Az~~~ 2 RESOLUTION OF THE CITY OF SAN BERNARDINO TERMINATING THE EXISTENCE OF THE TRAFFIC SAFETY ADVISORY COMMITTEE; AND 3 REPEALING RESOLUTION NO. 12728. 4 WHEREAS, the Mayor and COlll1llon Council of the City of San S Bernardino established a Traffic Safety Advisory COlll1llittee on , or about March 10, 1975; and 7 WHEREAS, the Mayor and COlll1llon Council have provided for 8 the duties and powers of the Traffic Safety Advisory COIlI1lIittee 9 by Resolution No. 12728 adopted on March 21, 1977; and 10 WHEREAS, it has been determined that the Traffic Safety 11 Advisory COlll1llittee should be dissolved at this time, 12 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 13 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 14 SECTION 1. The Traffic Safety Advisory COlll1llittee 15 established by Resolution No. 12728 shall be abolished and its 16 existence terminated by the adoption of this resolution. 17 SECTION 2. If it is determined that a new Traffic Safety 18 Advisory COlll1llittee should be established, such cOlll1llittee shall 19 be created by resolution providing that the Mayor will appoint 20 two members, and that each member of the COlll1llon Council shall 21 each appoint one member. 22 SECTION 3. RESOLUTION NO. /~ 7?f! 2 RESOLUTION OF THE CITY OF SAN BEillqARDINO CREATING THE TRAFFIC SAFETY ADVISORY COW1ITTEE AND PROVIDING FOR ITS DUTIES 3 AND POWERS. 1 4 BE IT RESOLVED BY THE MAYOR AND C0W10N COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 SECTION 1: The Traffic Safety Advisory Committee of the 6 City of San Bernardino is hereby created for the purpose of 7 providing safe, efficient and convenient movement of pedestrians, 8 persons and goods upon the public streets within the City of 9 San Bernardino. SECTION 2: The Traffic Safety Advisory Committee shall function in an advisory capacity and its duties shall include but not be limited to the following: (a) Review and make recommendations on all Traffic control items that require approval of the Mayor and Common Council. Planning Director The Technical group shall be entitled to one (1) collective vote. (e) The City Administrator or his designee shall serve as ex-officio secretary to the Traffic Safety Advisory Committee. The City Administrator shall not be entitled to vote. (f) A majority of the membership shall constitute a quorum. A majority of a quorum shall be sufficient to take action. The Chairman shall not be entitled to vote, except in the instances when a majority vote cannot be reached among the voting members present. SECTION 6: The absence of any member of the Traffic Safety Advisory Committee from attendance at three (3) consecu- tive meetings of the committee without being excused by the Chairman prior to such meetings shall constitute an automatic vacation of the office of the absenteeing member, and the Mayor shall appoint, subject to the approval of the Common Council, another person to fill the unexpired term of the member vacating the office. II - 4 - I ! .~ BY-LAWS CITY OF SAN BERNARDINO CITY TRAFFIC SAFETY COMMITTEE THE POWERS AND DUTIES OF THE CITY TRAFFIC SAFETY COMMITTEE ARE DESCRIBED HEREINAFTER: SECTION ONE: The City Traffic Safety Committee of the City of San Bernardino has been created for the goal of providing safe, efficient and convenient movement of pedestrians, persons, and goods upon the public streets within the City of San Bernardino. The Mayor shall appoint all members of the Committee. SECTI ON TWO: That said City Traffic Safety Committee shall function in an advisory capacity, whose duties shall include, but not necessarily be limited to, the following: a) Review and make recommendations on all traffic control items that require approval of the Mayor and Common Council. . ) b) Review and make recommendations on items relating to the flow of traffic and pedestrians upon public streets that are deemed necessary or as requested. SECTION FOUR: That said City Traffic Safety Committee shall be comprised as follows: a) One member preferably from each category listed below, to be appointed by the Mayor. 1. Business Community 2. SECTION FIVE: That said City Traffic Safety Committee shall elect a Chairman and Vice-Chairman from among its members to serve for a term of one ca 1 endar year, not to exceed two (2) ". consecutive years. The incumbent to indicate desire to conti nue term of offi ce for more than one year. The Chairman shall not be entitled to vote, except in the instances when a majority vote cannot be reached among the voting members present. The Vice-Chairman shall be entitled to vote, except when serving as Chairman. Nominations and election shall be made at the meeting in November. SECTION SIX: That if a member of the City Traffic Safety Committee shall fail to attend three (3) consecutive meetings, without being excused by the Chairman prior to a meeting, that member shall automatically forfeit his appointment, and the Mayor shall appoint another member to the Committee. Chief of Police 2. City Engineer 3. Street Superintendent 4. Planning Director The Technical Group shall be entitled to one (1) collective vote. Other City staff may be called upon if special technical consultation is need.ed. c) A quorum shall consi st of four from category (a) in addition to the Cbairman; three from "category (b). Four representatives from the City constitutes one vote. Three staff people are required. d) Traffic Engineer is the designated representative of the City Engineer and also serves as the Executive Director of the Committee. SECTION FIVE: That said Traffic Safety Advisory Committee shall elect a Chairman and Vice-Chairman from among its members excluding the technical group to serve for a term of one (1) year (January 1st to December 31st). not to exceed two consecutive years. The incumbent to indicate desire to continue term of office for more than one year. The Chairman shall not be entitled to vote, except in the instances when a majority vote cannot be reached among the voting members present. The Vice-Chairman shall be entitled to vote, except when serving as Chairman. Nominations to be made at meeting in November.
