Staff Report
Subject:
Resolution approving Amendment No. I to an Agreement with the County of San Bernardino (County
Contract No. 07-451) for pavement rehabilitation on Cajon Boulevard from 0.22 miles northwest of Palm
Avenue to 0.05 miles northwest of Rex Cole Road (SS07-06).
Background:
In early 2007, the County of San Bernardino Department of Transportation proposed a cooperative
project with the City to rehabilitate the pavement on Cajon Boulevard from Palm A venue to Rex Cole
Road. The County proposed to break the project into two segments. Project I is from 0.22 miles
northwest of Palm Ave northwesterly to the centerline of the BNSF Railroad Overcrossing, a length of
approximately 1.4 miles, and Project 2 is from the BNSF Railroad Overcrossing to 0.05 miles northwest
of Rex Cole Road, a length of approximately 1.3 miles. The total length of the entire project is
approximately 2.7 miles (14,000 feet).
On May 21, 2007, a Cooperative Agreement (County Contract No. 07-451) for the work was approved by
the two Agencies at an estimated cost to the City of $226,338. Sufficient funds were budgeted in the
City's FY 2007/08 Capital Improvement Program under Project No. SS 07-06, with the intent that the
work would be completed in late 2007. The County was designated the lead agency for the rehabilitation
project.
Start of the rehabilitation project was delayed due to conflicting work on the new FedEx distribution
center. It was necessary for Hillwood, the developer, to extend a sewer main approximately one mile in
Cajon Boulevard to serve the project and that necessitated excavating a trench in the middle of Cajon
Boulevard within the reach proposed for rehabilitation. The County agreed to hold off the rehabilitation
work until the sewer work was completed.
The County also reviewed the limits of the work being done for the Project I segment, and determined
that the City's share of the cost of the work was somewhat less than originally estimated. The revised
City share, based on the revised cost estimate, is $176,700. On October 17, 2008, the County requested
approval of Amendment No. I to the Cooperative Agreement (County Contract No. 07-45 I-AI),
reflecting the revised cost estimate and cost share distribution.
The majority of the City's portion of the overlay work on Cajon Boulevard, from BNSF Railroad to Rex
Cole Road, which is the Project 2 segment, is being done to fulfill off-site requirements of the FedEx
distribution center project and, therefore, the City will incur no cost for this work. With the assistance of
HilIwood Investments and on their behalf, the City successfully applied for and received a grant from the
Federal Economic Development Agency (FEDA) to fund the widening improvements on Cajon Blvd.
within the limits of the FedEx site. The widening improvements include curb, gutter, sidewalk,
landscaping and rehabilitation of existing pavement on Cajon Blvd. These improvements will be
constrncted by the City as a Public Works project. HilIwood Investments will fund the constrnction and
they will be reimbursed by the City as the City gets reimbursed by FEDA.
This reach of Cajon Boulevard from 0.22 miles northwest of Palm Avenue to 0.05 miles northwest of Rex
Cole Road is in urgent need of rehabilitation. Claims for damage from potholes along this reach are
frequent. The reach from Palm Avenue to the BNSF Railroad Overcrossing is in especially poor
condition.

Under terms of the Cooperative Agreement and Amendment No. I, the County will design the project,
contract out the work and bill the City for its share based upon the percentage of actual cost as indicated
in Exhibit "A" attached to the Agreement. The County is proposing to complete the work in two segments
as indicated in the attached maps marked Project No. I "Pavement Rehabilitation for Cajon Boulevard
from 0.22 miles north of Palm Avenue to the BNSF Railroad overcrossing" and Project No.2 "Pavement
Rehabilitation for Cajon Boulevard between the BNSF Railroad Overcrossing and 0.05 miles north of
Rex Cole Road."
The proposed rehabilitation strategy is to remove and replace failed areas of pavement, grind the existing
roadway full width and overlay with at least 1.5 inches of new asphalt pavement.
Although Project No. 2 "Pavement Rehabilitation for Cajon Boulevard between the BNSF Railroad
Overcrossing and 0.05 miles north of Rex Cole Road" is shown in the original Agreement and
Amendment No. I, the City's share of the cost for that reach will be zero since it is covered by the FEDA
grant project.
The original agreement indicated an estimated cost to the City of $226,338. Amendment No. I indicates
an estimated cost to the City of$176,700, which is a reduction of $49,638.
Staff believes this cooperative project will be beneficial to both agencies. Cooperative projects with the
County typically have elements under the jurisdiction of both the City and County of San Bernardino and,
therefore, lend themselves well to such a cooperative effort.
Approval of this Agreement will allow the County to proceed with bidding the project. Construction is
expected to start prior to the end of FY 08/09.
The County is requesting that three (3) copies of Amendment No I be executed and returned to them for
processing before the Board of Supervisors. The County will return one fully executed copy to the City
after approval.
Financial Impact:
Sufficient funds for this project are available in Capital Improvement Project No. SS07 -06 "Cajon
Boulevard Pavement Rehabilitation from 0.22 miles north of Palm Avenue to BNSF Railroad
Overcrossing" in Account No. 126-369-5504-7675.
Recommendation:
Adopt Resolution.

