RESOLU'l'ION OF THE CITY OF SAN BERNARDINO GIVING NOTICE
INVl:TING COMPETI'1'l:VE BIDS FOR. THE SALE OR LEASE 01, cilbAIN REAL

ESTABLISHING A MINIMUM SALE PRICE POR SAID PROPERTY OR, IN THE
AL'l'ERNA'tIVE, MINIMtJM LEASE PROVISIONS SUCH AS PAYMENTS, TERM, ETC.

WHEREAS, the City of San Bernardino, a municipal corpora-
tion, is the owner of the hereinafter described parcel of real
property situated in the City of San Bernardino, State of
California; and

WHEREAS, the Mayor and Common Council of the City of San
11
12
Bernardino find ~ determine that there is no further need or
necessity for the use of said real property; and
13
WHEREAS, the Mayor and Common Council of the City of San
14
Bernardino believe it to be in the best interest of the said City
15
that said parcel of real property Qe ~ld or leased at the highest
price obtainable in the open market,

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
18
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Notice is hereby given inviting competitive
20 bid proposals for the sale of the following real property, more
21 particularly described in and subject to the terms of Specifica-
22 tions No. 5074 on file in the Office of the Director of Public
23 Works/City Engineer, Real Property Section, City Hall, 300 North
24 "0" Street, San Bernardino, California, and generally described
25 as follows:
26 "A rectangular parcel of land totalling approximately
17,535 square feet containing a vacant library type
27 building at approximately 2,435 square feet and
located at the southwest corner of Home Avenue and
28 Muscott Street in the City of San Bernardino."

SECTION 2. The minimum acceptable bid for said real
2 property to be sold or leased by said City is established as
3 follows:

(a) $60,000.00 cash selling price, or
(b) In the alternative, a lease in a form satisfactory to
5
6 City for a lease term of five years, or more, and providing for
7 lease payments at a minimum rate of three thousand dollars
8 ($3,000.00), or more, per year.

SECTION 3. Each competitive bid or proposal shall be
10 delivered to the Office of the City Administrator, city Hall,
11 300 North "D" Street, San Bernardino, California, on or before
12 the hour of 2:00 p.m., Friday, October 7, 1977, at which time
13 said sealed bids or proposals shall be opened and publicly
14 declared. The highest of said bids or proposals shall be sub-
15 mitted to the Mayor and Common Council at the hour of 2:00 p.m.,
16 at the Council Chambers, City Hall, 300 North "D" Street, San
17 Bernardino, California at their next regularly scheduled meeting
18 being Monday, Ootober 17, 1977, at whioh time said Mayor and
19 Common Counoil may reoeive oral bids, with respeot to the sale of
20 the property, in $250.00 increments, provided that the initial
21 oral bid shall be an amount not less than the highest written bid
22 plus $250.00 and accompanied by cash or check in an amount of
23 $2,500.00, non-refundable; and oral bidding for the sale of the
24 property shall be continued in the same manner and bids received
25 orally until all bidding shall have been completed; and in the
26 alternative, with respect to the lease of the property, in six
27 hundred dollar ($600.00) increments per year lease payments;
28 provided that the initial oral bid for the lease of the property

shall be in an amount not less than the highest written bid plus
a six hundred dollar: ($600.00) increment per year for the propose
lease term and accompanied by cash or check in the amount of
$2,500.00, non-refundable; and oral bidding for the lease of
the property shall be continued in the same manner and bids
received orally until all bidding shall have been completed.
The Mayor and COll1ll\On Council of the City of San Bernardino
reserve the right to make, in their sole discretion, a determina-
tion as to whether the property shall be sold or leased.
SECTION 4. Attention of bidders is directed to "Descrip-
tion of Property, Requirements of Bidders, Requirements of Sale
and the Official Bid Form" which may be obtained at the office of
the Director of Public Works/City Engineer, Real Property Section,
Room 405, City Hall, 300 North "D" Street, San Bernardino,
California.
SECTION 5. All written bids or proposals shall be si~ned,
sealed and delivered. No bid proposal whiCh fails to contain a
sum equal to or. greater than the minimum acceptable bid price
established herein or which is filed at a later time or at a
different place or with a different person than required shall be
valid or considered for award unless there is substantial com-
pliance herewith as determined by the City Administrator in his
sole discretion; and the Mayor and Common Council reserve the
right to reject any or all bid proposals for any reason.
SECTION 6. This resolution shall be posted on or near the
door of the Council Chamber, City Hall, San Bernardino,
California, and shall be published not less than once at least 10
days prior to the date for filing bid proposals with the City
