Finance: Icil Notes: '&~<i ;;pl f/f 75-0262 Agenda I tem No. ~/S- _ CITY OF SAN BERh...40RDINO - REQUEST ~ ')R COUNCIL ACTION STAFF REPORT As required by the provisions of Chapter 12.90 of the Municipal Code and pursuant to the Brown Act, meeting and hearing dates were scheduled for the 4th ~onday in May and for the 4th Monday in June per Council Action taken on October 4, 1993 to hear protests on increased annual assessments on all of our Chapter 12.90 Assessment Districts. This is the time set for the hearing to hear and pass on any protests relative to increased assessments on the City's annual assessment rolls. A public meeting was held on May 23. 1994 and the protests were carried over to this meeting. Notices were mailed to all affected property owners on May 2, 1994 stating the District Number involved, the amount of the assessment and the dates and place of the meeting and hearing. All of the necessary Resolutions Confirming the annual assessment rolls are attached for vour consideration for those Districts which have increased assessments. It is the recommendation of this Department that all of the Resolutions be adopted as submitted. An inquiry was made at the previous meeting of 5/23/94 regarding the per-unit assessments proposed in A.D. 11959 (Shandin Hills) for the new Seniors Apartments, and as to whether the property owner of the complex would pass the cost of each per-unit assessment onto the tenant of each unit. We were informed by an agent from the leasing office that of the 176 units available, only 94 are Jccupied, and most of those are "HCD" subsidized which means that HUD limits the amount of rent that can be paid by the tenant based on his or her total monthly income. This does not allow the property owner of the complex much room to raise rents to cover the cost of the assessments. Secondly, in response to an inquiry regarding the type of "disclosure" given to perspective buyers within an assessment district, it is normally the seller's ubligation to disclose an~' dnd all issues affecting the property and/or conditions of the purchase, however. a Notice of Assessment is recorded as a "blanket" lien accross all properties within the boun<taries of the district, and a Preliminary Title Report or Policy of Title Insurance will state that the propert~' is subject to a particular Assessment District or more than one in some cases. RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1994-95 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 991. LANDSCAPING MAINTENANCE, VERDEMONT AND OLIVE AREA. WHEREAS, by Resolution No. 89-330, the ~layor and Common Council found that the public interest, convenience, and necessity required the formation of a landscaping maintenance district; and WHEREAS, by said Resolution No. 89-330, the Mayor and Common Council formed an assessment district known as Assessment District No. 991 for the purpose of providing landscaping maintenance in the area of Verdemont and 11 Olive Avenues pursuant to the provisions of Chapter 12.90 of the San Bernar- 12 dino City Municipal Code; and wlrnREAS, by Resolution No. 89-253, the Mayor and Common Council declared that all the land included within the boundaries of said district will be benefited by the maintenance of said landscaping; and WHEREAS, said Resolution No.89-253 declared that an annual assessment shall be levied on all land within the district to provide funding for said landscaping maintenance and the administration thereof; and WHEREAS, by Resolution No. 90-274, the Mayor and Common Council declared that the public interest and necessity required the amendment of the bounda- ries of the District by expanding the boundaries thereof to include addition- al territory in the District; and III III III III 4t1 05/02/Q4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTIO~ APPROVING 1994 ASSESS. ROLL AD 991 WHEREAS. an Assessment Roll has been prepared totaling 532.428.62 which sets forth the individual assessments to be levied on each of the parcels of land within Assessment District No. 991 for the fiscal year 1994-95. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and deter- mine that the proportionate costs to be levied against the parcels of land wi thin Assessment District No. 991 are correctly set forth on Assessment Roll No. 991 for the fiscal year 1994-95, designated as Exhibit "A" and attached hereto. and do hereby confirm said assessments. SECTION 2. That the City Clerk is directed to cause a copy of this Resolution to be transmitted to the Office of the Auditor-Controller for the . I prefer to be correct with my information therefore I will detail my list of questions in preparation of the next meeting of the Common Council on 7/5/94. With some help I will be better prepared to discuss the cost with the Council. Assessment District 991 is the district we were protesting. Here are a few questions that you could help me with: 1. Can you give us a complete itemized listing of the charges on WO 1335? 2. Please itemize what if any your Department has charge this district. If they are inspections please list the dates visited, mileage charge if any, whether this was a direct visit with no other stops on the way, etc. 3. Does your Department have the ability to enforce this contract with Mentone Turf? 4. Please detail all the water charges for this period that we are being charge. 5. Please detail what Monnig was being charge for water and if he paid it all. 6. Was the City Attorneys Department involved in the decisions with the Bank? 7. On the issue of Monnig's Bond, can we see the bond? 8. Did this bond have a section covering Attorney fees in case of litigation? 9. On 7/31/93; 10/31/93 and 1/31/94 Central Stores charged W01335, what was bought or supplied by them? We know locks were charged. What else? 10. What do you do with the reports from Parks and Rec.? 11. Would you be willing to visit this area with us to show you the problems? 