7 WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency") is a
RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF SAN BERNARDINO APPROVING AND AUTHORIZING
THE INTERIM EXECUTIVE DIRECTOR OF THE REDEVELOPMENT
AGENCY OF THE CITY OF SAN BERNARDINO ("AGENCY") TO
EXECUTE AMENDMENT NO. 1 TO THE PROFESSIONAL SERVICES
AGREEMENT BY AND BETWEEN THE AGENCY AND AECOM
8 public body, corporate and politic existing under the laws of the State of California, Health and
9 Safety Code 33101, and is charged with the mission of redeveloping blighted and underutilized
10 land pursuant to Health and Safety Code Section 33396; and
11 WHEREAS, the Community Development Commission of the City of San Bernardino (the
12 "Commission") is the governing body for the Agency; and
13 WHEREAS, on July 19,2010, the Commission approved a Professional Services Agreement
14 ("Agreement") by and between the Agency and AECOM (the "Consultant"), to accomplish any and
15 all tasks necessary to prepare and complete the necessary conceptual and schematic designs for the
16 development of streetscape plans for Downtown San Bernardino; and
17 WHEREAS, since the approval of the Agreement, the Consultant has performed various
18 services and tasks as required pursuant to the Agreement; and
19 WHEREAS, the Consultant has been asked to perform additional tasks related to the
20 preparation of final design and construction drawings for Downtown San Bernardino streetscape
21 improvements; and
22 WHEREAS, the additional tasks were not anticipated in the Agreement and not previously
23 authorized, and the requirement for undertaking the additional tasks and services have necessitated
24 the increase in the contract dollar amount for professional services.
25 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE
26 CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS
27 FOLLOWS:

The Commission hereby approves Amendment No.1 to the Agreement by
2 and between the Agency and the Consultant, in the form as attached hereto as Exhibit "A", and as
3 presented to the Commission upon adoption of this Resolution, and the Commission hereby
4 authorizes the Interim Executive Director of the Agency to execute Amendment No. 1 on behalf of
5 the Agency together with such technical and conforming changes as may be recommended by the
6 Interim Executive Director of the Agency and approved by the Agency Counsel and the City
7 Attorney.

AMENDMENT NO.1
TO THE
REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO
AGREEMENT FOR PROFESSIONAL SERVICES
(DOWNTOWN STREETS CAPE PLAN)
AECOM
THIS AMENDMENT NO.1 to the Redevelopment Agency of the City of San Bernardino Agreement
for Professional Services (Downtown Streetscape Plan), AECOM (this "Amendment No.1"), is dated
as of May 16, 2011, and is entered into by and between the Redevelopment Agency of the City of San
Bernardino, a public body, corporate and politic' (the "Agency") and AECOM (the "Consultant"), and
amends certain provisions of that certain Agreement for Professional Services with AECOM, dated as
of July 19,2010 by and between the Agency and the Consultant (the "Agreement"). The Agency and
the Consultant agree as follows:
RECITALS
WHEREAS, the Agency and the Consultant have executed and entered into the Agreement,
and the Consultant has performed various services and tasks as required pursuant to the Agreement;
and
WHEREAS, the Consultant has been asked to perform additional tasks related to the
preparation of final design and construction drawings for Downtown San Bernardino streetscape
improvements, which were not included in the Agreement; and
WHEREAS, the Agency and the Consultant desire to amend the Agreement to provide for an
increase in the contract dollar amount for professional services and the expiration date of the
Agreement pursuant to the terms, covenants and conditions of this Amendment No. 1.
NOW, THEREFORE, IN CONSIDERATION OF THE RECITALS SET FORTH ABOVE,
THE MUTUAL PROMISES OF THE AGENCY AND OF THE CONSULTANT IN THIS
AMENDMENT NO. 1 AND FOR OTHER GOOD AND VALUABLE CONSIDERATION THE
RECEIPT AND SUFFICIENCY OF WHICH ARE HEREBY ACKNOWLEDGED BY THE
AGENCY AND BY THE CONSULTANT, THE AGENCY AND THE CONSULT ANT AGREE AS
FOLLOWS:
1. The Recitals of this Amendment No.1 are incorporated herein by this reference.
2. This Amendment No. 1 amends the dollar amount of the compensation payable by the
Agency to the Consultant from $200,000 to $475,000, representing an increase of
$275,000, as said $200,000 figure is provided in Section 4.A. of the Agreement. Section
4.A. of the Agreement is hereby amended by the insertion of the dollar figure of $475,000
to replace the dollar figure of $200,000.
3. The new and expanded Scope of Work shall consist of the following:

PROJECT SCOPE OF SERVICES - DOWNTOWN STREETSCAPE
AECOM will provide landscape architectural and engineering design services for Downtown
Streetscape consisting of Construction Documents, Bidding Assistance, and Construction
Administration for roadway, utility, hardscape, site lighting, planting, irrigation, as well as
associated cost estimating.
The Phase I streetscape scope includes the 4th Street right of way limits from E Street to F
Street. Additionally, it is anticipated that striping modifications will be necessary on 4th Street
just west ofF Street and just east ofE Street to transition to the narrowed street.
This scope will be an amendment to the existing Downtown San Bernardino Streetscape
Design contract. The AECOM Design Team includes the following sub-consultants:
1. Lighting Design Alliance - Site Lighting
2. Brinkerhoff and Associates - Irrigation Design
3. Guida Surveying, Inc. - Surveying
4. Leighton Group, Inc. - Geotechnical
TASK 1 60% CONSTRUCTION DOCUMENTS
Based upon the Client -approved Schematic Design Package, refine the Preliminary Design to
a 60% Construction Document level for 4th Street between E Street and F Street.
A. FIELD SURVEY - research and obtain record maps, benchmarks, and other information
to establish horizontal and vertical field control necessary to complete the field
survey. All survey datum shall be based upon the California Coordinate System and
County of San Bernardino Benchmarks (unless otherwise directed), establish Field
Control to perform the topographic survey based on the Limits of Survey exhibit
attached.
The Field Survey also includes field data collection of 4th Street 50-feet westerly
from BCRlECR of 4th and F Street to 50-feet easterly from BCRlECR of 4th and E
Street (approximately 850LF), all at 25-foot intervals collecting CL, EP, FL, TC,
Back of Walk, ROW, and Grade Breaks, doorways & Finished Floors of Buildings
(within IS-feet of ROW), existing visible utilities (Gravity Flow Sewer & Storm
Drain MH and CB detailed and dipped for FL elevation), roadway culture &
architecture (street lights, signs, mailbox, signals, etc. ..), create a
topographic/design base map suitable for Civil Design in AutoCAD, and plot the
record Right-of-Way and Centerline within the limits as shown on the Limits of
Survey exhibit attached.
B. GEOTECHNICAL INVESTIGATION - core eXIstmg asphalt pavement at two (2)
locations and hand-auger shallow borings to sample sub grade soils below this
pavement. R-value testing will be performed on the sub grade soils, and develop
recommended pavement section based on Traffic Indexes (Tis) provided by others.

