that the Community Development Commission consider this action for approval.
On November 3, 2008, Community Development Commission consider and approved the 2008 Low and Moderate Income
Housing Funds Loan and Grant Property Acquisition Agreement by and between the Agency and California Housing
Foundation, Inc., for the benefit of the developmentally disabled adults

ACQUISITION AGREEMENT FOR THE BENEFIT OF
DEVELOPMENT ALLY DISABLED ADULTS
BACKGROUND:
On September 8, 2008, the Redevelopment Agency of the City of San Bernardino ("Agency") received a
request for financial assistance from the California Housing Foundation, Inc. (the "Project Sponsor").
Specifically, the request called for funding support in order to acquire two properties that are presently for
sale at the following addresses: 6538 North Jordan Lane and 6728 Ofelia Drive in the City of San
Bernardino ("City"). Both properties are in the Verdemont Area of the 5th Ward. Once acquired, these
homes would be refurbished, landscaped and equipped with furniture in order to provide permanent
housing for developmentally disabled adults (the "Project").
Established in 1998, the Project Sponsor is a California non-profit, public benefit corporation with a
501(c)(3) tax exemption affiliated with the Inland Regional Center ("IRC"). Located in Redlands, the
mission of the Project Sponsor is to acquire, develop and/or rehabilitate single-family homes for the
benefit of those developmentally disabled adults who are presently living in substandard housing or with
family members who struggle with meeting the daily needs of these individuals.
The Project Sponsor currently owns and leases 14 properties in the cities of Redlands, Palm Desert,
Beaumont, Hemet, Perris and Apple Valley. Based on a review of photographs and discussions with
representatives of the IRC, all appear to be operating appropriately and are very well maintained.
CURRENT ISSUE:
On November3, 2008, the Commission approved the 2008 Low and Moderate Income Housing Funds
Loan and Grant Property Acquisition Agreement ("Agreement") for the properties located at 6538 North
Jordan Lane and 6728 North Ofelia Drive in the City. Since the approval of the Agreement, the Project
Sponsor have closed escrow and acquired the property located at 6538 North Jordan Lane while the
property located at 6728 North Ofelia Drive fell out of escrow. The Project Sponsor has since been
looking for a replacement property and on May 13,2009, entered into a Purchase and Sale Agreement to
acquire the property located at 6495 North Jordan Lane.
The Project Sponsor is requesting Agency authorization to substitute the 6495 North Jordan Lane
property with the 6728 North Ofelia Drive property per the terms of the Agreement. The property
substitution does not require any additional Agency funding. An affordable housing unit with a 55-year
CC & R will be created and added to the Agency affordable housing inventory to address the housing
needs identified in the approved Housing Implementation Plan and the General Plan housing element.

ENVIRONMENTAL IMPACT:
The property substitution request is exempt under the California Environmental Quality Act ("CEQA")
per Public Resource Code 21080.14.
FISCAL IMPACT:
An approved amount of up to $200,000 in the Agreement has been allocated for the property acquisition
from the Agency's Housing Set-Aside Funds. Agency funds will be secured by a Deed of Trust and a
Promissory Note and a 55-year affordability covenant will be recorded on the property.
RECOMMENDATION:
That the Community Development Commission adopt the attached Resolution.

WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency") is a
body, corporate and politic, organized and existing under the California Community

Redevelopment Law (the "CRL"), as found at Health and Safety Code section 33000, et seq.; and

"Commission") is the governing board of the Agency; and
WHEREAS, the Community Development Commission of the City of San Bernardino (the

WHEREAS, California Housing Foundation, Inc. (the "Grantee"), was formed in 1998 and

incorporated within the State of California as a non-profit organization with the mission of acquiring
15
and leasing residential properties to licensed operators of facilities that house and care for

developmentally disabled adults; and
WHEREAS, on October 3, 2008, the Commission considered and approved the 2008 Low
18
and Moderate Income Housing Funds Loan and Grant Property Acquisition Agreement
19
("Agreement") by and between the Agency and the Grantee for the benefit of developmentally

disabled adults; and
WHEREAS, the Grantee has acquired the property located at 6538 North Jordan Lane and
22
was unable to close escrow on the 6728 North Ofelia Drive property, as per the terms of the
23
Agreement; and

WHEREAS, the Grantee has identified a substitution with a property located at 6495 North
25
Jordan Lane to replace the 6728 North Ofelia Drive property in the City of San Bernardino, as per
26
the terms of the Agreement; and

1 WHEREAS, the Agency is consenting to the substitution of the property located at 6495
2 North Jordan Lane to replace the 6728 North Ofelia Drive property in the City of San Bernardino,
3 as per the terms of the Agreement; and
4 WHEREAS, the property substitution request is exempt under the California Environmental
5 Quality Act ("CEQA") per Public Resource Code 21080.14.
6 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE
7 CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS
8 FOLLOWS:

Section 1.
The Commission hereby approves the substitution of the 6495 North Jordan
10 Lane property in place of the 6728 North Ofelia Drive property, as per the terms of the approved
11 2008 Low and Moderate Income Housing Funds Loan and Grant Property Acquisition Agreement
12 by and between the Agency and California Housing Foundation, Inc., for the benefit of
13 developmentally disabled adults.
This Resolution shall take effect from and after its date of adoption by this
14 Section 2.