12. Do you personally charge W01335 for any charges and if so why? You mentioned you visited this area today. When I drove home I saw white balls of paper on top of at least three plants in this area. We can show you weeds on North Garfield in many areas. Plants need to be trimmed even trees. We hope to bring all of these topics as well as others to the next meeting of the Common Council, your attention to these matters by Friday July 1, 1994 is appreciated. Sierra Way San Bernardino, CA 92410 Dear Mr. Yelton: On June 10, 1994 you answered my wife's fax request for informati9n on your Departments inspection for Assessment District 991. Thank you very much for these inspection dates and whether they had problems or not. We met with the Common Council today and protested our raise in fees based on poor work done by Mentone Turf and charges by the city for work we are not sure we received. The Council seemed to question every little thing we had to say to the point of causing us to get them more information. They have continued the meeting on this subject to July 5, 1994. As a group we told the Council that your Department did a very good job inspecting the area. In order to answer their other questions with proof, we are formally requesting that you document for us by Friday July 1, 1994 the following: We were told that your Department charged each inspection to work order 1335. Please submit a log of each visit to this district. Please insure that you document these visits with: Date Mileage if charged Time spent on visit inspector on that trip from their City Offices. Whether visit was the only stop made by Administrative time spent on paper work charge to 991: Dates. Name of person that spent the time. If you prefer to submit the actual charge record with detail we will do the math. On June 27,1994 we received a fax from Matthew Swalberg with some inspection reports from this past year Each report had an inspectors signature followed by the signature from the contractor Does this mean that your department meets with the contractor after each inspection or do you sent them a copy asking for a response? On 6/08/94 for Ohio & Olive there was a report. The contractor representative is listed as the Bank and Engineering. Yet the signature at the bottom is the same as that signed on Mentone Turf Contract site inspection reports. Are they doing the Banks work? If not did this one report go to the wrong people and get lost in the process. (My reason is the banks maintenance area looks real bad) I would also like to ask why on the following dates you inspected two days in a row in the same assessment district. Was the W01335 billed for both days? If so why didn't your inspectors complete the survey on the same day? 8/26/93 Verdemont Ave. 8/27/93 Palm Ave. 10/14/93 Verdemont Ave. 10/15/93 Palm Ave. On 11/16, 11/18, 11/19/93 Ohio was inspected. 4/06/94 Verdemont Ave. 4/04/94 Palm Ohio and Garfield. As you can see sometimes you inspected all the streets on the same day yet other days you had to come back to finish the area or a different street. If you were inspecting a problem then you would charge the same street two days in a row but to inspect two separate streets two day running it appears to be a over charge to the home owners. Can you help us understand what goes on? Who has the responsibility to force the vendor / contractor to correct the problems you uncover? Exhibit A Is an Inspection Loll which Identifies dates of Inspections and times charged. (No milage Is charged) This Information was obtained from time sheets. Additionally. Inspectors usually visit a number of sites in a row, so therefore these visits ue not the only SlOp the inspectors make on a trip from their office. The hours listed In Exhibit A Include administrative work (letters, telephone calls, etc,) In preparing to set-up for meetings and inspections. Administrative time Is not broken out from inspection time, rather. the Inspector detennlnes what his total time is to charge to the Assessment District. Percentage wise, Administrative time is between 15 % to 20 %, Question # 3 asked if the inspector meets with the contractor after the inspection. Generally, Inspectors try to meet with contractors on the job site and perform the Inspection together. At that time, the contractor acknowledges the denclencies noted and signs off, Otherwise, the Inspector attempts to locate the contractor to review the Inspection Sheet and have him sign-off. On occasion, due to conflicting schedules, the Inspector is unable to locate the contractor, and the forms ue submitted unsigned, at which time a copy Is sent to the contractor and Engineering. Question # 4 asks If the contractor's representative is the "Bank and Engineering." The correct response is the Bank. Engineering has worked with the bank to bring on this land. Previously. the developer of'this uea went bllIlkrupt and the bank assumed the responslblllty of maintaining this landscape In the Assessment District. At this time, the bank's contractor has not performed satisfactory and the City has not accepted the landscape. The City has given the bank's I'" N. 'IE""A. WAY. The slanature at the bottom Is Mentone TurrI representative, but this wu done only to keep our contraetor (Mentone Turf) appraised of the problems in the bank's landscape. Eventually, Mentone Turf will take over. Copies of this Inspection Porm Were provided to the bank and Engineerina for their reference. The City never has maintained the bank's landscaping although a portion the City's landscape abuts the banks. The City aarees the bank's landscaplni looks bad, which Is why we are worklns with them to brlns up the level of service. Question # 3 asks why on two days In a row, Inspectors Inspected the same area (W.O. # 1335). Many times Inspectors are called away to respond to other matters or emergencies and are unable to complete the inspection. They must go back at a latcr date to complete the Inspection. W.O. 11335 does let billed for both days, but only the amount of tbne spent Inspecting. Charies are not applied per visit, rather It's the total tbne in that pay period spend on W.O. # 1335. If the Inspector bad to break away, let's SllY from Palm Avenue and return the following day to Palm Avenue, then Palm Avenue Is not over-charged. As stated previously, the entire tbne Is added up to arrive at an hourly tbne spcntlnspoctlng W.O. # 1335 during a given pay period. As to Question 1 6, the Parks Division and the Engineering Division, has the responsibility to f'orce the contractor to correct deficiencies in the landscape. I, myself, did clwie tbne to W.O. # 1333 during Plscal Year 1993/94. This totaled 45 hours and wu spent on attending meetings with the City Inspectors.
