RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF
THE CITY OF SAN BERNARDINO APPROVING AND AUTHORIZING AN
AMENDMENT TO SECTION S.B., WORKING HOURS, OF THE
PERSONNEL POLICIES AND PROCEDURES FOR EMPLOYEES OF THE
CITY OF SAN BERNARDINO ECONOMIC DEVELOPMENT AGENCY
WHEREAS, on October 5, 1998, Section S.B., Working Hours, of the Personnel Policies
and Procedures (the "Personnel Policies") for Employees of the City of San Bernardino Economic
Development Agency ("Agency") was approved establishing a 9/80 work week schedule for
Agency employees; and
WHEREAS, alternate work schedules, including the 9/80, were first implemented to
improve employee morale and to promote the policies of the Air Quality Management District
goals to reduce smog and traffic; and
WHEREAS, Agency management has reviewed the effect of the 9/80 work week schedule
on the efficiency and effectiveness of the Agency's accomplishments and ability to serve the
public; and
WHEREAS, due to the Agency's limited number of staff, it has been determined that a
serious shortage of personnel frequently occurs on Fridays, negatively impacting the Agency's
efficiency and effectiveness; and
WHEREAS, the Agency desires to return to a traditional five-day work week; and
WHEREAS, the Agency desires to amend Section S.B. Working Hours, of the Personnel
Policies and Procedures for Employees of the Agency to read as follows:
"The Executive Director shall determine the Working Days of the Agency. The Executive
Director shall set forth in a Memorandum to all Agency Employees the hours of operation
of the Agency on each Working Day and the hours during which the Agency shall be open
to the public on each Working Day.
The beginning and ending times of work for Agency Employees on a Working Day shall be
set by the Executive Director. However, the Executive Director shall by written
Memorandum: 1) place the Agency Employees on notice that, with the approval of the

1 Executive Director, the Agency Employees may adjust their individual beginning and
2 ending times of work on a Working Day, and 2) describe in the procedure by which the
3 Agency Employees may obtain such approval from the Executive Director, and 3) set forth
4 the process of approval by the Executive Director as to beginning and ending times of work
5 which shall be based on the need to maintain adequate staffing levels throughout the
6 Working Day as determined by the Executive Director. The Executive Director may, after
7 timely notice, modify a previously approved beginning and ending time of work to maintain
8 adequate staffing levels throughout the Working Day as determined by the Executive
9 Director.
10 In the exercise of his or her discretion, the Executive Director may allow Agency Employees
11 or an Agency Employee to work on weekends and/or holidays as required to accomplish
12 Agency business"; and
13 WHEREAS, this action authorizes the Interim Executive Director of the Agency to update
14 Administrative Procedure #2 and issue to Agency Staff the new policy regarding work hours
15 consistent with this action and the herein approved amendment to the Personnel Policies.
16 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE
17 CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS
18 FOLLOWS:

Section 1. The Community Development Commission of the City of San Bernardino (the
20
"Commission") hereby finds and determines that the facts and circumstances set forth in the
21
Recitals hereof are true and correct in all respects.

Section 2. The Commission hereby approves the amendment to the Personnel Policies as set
23
forth in the recitals hereto and as further set forth in detail in the form as attached hereto as Exhibit
24
"A". The Commission further authorizes and directs the Interim Executive Director to issue such
25
directives or other Administrative Procedures to Agency staff consistent with this action of the
26
Commission to amend the Personnel Policies.

Section 3. This Resolution shall take effect from and after its date of adoption by this
28
Commission.

AMENDMENT
TO THE
PERSONNEL POLICIES AND PROCEDURES
FOR EMPLOYEES OF THE CITY OF SAN BERNARDINO
ECONOMIC DEVELOPMENT AGENCY
(FEBRUARY 16, 2010)
This Amendment to the Personnel Policies and Procedures for Employees of the City of
San Bernardino Economic Development Agency (this "Amendment") has been approved on
February 16, 2010.
-RECITALS-
The Agency desires to amend Section S.B., Working Hours, of the Personnel Policies
and Procedures for Employees of the Agency to read as follows:
