Synopsis of Previous Council Action:
7/21/08 - Mayor and Council adopted Resolution No. 2008-283 authorizing the City Manager to
execute an Agreement with the San Bernardino City Unified School District relating to delivery
of Type A lunches to City sites for the District's Year-Round Lunch Program for FY 08/09.
Recommended Motion:
Adopt Resolution.

Staff Report
Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
City Manager to execute Extension Offer - Year 2 of 3 - to the Food Service Agreement with
the San Bernardino City Unified School District relating to delivery of Type A lunches to City
sites for the District's Year-Round Lunch Program for FY 09/10.
Background:
The City has participated in the District's Year-Round Lunch Program for the past fifteen
years. The program provides meals to youth ages 18 years and younger who are off-track and
participate at City Community Centers. Each site receives a minimum of twenty (20) meals/day
that are prepared and delivered by the San Bernardino City Unified School District. All Type A
meals offered are wholesome and meet the requirements set by the United States Department of
Agriculture for the National Student Lunch Program for students' nutritional needs.
The San Bernardino City Unified School District charges the City for all leftover, second or
adult meals. The cost to the City for FY 09/10 is $2.80 for a student box style lunch and $2.95
for an adult box style lunch. Each Center would be responsible for reimbursing the San
Bernardino City Unified School District at the rate of $2.80/meal for all leftover and second
meals provided to school age participants and $2.95/meal for all adult meals from their
individual trust account.
Financial Impact:
There is no cost or financial impact to the City's General Fund for this program. The only cost
to the City is for any unused or leftover lunches each day, and this cost is paid for from various
donations or fund raisers at the centers.
Recommendation:
Adopt Resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the City Manager is hereby authorized to execute EXTENSION
OFFER - YEAR 2 OF 3 - TO THE FOOD SERVICE AGREEMENT with the San Bernardino
City Unified School District relating to delivery of Type A lunches to City sites for the
District's Year-Round Lunch Program for FY 09/10. A copy of said extension to the
Agreement is attached hereto and marked Exhibit "A"; and
SECTION 2. That the implementation date of the Agreement is July I, 2009;
therefore, any action taken between July 1. 2009, and the date that this Resolution is adopted is
hereby ratified.

RE: Food Service Agreement (Reimbursable/Box Style) EXTENSION OFFER-Yr. 2 on
This letter is in reference to the Food Service Agreement dated July 1.2008, between the DISTRICT and the CITY. The
first year of this agreement will expire on June 30, 2009. This agreement provides for extension by mutual written
consent, one fiscal year at a time (July I-June 30) up to a total of three years, subject to the written notice of terms and
conditions agreed upon by both parties by June 30th of each year.
This letter serves as written notification of the District's offer to extend this agreement through June 30. 2010, and also as
written notice of the following changes:

V. CITY Responsibilities
L. Cancellation shall be by thirry (30) days written notice for each delivery location. A notice of less
than 30 calendar days will be subject to a penalty fee charged equal to the price of the average
number of meals ordered per service day, for the first five (5) service days.
If the CITY wishes to extend and agrees to the above noted changes in the agreement, please sign below and return to me
along with your 2009/10 operational calendar(s) as soon as possible-preferably within one (I) week.
