Recommended Motion:
1. Authorize the Director of Finance to amend the FY 2008/09 Budget by transferring $42,771.00 from
Account No. 258-359-5504-7741 "SS07-32 Realignment of Viaduct Boulevard" to Account No. 258-
359-5504-7740 "TC08-01 Install Traffic Signal at Realigned Viaduct Boulevard and 2nd Street"; and
2. Authorize the Director of Finance to amend the FY 2008/09 Budget by transferring $90,482.00 from
Account No. 258-359-5504-7741 "SS07-32 Realignment of Viaduct Boulevard" to Account No. 258-
359-5504-7769 "SD08-01 Viaduct Boulevard-Realign Existing Storm Drain"; and
3. Adopt Resolution.

STAFF REPORT
Subiect:
Resolution awarding a contract to Matich Corporation for the Realignment of Viaduct Boulevard
between 2nd Street and 3rd Street per project Plan Nos. 12325 & 12326 and authorization for the
Director of Finance to amend the FY 2008/09 Budget.
Backeround:
On September 2, 2008, the Mayor and Common Council approved the FY 2008/09 Capital
Improvement Program (CIP), which included several projects related to construction of a
Metrolink Parking Structure at the Santa Fe Depot. CIP No. SS07-32 is for the realignment of
Viaduct Boulevard between 2nd Street and 3rd Street and CIP No. GB04-19 is for construction of
a 350 space parking structure for use by Metrolink Riders.
This first phase of the work, which is necessary to clear the site for the parking structure, consists
ofthe following items:
1. Realignment of Viaduct Boulevard between 2nd Street and 3rd Street (SS07-32 & SS04-34).
2. Realignment of a 42-inch reinforced concrete pipe storm drain (SD08-01).
3. Realignment of an 8-inch San Bernardino Municipal Water Department water main.
4. Installation ofa traffic signal at the intersection of 2nd Street and Metrolink Way (TC08-01).
The plans and specifications for this project were completed and the project advertised locally in
the San Bernardino County Sun Newspaper, F. W. Dodge, Construction Data Hot Sheet, Reed
Construction Data and Bid America, Construction Bid Source, the City's web sites, and the San
Bernardino Area Chamber of Commerce.
A total of thirteen (13) bids were received and are listed below:

When the bids were initially opened, it appeared that Elite Bobcat Service, Inc. was the lowest
bidder. However, on close analysis, it was found that Elite's bid for Item No 4 in Bid Schedule
No. 2 "Install 42" RCP to Join Existing, including Plugs of Existing, per Plan, Complete in
Place" indicated in handwritten words "seven hundred thirty five Dollars & no Cents" per linear
foot, but indicated in numbers "$135.00" per linear foot. The instructions to bidders clearly state
that in case of conflict, the written words will take precedence over numbers. After recalculation
of Elite's bid using $735.00 per linear foot, their total bid amount equaled $1,647,600.00,
ranking them twelfth highest of the thirteen bidders. Matich Corporation was determined to be
the lowest bidder at $1,135,311.00.
After complete review of the sealed competitive bids received and verification of mathematical
calculations and certifications, staff has determined that Matich Corporation of San Bernardino,
the apparent low bidder, has met the minimum requirements of the specifications and bid
guidelines. Therefore, staff recommends that the Mayor and Common Council award the
referenced contract to Matich Corporation.

If approved, this project is expected to begin construction in late March of 2009 and be
completed by August of 2009. During construction, Viaduct Boulevard will be closed and
approximately 70 parking spaces at the Metrolink Station will be displaced for a period up to 6
months. There is a serious shortage of existing parking for Metrolink riders and the loss of 70
spaces would severely impact the ability of riders to find parking.
To compensate for the loss of parking spaces during construction, an Agreement was approved
on December 15, 2008, with Placo San Bernardino, LLC, owner and operator of the Carousel
Mall, to allow the City use of an existing parking lot located at the northeast corner of "G" Street
and 2nd Street. This auxiliary parking lot will offer an alternative for the displaced Metrolink
parking and no major improvements will be needed.

Staff is currently working with Omnitrans to provide shuttle service between the auxiliary
parking lot and the Metrolink train station Monday through Friday, during the peak morning and
evening commute periods. A proposed Agreement has been received from Omnitrans to provide
the shuttle service. Staff will be recommending approval of the Agreement at the Mayor and
Common Council meeting of March 2, 2009.
Caltrans Local Assistance is expected to approve the National Environmental Policy Act (NEPA)
document for the parking structure by June of2009. This clearance will allow the City to submit
final plans for approval by Caltrans and to submit a Request for Authorization (RF A) to proceed
with construction. Approval of the final plans and the RF A will obligate federal Congestion
Management and Air Quality (CMAQ) funds for the project. Construction of the structure is
expected to start in November of2009 and be completed by November of20l0.

The total funding available is adequate for the project. However, it is necessary to transfer
funding from CIP project SS07-32 (Prop I-B) to fully fund the storm drain (SD08-0l) and the
traffic signal (TC08-0 1). Please see the attached Attachment "B" spreadsheet for details of the
budget adjustment. After adjustment, the project funding will be as follows:

It is anticipated that only $362,806 of the authorized $862,806 amount as noted above for
Proposition I-B funds would actually be used on this project. The adjacent La Placita Project has
entered into an agreement with the EDA and the developer has committed in this agreement to
remit a fair-share contribution of $500,000 towards the CIP Project. CIP Project SS07-32 has the
$862,806 available in the event the developer delays or defaults in funding this $500,000 fair-
share contribution for off-site improvements. The $500,000 will be included in the construction
budget to reduce the amount of Proposition l-B funds.

PRECISE GRADING IMPROVEMENTS (SS 07-32), PLAN NO. 12325; STREET
IMPROVEMENTS (SS 07-32 & SS 04-34), STORM DRAIN IMPROVEMENTS (SD 08-
01) & TRAFFIC SIGNAL IMPROVEMENTS (TC 08-01), PLAN NO.12326 AND CITY
OF SAN BERNARDINO MUNICIPAL WATER DEPARTMENT WATER
IMPROVEMENT - METROLlNK PARKING STRUCTURE, PLAN NO. 12576 FOR
THE REALIGNMENT OF VIADUCT BLVD. BETWEEN 2ND STREET AND 3RD
STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Matich Corporation, 1596 Harry Sheppard Boulevard, San Bernardino,
CA 92408 is the lowest responsible bidder for Precise Grading Improvements (SS 07-32), Plan
No. 12325; Street Improvements (SS 07-32 & SS 04-34), Storm Drain Improvements (SD 08-
01) & Traffic Signal Improvements (TC 08-01), Plan No.12326 and City of San Bernardino
Municipal Water Department Water Improvement - Metrolink Parking Structure, Plan No.
12576 for the Realignment of Viaduct Blvd. between 2nd Street and 3rd Street.
A contract is awarded accordingly to said bidder in a total amount of $1,135,311.00, with a
contingency amount of $160,299.00, but such award shall be effective only upon being fully
executed by both parties. All other bids, therefore, are hereby rejected. The City Manager is
hereby authorized and directed to execute said contract on behalf of the City; a copy of the
contract agreement is on file in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. The Director of Finance is hereby authorized and directed to issue a
Purchase Order for services based on said contract.
SECTION 3. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
