1 EMPLOYMENT AGREEMENT
2 THIS AGREEMENT is made and entered into this 3rd day of October, 2011, by and
3 between the CITY OF SAN BERNARDINO, a charter city ("City"), and ROBERT HANDY, an
4 individual ("Handy").
5 WITNESSETH
6 WHEREAS, City has the need for the services of a Chief of Police, and
7 WHEREAS, Handy is competent, trained and qualified for the position of Chief of Police,
8 as established by the background investigation conducted by the City's contractor
9 WHEREAS, the parties desire to enter into this Agreement to outline the duties and
10 responsibilities of the parties,
11 NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
12 1. APPOINTMENT. Handy is hereby appointed to, and does hereby accept such
13 appointment of the office of Chief of Police of the City of San Bernardino to commence on
14 October 17,2011.
15 2. COMPENSATION. Handy shall be compensated for his services as Chief of
16 Police as provided in Section 186 of the San Bernardino City Charter, which currently sets the
17 annual salary for Police Chiefat $237,300. However, in recognition of the extraordinary financial
18 issues facing the City and consistent with the sacrifice made by other City department heads, Handy
19 voluntarily agrees to give back ten percent (10 %) of his salary in accordance with Resolution No.
20 2010-276. If and when the City restores the 10% concession provided by employees in the
21 Management/Confidential group per Resolution No. 2010-276, or any portion thereof~ the 10%
22 voluntary "give back" provided by Handy shall also be commensurately restored. In the event
23 Resolution No. 20 I 0-276, or any portion, thereof is extended and/or amended, it shall also be
24 applicable to Handy.
25 3. TERMINATION. Under the terms of this appointment, Handy serves as an "at
26 will" employee and may be terminated at any time, with or without cause, and Handy may resign
27 at any time. In the event Handy voluntarily resigns his position of Police Chief with the City,
28 Handy shall give the City 30 days' written notice in advance of the effective date ofresignation,

unless agreed otherwise. If Handy is terminated without cause, he shall be entitled to severance
pay equal to six (6) months of his then current salary. If Handy is terminated for cause, there shall
be no right to any severance pay. Any receipt of severance payment shall be conditioned upon
Handy executing a separation agreement providing a release and waiver of any and all claims
against the City, its officers, employees and agents arising out of Handy's employment with the
City.
4. AUTOMOBILE ALLOWANCE. Handy shall have the right to the use of a City-
owned and maintained vehicle or, in the alternative, to receive a vehicle reimbursement allowance
in accordance with Resolution No. 2006-428 as amended or its successor, currently set at
$575/month.
5. MANAGEMENT BENEFITS.
A. The City shall provide to Handy the same monthly contribution to purchase
City-sponsored medical, dental, vision, and life insurance as other Department Heads in the
Management/Confidential Unit, currently at $1,091.81 per month.
B. Handy shall be provided an initial vacation bank of 100 hours of vacation
leave and shall be given credit for 20 years of continuous service for purposes of accruing vacation
leave per Resolution No. 2007-345 as amended or its successor. Handy shall also receive
Administrative Leave consistent with Resolution No. 2007-345 as amended or its successor, with
such Administrative Leave currently at 80 hours each fiscal year.
C. Any other benefits not specifically addressed in this Agreement shall be
consistent with the Police Management Unit.
6. UNIFORM ALLOWANCE. An initial uniform and equipment stipend of $950
shall be provided and on an annual basis consistent with members of the Police Management unit.
7. TEMPORARY HOUSING AND RELOCATION ASSISTANCE. A temporary
housing assistance stipend of $5,000 shall be provided to assist with obtaining temporary housing
in the City of San Bernardino until permanent residency can be established. City shall pay a one-
time only moving expense (not to exceed $8,000) from Phoenix, AZ to San Bernardino, CA, based
on three bids from moving contractors. Handy shall not be required to live in the City; however,

1 the temporary housing stipend and moving expenses will be paid only if Handy establishes
2 permanent residency within the City of San Bernardino. Invoices must be submitted for
3 reimbursement. Iffor any reason during Handy's employment with the City, Handy establishes his
4 residence outside of the boundaries ofthe City of San Bernardino, then Handy shall repay the City
5 of San Bernardino the entire amount of moving expenses paid to him within 3 months of his
6 relocation outside the boundaries of the City of San Bernardino, or upon separation, whichever
7 occurs first.
8 8. ENTIRE AGREEMENT. This Agreement contains the entire agreement between
9 the parties. Any correspondence, letters, documents or discussions leading up to this Agreement
10 or in any other way made between the parties or their agents are replaced and superseded by this
11 Agreement.
12 9. NONSEVERABILITY. The provisions of this Agreement are not severable one
13 from the other. Should any of the provisions of this Agreement be determined invalid or
14 unenforceable for any reason by the final judgment of a court of competent jurisdiction, then this
15 Agreement in its entirety shall thereupon become null and void.
16 II. AMENDMENT. This Agreement may only be amended by a written agreement
17 executed by the parties, and may not be amended by oral agreement.
