Description: Caltrans Reimbursement Finance: Council Notes: &0 z.009-/?5 Agenda Item No. 22. 1"'(,-OCf CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution awarding a contract to Weka, Inc. for Sanitary Sewer Improvement Relocations for 1- 215 Freeway, Segment 1,2 and 5 (SW09-03), per Project Plan No. 12574. Background: On March 16, 2009, the Mayor and Common Council approved four Utility Relocation Agreements with the California Department of Transportation (Caltrans) to relocate City sewer facilities that conflict with the widening of the Interstate 215 Freeway. SANBAG recently received assurance that it will receive stimulus money under the American Recovery and Reinvestment Act (ARRA) of 2009. This new funding will allow SANBAG to proceed with bidding the actual construction work after utility relocations have been completed. Plans and specifications for sewer relocation work for segments I, 2, and 5 were completed and the project was opened to public bidding on March 10,2009. These segments include: . Segment No. I between Rialto Avenue and 8th Street, which includes City sewer relocations at 2nd Street, Main Street, 3rd Street, Kingman Street, alley north of 5th Street, Spruce Street, Victoria Street, 7th Street, Vine Street, and 8th Street. . Segment No.2 between 8th Street and Massachusetts Avenue, which includes City sewer relocations at Temple Street, 10th Street, Olive Street, 11 th Street, Orange Street, Baseline Street, Virginia Street, and 17th Street. . Segment No. 5 between Massachusetts Avenue at 19th Street, which includes City sewer relocation at Massachusetts Avenue. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge Company (Rancho Cucamonga and Monrovia), High Desert Plan Room, Construction Bid Board, San Diego Daily Transcript, Bid America Electronic, AGC Plan Room/The Daily Construction Reporter, Reed Construction Data, Construction Bid Source, Bid Ocean, and with the San Bernardino Area Chamber of Commerce. Fontana, CA $ 47,001,834.00 Engineer's Estimate (Range Only) $ 2,700,000.00 to $ 3,000,000.00 2 CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT - Continued Based on review of the sealed competitive bids received, staff has determined that Weka, Inc. of Redlands, the apparent low bidder, has met the minimum requirements of the specifications and bid guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced contract to Weka, Inc. The estimated project costs are as follows: rox.15%) $ 1,364,058.00 $ 204,608.70 $ 231,333.30 $ 1,800,000.00 If approved, the project is expected to begin construction in July of 2009 and be completed by December of 2009. Financial Impact: The FY 2009/2010 Capital Improvement Program budget includes sufficient funds in Acct. No. 242-362-5504-7848 and a corresponding amount in revenues will be reimbursed by Caltrans for project "SW 09-03 1-215 Sewer Relocations" to cover the cost of the project. (C(Q)ry 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO WEKA, INC. FOR SANITARY SEWER IMPROVEMENT RELOCATIONS FOR 1-215 FREEWAY, SEGMENT 1,2 AND 5 (SW 09-03), PER PROJECT PLAN NO. 12574. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Weka, Inc. 826 Brookside Avenue, Suite G, Redlands, CA 92373, is the lowest responsible bidder for the Sanitary Sewer Improvement Relocations for 1-215 Freeway, Segment I, 2 and 5 (SW 09-03), per Project Plan No. 12574. A contract is awarded accordingly to said bidder in a total amount of $1,364,058.00, with a contingency amount of $231,333.30, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The City Manager is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of the resolution.
