1. SPLIT OF CIVIL SERVICE/PERSONNEL-
received a progress report and continued
september 22, 1988 (See attachment #1).
2. DRUG TESTING POLICY The Committee received a
thorough and excellent briefing of the proposed drug screen-
ing program. The Directors of Personnel and Risk Management
have been asked to address several concerns of the Committee
and report back at the January 5, 1989 Personnel Commmittee
meeting (See attachment #2).

3. FILLING EXISTING CITY ATTORNEY CONTRACT POSITION -
The Committee recommended approval of the contract agreement
arrangement for filling the Litigation Contract Attorney's
position (See attachment #3).
4. FILLING LEGAL SECRETARY POSITION The Committee
concurred with the City Attorney's recommendation to fill the
Legal secretary II position at the recommended range and step
(See attachment #3).
5. FILLING DEPUTY CITY ATTORNEY II POSITION The
Committee concurred with city Attorney's recommendation to
fill the Deputy city Attorney II position at the recommended
range and step (See attachment #3).

The civil Service Board chairperson has established a commit-
tee to study civil service Board rules to more clearly define
the roles and responsibilities of the Chief Examiner and the
Director of Personnel in the area of recruitment and selec-
tion. It's goal will focus on efficiency while still main-
taining the civil Service merit system.
I expect this to be a long process as many factors must be
considered, i.e. the charter, meet and confer issues, legal
aspects, as well as equal opportunity and affirmative action
concepts. The first meeting of this committee has been set
for August 23, 1988, and I will be providing periodic pro-
gress reports of that committee as necessary to keep your
body informed.

PROGRAM
1. Drug testing in conjunction with Driver. Safety Program -
every year for all Class 1 drivers - every two years for
all Class 2 drivers - every three years for all Class 3
drivers.
2. Drug testing for all new employees when job description
requires maintenance of a valid California Drivers
License (Class 1, 2, or 3).
3. Drug testing for any employee when his/her supervisor
has reasonable suspicion that drug or alcohol abuse is
affecting job performance. Supervisor must have the
concurrence of two other supervisors and the concurrence
of either the Risk Manager, the Safety Officer, or the
City Nurse. (Note: All supervisors and Managers must
receive at least 4 hours of training in detection of
drug and alcohol abuse.)

The following individuals are recommended for the positions and
salary indicated:
RICHARD DE LA TORRE - Litigation Contract Attorney - S57,000.00
per year ($4,803.00 per mo.), plus benefits, 2 year
contact, 30 day cancellation clause.
DIANE ROTH - Deputy City Attorney II - Range 3158 Step 1-
$3,572.00 per month
CYNTHIA ZOBEL - Legal Secretary II - Range 3102 Step 1-
$1,789.00 per month.

AGREEMENT FOR ATTORNEY SERVICES
~
THIS AGREEMENT, made and entered into this ____ day of
, 1988, by and between the City of San
Bernardino, a charter city and municipal corporation (.City.),
and LOREN McQUEEN (.Attorney.).
WITNESSETH:
WHEREAS, City has need on an interim basis for full-time
attorney services beyond the amount allocated in the City
Attorney's office; and
WHEREAS, Attorney asserts that she is specially trained,
experienced and competent to perform such services.
NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
1. City hereby employs Attorney to provide full-time
legal assistance in the City Attorney's office with respect to
matters assigned by the City Attorney under the supervision of
the City Attorney or his designee.
2. City shall compensate Attorney for services rendered,
as follows:
(a) Monthly Compnesation. For each month of
service (paid every two weeks with the
City payroll), Attorney shall be
compensated in the gross amount of
$4,570.00. Such amount shall be
subject to standard withholding and other
deductions in like manner as a full-time
City employees in the City Attorney's
office. Such amount shall be subject

to adjustment. in the.same amount
or percentage and at the same time that
City adjusts compensation for Deputy
City Attorneys IV.
(b) Benefits. Attorney shall be entitled to
the same benefits including but not
limited to vacation, sick leave,
health insurance, etc., as are provided
by City to Deputy City Attorneys IV.
(c) SUD~ort Services. City shall provide
Attorney with office space, telephone,
adequate office furniture, secretarial
support and other related services which
would normally be provided to a Deputy
City Attorney.
3. The parties understand and agree that Attorney was
previously an employee of the City and, although shall be on
contract status for the time period of this Agreement, shall
continue to accrue vacation, sick leave, seniority and other
accoutrements of employee status as if Attorney was an
employee. However, Attorney shall not obtain or maintain a
vested right to continued employment. Should, however, at the
termination of this Agreement or any extension thereof Attorney
be reinstated to employee status, the time period during which
Attorney served under this contract shall be counted as time in
employment with the City.

4. This Agreement shall commence on June 7, 1988, and
shall terminate on June 6, 1989. However, prior to such
automatic termination, either the Attorney or the City Attorney
may terminate this Agreement for any reason upon thirty (30)
days' written notice to the other.
5. Any notice to be given pursuant to this Agreement
shall be deposited with the United States Postal Service,
postage prepaid, and addressed as follows:

6. This document contains the entire Agreement between
the parties.