copy of said Amendment No. I is attached as Attachment "A" and made a part hereof.
SECTION 2. The authorization to execute the above-referenced Amendment No. I is
rescinded if the parties to the Amendment fail to execute it within sixty (60) days of the passage
of this resolution.

WHEREAS, the COUNTY and CITY have previously entered into an Agreement, Contract No. 07-451; and
WHEREAS, the COUNTY and the CITY now desire to amend this Agreement.
NOW, THEREFORE, it is hereby agreed to amend County Contract No. 07-451 between the County and the
City as follows:
1. CHANGE the description of limits of PROJECT-1 and PROJECT-2, to the following:
PROJECT-1: From .22 mile northwest of Palm Avenue, northwesterly to .32 mile northwest of the
Burlington Northern and Santa Fe railroad over-crossing (BNSF).
PROJECT-2: From .32 mile from BNSF, northwesterly to .05 miles northwest of Rex Cole Road.
2. CHANGE percentage of PROJECT-1 within each jurisdiction, to the following:

. PRGlJECT-1 is partially (76.5%) in the unincorporated area of the COUNTY and partially (23.5%)
within the incorporated area of the CITY; and
3. DELETE the existing fourth WHEREAS statement, and SUBSTITUTE the following as a new fourth

WHEREAS, the PROJECTS overall total cost is estimated to be $949,460. PROJECT-1 and PROJECT-
2's estimated total costs are $751,900 and $197,560, respectively. The COUNTY's proportionate share of
cost for PROJECT-1 is $575,200 (76.5%), while the CITY's proportionate share of cost is $176,700
(23.5%). PROJECT-2 shall be within 100% COUNTY area. The COUNTY's proportionate share of cost for
PROJECT-2 will be $197,560 (100%) and the CITY's share will be (0%), as more particularly set forth in
Exhibit "A", attached hereto and incorporated herein by reference
4. DELETE the existing paragraph 1.9 and SUBSTITUTE the following as a new paragraph 1.9:
Pay for its proportional share of the costs for the PROJECTS. The costs of the PROJECTS shall include
the cost of design, construction, construction engineering, and overhead. COUNTY's proportionate share
of cost for PROJECT-1 is estimated at $751,900 (76.5%) and PROJECT-2 is estimated at $197,560
(100%). COUNTY shall be responsible for the sum of $772,760, plus its proportionate share of any
PROJECT cost increases pursuant to paragraph 3.5 below and pay such costs from COUNTY road funds.
5. DELETE the existing paragraph 2.1 and SUBSTITUTE the following as a new paragraph 2.1:

The Parties acknowledge that final costs of the PROJECTS may ultimately exceed current estimates of
the PROJECTS' cost. Any additional costs resulting from increased bid prices, change orders, or arising
from unforeseen site conditions, including Utility relocation (but not from requested additional work by the
CITY or COUNTY, which is addressed in paragraph 3: 7 below) over the estimated total of the PROJECTS'
cost of $949,460 (which is the sum of $772,760 from COUNTY and $176,700 from CITY), shall be borne
by each Party in proportion to where the work actually lies (based on jurisdiction), as part of the Parties'
respective obligations to pay the cost for the PROJECTS.
