Subiect:
Resolution authorizing the execution of an easement to Southern California Edison Company
across City owned property located at 1298 N. Pennsylvania Avenue (Anne Shirrells Park).

On August 18, 2008, Resolution No. 2008-326 was adopted, approving the execution of a Lease
Agreement with Omnipoint Communications, Inc (T-Mobile) for the placement of a monopine
cell tower at Anne Shirrells Park.
This office received a request dated November 10, 2008, from Spectrum Land Services on behalf
of Southern California Edison Company (SCE) for an approximately 191.25 sq. ft. (9' X 21.25')
easement on City property for the installation of an electric distribution facility. SCE has been
requested to furnish electric service for the new T-Mobile cell site located at 1298 N.
Pennsylvania Avenue (Anne Shirrells Park).
Although the Lease Agreement authorizes the Lessee (T-Mobile) to provide utilities to the leased
area, the Lease does not provide easement rights to SCE. This easement will allow SCE to
provide the necessary service to T -Mobile. The easement will not affect City use of the park and
there will be no charge to the City for the construction of this new line.
The attached resolution authorizes the execution of an easement to SCE. All recording fees
associated with this easement will be paid for by SCE.
Financial Impact:
None. Southern California Edison Company will pay for the construction and installation of the
distribution facility and pay all recording fees relative to this easement.
Recommendation:
Adopt Resolution.

California Edison Company has been requested to furnish electric service the new T-
Mobile IMS Site IE24775B-Anne Shirrells Park" located at 1298 N. Pennsylvania

To enable Edison to provide this service, we would like to obtain an easement across your
property. There will be no charge to you for the construction of this line, nor does the
granting of this easement obligate you to take service. In the event you should desire
service for the future development of your property, it could be furnished from this line.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor of the City of San Bernardino is hereby authorized and
directed to execute on behalf of the City, a Grant of Easement to Southern California Edison across
City owned property, located at ]298 N. Pennsylvania Avenue, known as Anne Shirrells Park,
more fully described in the Grant of Easement document attached hereto as Exhibit" 1 " and made
a part hereof.

Grantee requests said easement for installation of Grantee's underground systems to service the new T-Mobile lMS Site
IE24775B-Anne Sherrills Park. Consideration for Grantor's grant of easement to Grantee is the rent Grantor will receive from
the Lease between Grantor and T -Mobile, recorded in the County of San Bernardino on December 15, 2008 as Memorandum of
Lease, under Document No. 2008-0553079.
Grantor agrees for himself, his heirs and assigns, not to erect, place or maintain, nor to pennit the erection, placement or
maintenance of any building, planter boxes, earth fill or other structures except walls and fences on the above described real
property. The Grantee, and its contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger
or interfere with said systems and shall have free access to said systems and every part thereof, at all times, for the purpose of
exercising the rights herein granted; provided, however, that in making any excavation on said property of the Grantor, the
Grantee shall make the same in such a manner as will cause the least injury to the surface of the ground around such excavation,
and shall replace the earth so removed by it and restore the surface of the ground to as near the same condition as it was prior to
such excavation as is practicable.
