RESOLUTION OF THE CITY OF SAN BERNARJ)INO IN SUPPORT OF AN
URGENCY STATUTE, STATE ASSEMBLY BILL 1832, WHICH WOUld) AUTHORIZE
THE CONSOLIDATION OF SPECIFICALLY DESIGNATED REDEVELOPMENT PROJECT
AREAS WITHIN THE CITY OF SAN BERNARJ)INO.
WHEREAS, State Assembly Bill 1832 has been introduced in
the State Legislature to amend the heading of Article 13 (commenc-
ing with Section 33460) of Chapter 4 of Part 1 of Division 24 of,
and to add Article 14 (commencing with Section 33470) to Chapter
4 of Part 1 of Division 24 of, the Health and Safety Code, relat-
ing to redevelopment, and, declaring the urgency thereof, to take
effect immediately; and
WHEREAS, present law authorizes redevelopment plans
adopted under the Community Redevelopment Law to provide for
allocation to the redevelopment agency of a prescribed portion of
the tax revenues derived from property in the redevelopment pro-
ject areas in order to finance redevelopment. Such allocation
process being commonly known as the "tax increment" method of
financing redevelopment; and
WHEREAS, present law authorizes merger of contiguous and
noncontiguous redevelopment project areas within the jurisdiction
of the City of Sacramento for the purpose of application of tax
revenues allocated to the agency under the "tax increment" method
of financing; and
WHEREAS, said State Assembly Bill would authorize merger of
redevelopment project areas within the City of San Bernardino; and
WHEREAS, said Bill shall be applicable only to redevelop-

ment projects of the Redevelopment Agency of the Cit.Y.. l!>~. San

1 Ilordinanoe on or before January 1, 1978; and
2 I WHEREAS, the City of San Bernardino needs authority to
3 merge project areas to correct an error made by tax assessing
4 authorities as between redevelopment project areas to properly
5 allocate tax revenues available for payment of Redevelopment
6 Agency bonds. If the error is not corrected, existing outstanding
7 bonds will be placed in serious jeopardy; and
8 WHEREAS, the redevelopment plan for a project area which
9 is merged pursuant to Section 33470 shall be amended in the same
10 manner as other redevelopment plans are amended. Notice of the
11 public hearing, except as indicated in Section 33472 of State
12 Assembly Bill 1832, shall be mailed to the last known assessee of
13 each parcel of land not owned by the agency within the boundaries
14 of the project area described in the redevelopment plan being
15 amended,
16 NOW, THEREFORE, BE IT RESOLVED that the Mayor and-Common
17 Council of the City of San Bernardino, in demonstration of due
18 diligence, and, to preserve the integrity of a bond issuance by
19 the Redevelopment Agency of the City of San Bernardino, do hereby
20 record support of State Assembly Bill 1832; and
21 BE IT FURTHER RESOLVED that the Mayor and Common Council
22 herewith authorize and direct the City Clerk of the City of San
23 Bernardino to transmit by the most expeditious means a copy of
24 this Resolution to the appropriate committee members before which
25 this subject matter is heard and, upon passage by the committee,
26 to further send a copy of this Resolution to all concerned State
27 legislators.
