2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE SALE
OF APPROXIMATELY 6. 17 ACRES OF :REAL PROPERTY LOCATED IN THE SOUTH-
3 EAST INDUSTRIAL PARK :REDEVELOPMENT PROJECT AlmA TO RICHARD J.
KBEMER BY THE BEDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO
4 (HEALTH & SAFETY CODE SECTION 33433).
S WHEBEAS, the Redevelopment Agency of the City of San
, Bernardino is the owner of certain parcels of real property
7 situated in the Southeast Industrial Park Redevelopment Project
8 Area and more particularly described in Exhibit nAil attached here-
9 to and incorporated by reference herein as fully as though set for h
10 at length; and
11 WHEREAS, said real property was purchased on October 26,
12 1976 at a total cost of seventy-five thousand four hundred fifty
13 dollars ($75,450.00), the fair market value of the aforesaid pro-
14 perty for the highest and best use consistent with the redevelop-
15 ment plan; and
16 WHEBEAS, the Redevelopment Agency of the City of San
17 Bernardino proposes to sell said parcels of real property to
18 Richard J. Kremer, an individual, for the sum of twenty-four
19 thousand six hundred eighty dollars ($24,680.00); and
20 WHEBEAS, said selling price is less than the estimated fair
21 market value of the property of the real property being sold; and
22 WHEBEAS, said twenty-four thousand six hundred eighty
23 dollars ($24,680.00) selling price is necessary to effectuate the
24 purposes of the Redevelopment Plan; and
25 WHEBEAS, Richard J. Kremer, an individual, has proposed a
26 development for said real property as a manufacturing plant for
27 Futurex Industries, Inc.; and
28 WHEBEAS, Futurex Industries, Inc. will develop a 60,000

square foot plant upon the real property with a development cost
of at least 1.2 million dollars and will install plant machinery
and maintain an inventory which will significantly add to the
development costs. Futurex Industries, Inc. intends to employ
125 persons from the local labor area during their peak production
periods and they desire to have the plant engaged in actual
manufacturing operations not later than the month of January
1978; and
WHEREAS, notice of the time and place of hearing has been
given as required by lawl and
WHEREAS, the Redevelopment Agency has made available for
public inspection and copying all of the information required by
lawl and
WHEREAS, all hearings have been held as required by Health
& Safety Code Section 33433,
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO do hereby find and declare that the sale is for
less than estimated fair market value of the parcel of real pro-
perty being sold determined at the highest use permitted under the
Southeast Industrial Park Redevelopment Project Area Redevelopment
Plan and that such lesser consideration is necessary to effectuate
the purposes of said plan for the following reasons:
1. Article V, Subsection B of the Redevelopment Plan pro-
vides and allows commercial uses, including, without limitation,
business offices, professional offices, retail stores and shops
and other office functions as may be directly related to industry
and commerce as well as the general public.
2. The real property involved has been owned by the Agency

1 since October 26, 1976, has been available for sale without any of ers
2 therefor being made, and the Agency has been unable to sell said
3 properties for development since that time.
4 3. There is strong competition from the County of San
S Bernardino and from other cities in the area to induce and persuad
6 developers to locate their developments in their areas. Should
7 the Redevelopment Agency be unable to sell these properties for th
8 sale price set forth herein, the developer will undoubtedly develo
9 his plant elsewhere, the parcels would remain undeveloped, and the
10 Agency would lose tax increment revenue which would be generated
11 by the development of the properties.
12 4. The proposed development waives any claim for a
13 finder's fee provided for by established Agency policy.
14 5. All of the recitals set forth hereinabove are
15 incorporated herein by reference.
16 6. Approximately forty-five thousand dollars ($45,000.00)
17 per year in tax increment revenues will be realized from the pro-
18 posed development and the Redevelopment Agency will recover the
19 difference between the property and its estimated fair market
20 value determined at the highest and best use consistent with the
21 Redevelopment Plan in less than two years.
22 7. Should the Redevelopment Agency not sell the parcels of
23 real property as proposed herein, the Redevelopment Plan for this
24 project area could not be effectuated.
2S BE IT FURTHER RESOLVED that the Mayor and Conunon Council of
26 the City of San Bernardino hereby approve the sale of th~ said
27 parcels of real property upon the terms, conditions, and for the
28 reasons herein-set forth.
