Resolution of the Mayor and Common Council of the City of San
Bernardino, California, reciting the facts of the Special Municipal
Election held on the 17th day of March 2009, declaring the results thereof
and setting forth such other matters as are allowed by law.
BACKGROUND INFORMATION:
Elections Code Division 15, Chapter 4 (Official Canvass), Section 15372, requires that
a certified statement of the results of an election must be submitted to the governing
body within 28 days of an election. The County Registrar of Voters conducted the
City's Special Municipal Election on March 17, 2009, to fill the vacancy on the 4th
Ward Council seat. The Registrar of Voters issued the certified statement of results on
March 23, 2009.
San Bernardino City Charter, Section 11, and San Bernardino Municipal Code Section
2.56.130B provide that at the next regular or adjourned regular Council meeting
following the completion of the canvass, the Mayor and Common Council shall declare
the results of the election as official. Adoption of this resolution serves to declare the
election results as official.
RECOMMENDED MOTION:
Adopt resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL
MUNICIPAL ELECTION HELD ON THE 17TH DAY OF MARCH 2009,
DECLARING THE RESULTS THEREOF AND SETTING FORTH SUCH OTHER
MATTERS AS ARE PROVIDED BY LAW.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
WHEREAS, a Special Municipal Election was held and conducted in the City of San
Bernardino on the 17th day of March 2009; and
WHEREAS, notice of said election was duly and regularly given in the time, form and
manner as provided by law; voting precincts were properly established; election officers were
appointed and in all respects said election was held and the returns made and declared in the
time, form, and manner as required by the provisions of the Charter of the City of San
Bernardino and the Elections Code of the State of California for the holding of public
elections in the City of San Bernardino; and
WHEREAS, pursuant to Resolution No. 2008-438, adopted on December I, 2008, the
Registrar of Voters of the County of San Bernardino canvassed the returns of said election and
has certified the results to this City Council and said results are received, attached and made a
part hereof as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the
City of San Bernardino as follows:
Section 1:
That pursuant to Resolution No. 2008-438, the Special Municipal Election was
conducted by all mail ballot.

Section 2:
That said Special Municipal Election was held for the purpose of filling
6 the vacant Fourth Ward Council Seat.

Section 3:
That the grand total of all votes cast in the City of San Bernardino in
said election was 3,227. That the number of votes cast for the Fourth Ward election is listed
on the attached Exhibit A.
Section 4:
That the City Clerk shall enter on the records ofthe City Council of
said City a statement ofthe results of the Special Municipal Election held on the 17th day of
