 06-15-94 -- Notices were mailed to all property owners within the Downtown Parking District's boundaries relative to the proposed increases in the 1994/95 Parking District assessments. Council Notes: 75-0262 Agenda Item No. lit; CITY OF SAN BERNI "1DINO - REQUEST Fr., COUNCIL ACTION , , STAFF REPORT " This is the time set for the meeting to hear any protests relative to increased assessments on the City's annual assessment rolls for the Downtown Parking District (RollI) and f~r the Expansion of Facilities parking assessment (Roll 2). No action can be taken on the protests at this time and all protests are to be carried over to the hearing scheduled for August 1, 1994. Notices were mailed to all affected property owners on June 15, 1994 stating the Assessment District Name and Number involved, the amount of the proposed assessment, and the dates, times, and places of the meeting and hearing. The main reason for the increased assessments in the primary roll is the reduction in the contribution amount from last year's amount. The total amount to be assessed for the secondary ro 11 did not increase, however, some of the individual assessments may have increased. The necessary Resolutions Confirming the annual assessment rolls for both rolls are attached for your review at this time, however, no action can be taken on these assessments or the protests, if any, at this time. RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1994-95 ASSESSMENT ROLL, EXPANSION OF FACILITIES FOR THE CENTRAL CITY PARKING DISTRICT. WHEREAS, by Resolution No. 12613, the Mayor and Common Council found that the public interest, convenience, and necessity required the formation of a parking improvement district; and WHEREAS, by said Resolution No. 12613 the ~\ayor and Common Council of the City of San Bernardino formed a parking improvement district for the purpose of providing public off-street parking facilities in the City of San Bernardino pursuant to the provisions of Ordinance Ko. 3589 relating to the 11 establishment, financing, operation, and maintenance of vehicle off-street 12 parking within the City; and 13 WHEREAS, said Resolution No. 12613 declared that all the land 14 inc I uded within the boundaries of said parking improvement district will be 15 benefited by the parking improvements to be constructed; and 16 WHEREAS, by Resolution No. 79-208, the Mayor and Common Council 17 found and determined that the public convenience and necessity required the 18 acquisition and installation of property improvements for providing addition- 19 al off-street public parking facilities within the Central City Parking 20 District; and 21 WHEREAS, by Resolution No. 79-207, the Mayor and Common Council 22 declared that an annual ad valorem assessment shall be levied on all land 23 within the District to provide moneys for any or all of the purposes set 24 forth in Section 2 of the off-street Parking Ordinance and in particular to 25 pay all or any part of the costs and expenses of providing such additional 26 parking place improvements; and 27 III 28 06-13-94 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION APPRV. 1994 ASSES. ROLL2 AD947 ~~REAS, an Assessment Roll has been prepared totalling S 30,299.41 which sets forth the individual assessments for the Expansion of Facilities to be levied on each of the parcels of land within the Central City Parking District; NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAK BERKARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that the proportionate costs to be levied for the Expansion of Facilities against the parcels of land within the Central City Parking Dis- trict are correctly set forth on the 1994-95 Expansion of Facilities for the Central City Parking District Assessment Roll, designated as Exhibit "A" and attached hereto, and do hereb,' confirm said assessments. SECTION 2. That the City Clerk is directed to cause a copy of this Resolution to be transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the request that the individual assessments be placed on the subject 1994-95 property tax bills for collection together with all other property taxes. ROLL AD947 costs and expenses of providing additional parking place improvements; and ~1lEREAS, pursuant to Resolution No. 79-207 and that certain "Park- ing Facilities Lease" dated for convenience as of February I, 1977 between the City and the Redevelopment Agency (RDA) , any assessment levy necessary to pay the rent due from the City. to the RDA of the City of San Bernardino shall be a separate and distinct assessment. In determining said annual assess- ment, the Mayor and Common Council may include in addition to other costs of providing the addition of parking place improvements an amount necessary for the establishment, maintenance and replenishment of reasonably required reserve funds; and WHEREAS, an Assessment Roll has been prepared totaling S 174,059.95, which sets forth the individual assessments to be levied on each of the parcels of land within the Central City Parking District; NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and determine that the proportionate costs to be levied against the parcels of land within the Central City Parking District are correctly set forth on the 1994-95 Central City Parking District Assessment Roll, designated as Exhibit "A" and attached hereto. and do hereby confirm said assessments. SECTION 2.
