STAFF REPORT Historically, park construction fees for mobile homes have been collected in a very minimal amount. Currently, the fees are one-half of one percent of the cost of construction on a mobile home lot as determined by a building permit. As an example, if a lot was constructed for $5,000, the fee would amount to $25. This amount does not even cover the administrative costs for collecting the fee. There is no fee on the mobile home when it is moved on to the lot and set up. It is recommended that the Park Construction Fee for construction of mobile home lots be changed to one percent of the cost of improvements or $650, whichever sum is greater, as determined by the building permit. Currently, the mobile home developers and dwellers are not paying their fair share of costs for parks and recreation facilities. The average single family residential construction currently has a fee ranging from $700-$1,000 per unit. The fees are based on one percent of the cost for improvements for each residential dwelling unit or each unit in a multiple dwelling construction. These families in mobile homes have potentially the same impact on use of parks and recreation facilities as families dwelling in single family residences or apartment houses. Therefore, it is reasonable to expect mobile home developers and dwellers to pay their fair share of park construction fees as well. These changes in the Park Construction Fee schedule will provide a more equitable spread of fees to all types of residential development. Therefore, it is recommended that this ordinance change be approved. September. 7, 1989 75-0264 MOBILE HOME LOTS AND DWELLING UNITS 15.$6.040 Park.nd recreation constNction fee imposed. A. A park and recreation construction fee is imposed on the privilege of constructina in the City any mobile home lot or residential dwelling unit, and every person to whom a permit to construct any residential dwelling unit in the City is issued, and every person to whom a permit to construct and install electrical and plumbing equipment to service a mobile home lot in a mobile home park in the City is issued, shall pay to the City such fee at the following rates: 1. A sum equivalent to one percent of the cost of the im- provements for each one-family dwelling constructed, as determined by the building permit. 2. A sum equivalent to one percent of the improvements for each residential dwelling unit constructed in a mul- tiple dwelling containing alleast two or more residential dwelling units, as determined by the building permit. 3. A sum equivalent to one-half of one percent of the im- provements for each mobile home lot constructed in a mobile home park or mobile home park subdivision, as determined by the building permit. B. The fee imposed by this section shall be imposed regard- less of whether the new dwelling unit is created by new construction or by modification of existing nonresidential structures. The fee imposed shall apply to new mobile home park sites regardless of whether they are part of a new mobile home park or an addition to an existing park. e. Notwithstanding the foregoing provisions, the fee shall not be imposed and charged for any permit for which an application, together with two sets of complete plans and specifications as required by Section 30 I C and 0 of the Uniform Building Code, are filed with the City prior to June 1, 1978, provided that the applicant has paid all plan check fees prior to said date. 881 (San Bernardino 11~86) I I -; CITY OF SAN BERNARDINO INTEROFFICE MEMORANDUM 8909-203 TO: MARSHAL JULIAN, CITY ADMINISTRATOR FROM: ANNIE F. RAMOS, DIRECTOR OF PARKS, RECREATION AND COMMUNITY SERVICES SUBJECT: AMENDMENT TO ORDINANCE FOR PARK DEVELOPMENT FEES. DATE: September 7, 1989 COPIES: JAMES PENMAN, CITY ATTORNEY ------------------------------------------------------------- City Municipal Code 15.56 establishes the collecting of City Park Development fees. This fee is one which is collected at the time of issuance of a building permit. The rate is set to cover acquisition, development and rehabilitation of existing parks to accommodate all citizens of the City, and in particular, the new citizens who will occupy the new residential dwelling units for which the building permit is issued. Collection of fees on new residential developments provides an equitable and fair method for spreading the costs of new and expanded or rehabilitated existing facilities to the new residents rather than the costs being placed totally on existing residents. The City has the authority to apply these fees under the basic rights to regulate growth and development. The City General Plan, section 9, deals with Parks and Recreation standards and the collection of fees for the acquisition and development of parks and recreation facilities. September 7, 1989 Page 2 city of San Bernardino Municipal Code 15.56 currently provides for a very minimal fee for construction of mobile home lots (1/2 of one percent of the building permit valuation). In most cases this amounts to approximately $25 which does not even cover the costs for. processing the paperwork. This amount is not fair and equitable when compared to the fees levied on other residential development. For instance, the average single family residential construction currently has a fee ranging from $700-1,000 per unit. The fees are based on one percent of the cost for improvements for each residential dwelling unit or each unit of a multiple dwelling construction. The impact of families living in mobile homes is just the same as those living in single family and multi-family dwellings. Therefore, this department is requesting an amendment to Municipal Code 15.56.040 (A) (3) regarding mobile home lots construction to make fees more in line with other residential development fees and to be comparable to fees collected by surrounding cities for the same type of residential construction. Subsection 15.56.040.A.3. of the San Bernardino 6 Municipal Code is amended as follows: 7 "3.
