I ~ 7?-;L / A RESOLUTION OF THE MAYOR AND COMlllN COUNCIL OF THE CITY OF SAN BERNARDINO DE~.A1!TNG ITS I1rrENTION TO ORDER THE VACATION OF A PORTION OF TERRACE ROAD LYING APPROXIMATELY 610 FEET NOR1'll OF FOOTHILL BOULEVARD, AND RESERVING PUBLIC UTILITY EASEMENTS THEREON. BE IT RESOLVED BY THE MAYOR AND COMlllN COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of a portion of Terrace Road lying North of Foothill Boulevard. in said City. which said portion more particularly is described as follows: That portion of Terrace Road lying within the Northwest one- quarter of the Southwest one-quarter of the Southeast one- quarter of Section 6. Township 1 South. Range 4 West. San Bernardino Base and Meridian. according to the official plat thereof. approved by the Surveyor General. dated August 14. 1876. as situated in the County of San Bernardino. State of California. described as follows: Beginning at the intersection of the West line of Terrace Road. 40.00 feet wide. with the South line of the Northwest one-quarter of the Southwest one-quarter of the Southeast one-quarter of said Section 6; thence North 089 18' 25" West along said West line of Terrace Road. a distance of 290 feet. more or less to a point. said point being the Southwest corner of that certain parcel of land as conveyed to the, City of San Bernardino for street and highway purposes in the deed recorded July 20. 1966. in Book 6666. page 329. Official Records of the County Recorder of said County. said point also being the beginning of a tangent curve. concave Southwesterly and ~ving a radius of 50.00 feet. with a central angle of 660 25' 19"; thence Northerly and North- westerly along said curve a distance of 57.96 feet to the beginning of a reverse curve, concave Southeasterly and having a radius of 50.00 feet. with a central angle of 2460 25' 19"; thence Northerly. Northeasterly and Southeasterly along said curve a distance of 215.04 feet to the East line of said Terrace Road; thence South along said East line a distance of 390 feet more or less to its intersection with the South line of the Northwest one-quarter of the Southwest one-quarter of the Southeast one-quarter of said Section 6; thence Westerly along said South line. a distance of 40.00 feet. more or less. to the Point of Beginning. Containing 0.53 Acres more or less. SECTION 2. That the Mayor and Common Council, of the City of San Bernardino, in vacating the above described portiou,of said street. elects ,i;:- .:: #"'. , , " ,\-'" 1- 1 to proeeed under and in aeeordanee with the provisions of the "Street Vaeatio 2 Act of 1941", being Division 9, Part 3, of the Streets and Highways Code of 3 the State of California. 4 SECTION 3. That the hour of 2:00 P.M., on the 20th day of June, 5 1977. in the Council Chamber of the City Hall, San Bernardino, California, be, 6 and the same hereby is fixed as the time and plaee when and where all persons 7 interested in or objecting to the proposed vacation may appear before the said 8 Mayor and Common Council and offer evidence in relation thereto. For further 9 particulars as to the proposed vacation of the hereinbefore described portion 10 of said street, reference is made to that certain map marked "Plan No. 5043" 11 approved April 18, 1977, on file in the office of the City Clerk of said 12 City. 13 SECTION 4. Nothing in this Resolution shall in any way affeet or 14 disturb any existing easements for sanitary sewer and appurtenant facilities 15 and for public utility purposes belonging either to the City of San 16 Bernardino or to any public utility and there is hereby reserved for future 17 general public utility purposes and for this City an easement reasonably 18 necessary to locate such sanitary sewer and public utility facilities over, '^ 19 in, under, or across the real property described ~ereinbefore and._to use, 20 maintain, repair, replace or renew such facilities. SECTION 5. That the City Engineer of the City of San Bernardino 21 22 23 24 25 26 27 28 hereby is directed to cause Notices of Street Vacation to be posted as required by the Street Vacation Act of 1941. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution of Intention and ahall cause the same to be published for 3 successive days in The San Bernardino Sun Telegram, a newspaper published and circulated in the City of San Bernardino, prior to the date of the above ..... .....
