HomeMy WebLinkAbout12948 I'. ~. 1 i 2 'I I 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. /=< 7' ~ Y' RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE SALE OF APPROXIMATELY 11.39 ACRES OF REAL PROPERTY LOCATED IN THE SOUTH EAsT INDUSTRIAL PARK REDEVELOPMENT PROJECT AREA TO HUNTLEY PROPERTIES, INC. BY THE REDEVELOPMEN~ AGENCY OF THE CITY OF SAN BERNARDINO (HEALTH & SAFETY CODE SECTION 33433). WHEREAS, the Redevelopment Agency of the City of San Bernardino is the owner of a certain parcel ~ r~1 property situated in the Southeast Industrial Park Redevelopment Project Area and more particularly described in Exhibit "A" attached here- to and incorporated by reference herein as fully as though set forth at length; and WHEREAS, said real property was purchased on December 29, 1976 at a total cost of one hundred nineteen thousand, five hundre ninety-five dollars ($119,595.00), the fair market value of the aforesaid property for the highest and best use consistent with the redevelopment plan; and WHEREAS, the Redevelopment Agency of the City of San Bernardino proposes to sell said parcel of real property to Huntley Properties, Inc., a corporation, for the sum of forty- five thousand, five hundred sixty dollars ($45,560.00); and WHEREAS, said selling price is less than the estimated fair market value of the real property being sold; and WHEREAS, said forty-five thousand, five hundred sixty dollars ($45,560.00) selling price is necessary to effectuate the purposes of the Redevelopment Plan; and WHEREAS, Huntley Properties, Inc, a corporation, has pro- posed a development for said real property as a manufacturing plant for a national furniture manufacturing company; and WHEREAS, Huntley Properties, Inc. will develop a 100,000 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 square foot plant upon the real property with a development cost of at least 1.5 million dollars, and the furniture manufacturer will install plant machinery and maintain inventory which will significantly add to the total development costs. The furniture manufacturer intends to employ 200 persons from the local labor area during their peak production periods, and desire to have the plant in actual manufacturing production as soon as possible; and WHEREAS, notice of the time and place of hearing has been given as required by law; and WHEREAS, the Redevelopment Agency has made available for public inspection and copying all of the information required by law; and WHEREAS, all hearings have been held as required by Health & Safety Code Section 33433, NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO do hereby find and declare that the sale is for less than estimated fair market value of the parcel of real pro- perty being sold determined at the highest use permitted under the Southeast Industrial Park Redevelopment Project Area Redevelopment Plan and that such lesser consideration is necessary to effectuate the purposes of said plan for the following reasons: 1. Article V, Subsection B of the Redevelopment Plan pro- vides and allows industrial uses, including, without limitation, industrial and industrial park developments which will include manufacturing, fabrication, production and assembly, wholesale and resale distribution uses, technical service businesses, re- search and development and other related compatible uses. 2. The real property involved has been owned by the -2- I' 1 Agency since December 29, 1976, has been available for sale with- 2 out any offers therefor being made, and the Agency has been un- able to sell said property for development since that time. 3 4 3. There is strong competition from the County of San 5 Bernardino and from other cities in the area to induce and persuad~ 6 developers to locate their developments in their areas. Should 7 the Redevelopment Agency be unable to sell this property for 8 the sale price set forth herein, the developer will undoubtedly 9 develop his plant elsewhere, the parcel would remain undeveloped, 10 and the Agency would lose tax increment revenue which would be 11 generated by the development of the property. 12 4. Any claim for a finder's fee provided for by establishe 13 Agency policy for the proposed development has been waived. 14 5. All of the recitals set forth hereinabove are 15 incorporated herein by reference. 16 6. Approximately forty-five thousand dollars ($45,000.00) 17 per year in tax increment revenues will be realized from the pro- 18 posed development and the Redevelopment Agency will recover the 19 difference between the property and its estimated fair market I , h' d " Ivalue determ1ned at the 19hest an best use cons1stent w1th the , !Redevelopment Plan in less than two years. 7. Should the Redevelopment Agency not sell the parcels of 20 21 22 23 real property as proposed herein, the Redevelopment Plan for this 24 project area could not be effectuated. 25 BE IT FURTHER RESOLVED that the Mayor and Common Council of the City of San Bernardino hereby approve the sale of the said 26 27 parcels of real property upon the terms, conditions, and for the reasons herein set forth. 28 -3- I' 1 I , j , i I I adopted by the Mayor and Common Council of the city of San I !