C. ROADWAY PLAN & PROFILE - prepare 60% plan sheets at 20 scale horizontal, 4 scale
vertical, for 4th Street in conformance to City standards.
D. SIGNING & STRIPING PLAN - prepare 60% plans at 40 scale, double stacked, in
conformance to City and MUTCD standards to reflect the striping, pavement
markings and proposed signs.
E. STORM DRAIN PLAN - prepare 60% plans providing for the proposed storm drain
facilities as determined during the Schematic Design. A plan & profile sheet at 20 scale
shall be provided and shall include miscellaneous construction details, as required, for
detailing connections to existing facilities.
F. UTILITY PLAN - prepare 60% plans including existing and proposed composite utility
plans at 40 scale. Disposition of all existing utilities within the project limits shall be
identified. It is assumed that there will be proposed sewer and water connections from the
retail/theater area on the northwest comer of 4th Street and E Street required for this
proposal.
G. ELECTRICAL PLANS - prepare 60% plans depicting pole and luminaire locations, pull
box and power source locations, and wiring/circuit diagrams, schedules, and details.
H. SITE LIGHTING PLANS - prepare Lighting Plans that include roadway lights, bollards,
tree uplights, and pedestrian lights. Provide technical specifications for all standard
lighting fixtures and performance specifications for incorporation into the Construction
Documents. Prepare a complete lighting system specification in draft form with details of
all standard lighting elements, which will be included as an integral section in the
Electrical Engineer's specifications.
I. CONSTRUCTION PLANS & DETAILS - prepare 60% plans that indicate layout,
materials, finishes and colors of project elements including the roads and pedestrian
hardscape treatments. Prepare 60% details of hardscape elements based upon the 60%
Construction Plans.
J. PLANTING PLANS & DETAILS - prepare plans that indicate plant species, SIzes,
quantities and locations. Prepare associated planting details.
K. IRRIGATION PLANS & DETAILS - prepare an Irrigation Master Plan that includes the
points of connection locations, water meter sizes, power drop locations, approximate
number of irrigation controllers and sizes, mainline routing, pipe sleeve locations, sizes
and quantities, calculations to determine whether or not pumps will be required and
indicate locations, required notes, and other pertinent information as required for city
comment and review.
L. OPINION OF PROBABLE CONSTRUCTION COSTS - update the Opinion of
Probable Construction Costs based upon the 60% Construction Document Package.

M. CLIENT REVIEW MEETINGS - attend design review meetings with the Client and other
appropriate members of the Design Team to resolve outstanding design issues that affect
the progress of AECOM's work. Maximum of two (2) meetings in San Bernardino.
N. CONSULTANT COORDINATION - provide coordination by phone or email with the
work of other Consultants.
O. FINAL SUBMITTAL TO CLIENT - submit the final 60% Construction Documents
Package to the Client.

TASK 2 100% CONSTRUCTION DOCUMENTS

Documents suitable for bidding and construction for 4th Street between E Street and F Street.

I. IRRIGATION PLANS & DETAILS - prepare final Irrigation Plans & Details that
indicate all components and facilities for a permanent automatic irrigation system.
Irrigation system includes, but is not limited to, sprinkler head layout, piping, valves,
water supply Point-of-Connection(s), irrigation controllers with notes and call-outs.
Irrigation system design will incorporate current industry technology and installation
methods to produce an efficient system operating within a public environment.
J. SITE LIGHTING PLANS - based on the 60% Construction Document Package,
prepare Lighting Plans that include roadway lights, bollards, tree uplights, and
pedestrian lights. Provide technical specifications for all standard lighting fixtures and
performance specifications for incorporation into the Construction Documents. Prepare
a complete lighting system specification in draft form with details of all standard
lighting elements, which will be included as an integral section in the Electrical
Engineer's specifications.
K. SPECIFICATIONS AND BID DOCUMENTS - based upon the ICDC-established
format, prepare Specifications and Bid Documents/Forms for AECOM's Scope of
Work.
L. OPINION OF PROBABLE CONSTRUCTION COSTS - update the Opinion of
Probable Construction Costs based upon the 100% Construction Document Packages.
M. IN-HOUSE REVIEW AND PLAN CHECK - provide continuous in-house quality
review and plan check of the Construction Documents.
N. CONSULTANT COORDINATION - provide coordination by phone or email with
the work of other Consultants, including Vanir, as it relates to AECOM's work. (This
task does not include work-sessions, site meetings or weekly/monthly group
conference calls with team.)

O. CLIENT REVIEW MEETINGS - attend design review meetings with the Client and

milestone dates. Maximum of two (2) meetings in San Bernardino.
P. 100% SUBMITTAL - submit the revised Construction Documents Package to the
Client for final approval.
Q. CLIENT REVIEW REVISIONS - provide minor reVISIOns to the Construction
Documents Package based upon the Client's review and the City's plan check review
comments of the 100% Construction Documents Package.
R. BID SET SUBMITTAL - submit a final "Bid Set" construction documents package
to the Client for bidding and construction.

