CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
SUBJECT
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of a
services agreement and issuance of a purchase order to Law Enforcement Medical Services for evidence
collection not to exceed $80,000 for FY 2008-09 with one optional renewal year.
BACKGROUND
The San Bernardino Police Department has contracted with Law Enforcement Medical Services for evidence
collection (venipuncture and sexual assault examinations) since 2001. L.E.M.S (Law Enforcement Medical
Services, Inc.) currendy provides evidence collection for the San Bernardino County Sheriff and most Police
Departments in San Bernardino County.
In 2001, L.E.M.S. was the sole responder to City of San Bernardino bid F-01-46 and sole responder to the
County of San Bernardino bid in 2004. Because L.E.M.S. was the sole responder to these bids and the sole
provider of these services, the San Bernardino Police Department opted to take advantage of the San
Bernardino County contract pricing. Resolution 2004-360 was approved on November 16, 2004 authorizing
the City of San Bernardino to piggyback on the County of San Bernardino contract with L.E.M.S. for
evidence collection through June 2008.
The San Bernardino County contract with L.E.M.S expires October 31, 2009. It is econOln1cally
advantageous for the City of San Bernardino to utilize the County contract pricing and issue an annual
purchase order not to exceed $80,000 for FY 2008-09 with one optional renewal year. Expenditures for
2008-09 are forecasted to total approximately $72,000. The "not to exceed" limit is established at $80,000 to
allow for any additional expenditures resulting from special programs (patrol programs, DUI checkpoints,
grant programs) through the end of the contract period. In October 2009, the San Bernardino Police
Department will have the option of re-bidding evidence collection services or continuing the practice of
piggybacking on the County contract pricing.
FINANCIAL IMPACT
The Police Department's approved General Fund budget for FY 2008-09 includes $67,200 in account 001-
220-5505 for evidence-collection and sexual assault exams. The approved 2008-09 O.T.S. grant budget
includes $5,000 for evidence collection to offset the increased cost of evidence collection as a result of D.U.r.
checkpoints and traffic safety programs.
