DESIGNATING CERTAIN STREET INTERSECTIONS WHERE A STOP IS REQUIRE . . ."; AND AUTHORIZING THE INSTALLATION OF STOP SIGNS ON 40TH STREET AT THE VALENCIA AVENUE INTERSECTION. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Resolution No. 2482, which designates certain 8 9 street intersections where a stop is required, Section one, Subsection (39) relating to Valencia Avenue is hereby amended to read as follows: "(39) For the purpose of stopping traffic entering VALENCIA AVENUE at its intersection with the following streets: 21st Street 23rd Street Orchid Drive - traffic approaching from the east only Norbert Drive - traffic approaching from the east only 26th Street - traffic approaching from the west only Alexander Avenue - traffic approaching from the west only 28th Street 29th Street 30th Street - traffic approaching from the west only Mockingbird Lane - traffic approaching from the east only Lynwood Drive North Road Val Mar Road - traffic approaching from the east only Marshall Boulevard Bernard Way - traffic approaching from the east only Glendenning Way - traffic approaching from the east only parkdale Drive I' .' ,_. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is authorized and directed to execute on behalf of said City an agreement with San Bernardino Chamber of Commerce providing for financial assistance to said Chamber of Commerce for publicizing, advertising and promoting the City of San Bernardino as an All America City, a copy of which is attached hereto, marked Exhibit "I" and incorporated herein by reference as fully as though set forth at length. Promotion. The Chamber agrees that it will use its best efforts to advertise and publicize the City of San Bernardino as an All America City by appropriate visual displays as more specifically defined and set forth in the request for financial assistance attached hereto, marked Exhibit "A" and incorporated herein. 2 . Payments. City shall pay Chamber, for all publicity and advertising services to be conducted under the provisions of this agreement, the total sum of fifteen thousand dollars ($15,000.00) to be paid on or before June 15, 1977. Said funds paid by City to Chamber shall only be used for the purposes and items as set forth on Exhibit "A" attached hereto. In the event any of said sums are not fully expended for the purposes set forth on said Exhibit, then Chamber shall forthwith refund to City any and all of said unexpended funds. 3. Relationship of Parties. It is understood that the contractual relationship of Chamber to the City is that of independent contractor. 4. Expenditures - Report and Accounting. Chamber shall file a report indicating the projects accomplished under the program and an accounting of all expenditures and all revenues received, from all sources including the City, relative to the projects outlined in Exhibit "A". Said report shall be filed with the City Administrator on or before July 31, 1977. 5. Hold Harmless Clause. Chamber hereby agrees to, and shall, hold City, its elective and appointive boards, commissions, officers, agents and employees, harmless from any liability for -2- 1 damage or claims for damage for personal injury, including death, as well as from claims for property damage which may arise from J Chamber's operations under this agreement, whether such operation, be by Chamber or by anyone or more persons directly or 2 3 4 5 indirectly employed by, or acting as agent for Chamber. Chamber 6 agrees to, and shall, defend City and its elective and appointive 7 boards, commissions, officers, agents and employees from any 8 suits or actions at law or in equity for damages caused, or 9 alleged to have been caused, by reason of any of the aforesaid 10 operations. 11 6. AIIIendment. This agreement may be amended or modified 12 only by written agreements signed by both parties and failure 13 on the part of either party to enforce any provision of this 14 . agreement shall not be construed as a waiver Qt: the right to 15 compel enforcement of such provision or provisions. 16 7. Assignment. This agreement shall not be assigned by 17 Chamber without the written consent of City. 18 8. Notices.