TASK 3 WATER QUALITY MANAGEMENT PLAN
Site topography, existing infrastructure, land use, impervious surface, and general drainage
characteristics will be summarized from the drainage study and analyzed relative to the
proposed designs in a City-compliant Water Quality Management Plan (WQMP).
The WQMP will serve to document and assess the potential impacts to hydrology, water
resources, hydromodification, and water quality associated with the proposed project footprint,
as well as the required measures to reduce these impacts to the maximum extent practicable
(MEP). This report may be used by EDA and City staff to assist in assessing water
resource/supply issues if needed.
AECOM will make maximum use of existing documentation to adequately address the
anticipated impacts of the project, characterize environmental issues, and identify impact
minimization design measures (e.g. BMPs).
Compliance with construction and post-construction storm water management requirements
will be summarized in terms of complying with state and jurisdictional (i.e., municipal)
regulations. EDA and the City will provide other pertinent design requirements to assess
project compliance and/or compliance requirement needs. Based on AECOM's project
understanding of the discipline and the local/regional/state requirements, the project will have
to comply with the following:

TASK 4 BID ASSISTANCE
Assist the Client during the bidding of AECOM's Construction Documents.
A. ADDENDA - provide Addenda to the Construction Documents during bidding and
provide coordination and written documentation as required.
B. BIDDER COORDINATION - respond to bidders' questions during the bidding period.
C. PRE-BID MEETING - attend the Pre-Bid Meeting. One (1) meeting in San Bernardino.
D. BID EV ALUA TION AND SELECTION MEETING - attend the Bid Evaluation and
Selection Meeting. One (1) meeting San Bernardino.
E. BID AWARD MEETING - attend the Bid Award Meeting. One (1) meeting San
Bernardino.

TASK 5 CONSTRUCTION ADMINISTRATION
Assist the Client in making periodic site visits to monitor the progress of the work and to
determine if the Project is proceeding in accordance with the design intent of the
Construction Documents.
A. LANDSCAPE SITE VISITS - provide a maximum of eight (8) site visits to review some,
if not all, of the following stages of landscape construction:
. Pre-Construction or "Kick-Off' Meeting
. Completed paving mock-ups
. Layout/installation ofhardscape elements
. Layout of plant material and trees
. Irrigation sprinkler coverage test
. Installation of way finding/directory signage
. Pre- Final Walk-Through to establish the "Punch List"
. Final Walk-Through for project acceptance

B. LIGHTING SITE VISITS - provide a maximum of one (1) site visit during construction
to review installation, adjust for construction conflicts, targeting changes, and adjustments
of fixtures where required, and provide one (1) site visit upon completion of light fixture
installation to aim adjustable fixtures, provide punch lists, set controls (if required), verify
the design, and educate the Client on the lighting system.
C. FIELD REPORTS OR "PUNCH LISTS" - prepare typed Field Reports or "Punch Lists"
that indicate the status of construction for each site visit.
D. PLANT SELECTION AND TAGGING - visit Southern California nurseries to review
and tag trees and shrubs for the project. One (1) AECOM staff person for a maximum of
two (2) days.
E. PROJECT COORDINATION - perform on-going coordination with the Client, the
Consultant Team and the Contractor to resolve landscape-related construction and
installation issues.
F. SHOP DRAWING AND SUBMITTAL REVIEW - review, comment and process the
Contractor's Shop Drawings and Submittals as they relate to the AECOM Design Team's
Construction Documents.
G. REQUESTS FOR INFORMATION - during the course of construction review and
respond to the Contractor's Requests for Information as they relate to AECOM's
Construction Documents. Prepare clarification sketches, if required, to resolve
construction ambiguities.
H. CHANGE ORDERS - prepare and coordinate Change Orders to the Construction
Contract as they relate to AECOM's Construction Documents.
