RE:
Agenda Item #28, Scrap Metal Ordinance
As you may recall we have been continuing the item that is now number 28 on today's
council agenda due to a state bill that was pending on the same subject matter. On September 30,
2008 Governor Schwarzenegger signed four separate bills relating to metal theft. These bills are
AB844 (Berryhill), SB691 (Calderon), ABl859 (Calderon), and SB 447 (Maldonado).
Both AB844 and SB691 amend the Business and Professions Code relating to junk dealers
and take effect immediately. The amendment added section 21608.5(g) to the Code that reads as
follows:
'This section is intended to occupy the entire field of law related to junk
dealer or recycler transactions involving nonferrous metal. However, a city or county
ordinance, or a city and county ordinance, relating to the subject matter of this section
is not in conflict with this section ifthe ordinance is passed by a two-thirds vote and
it can be demonstrated by clear and convincing evidence that the ordinance is
both necessary and addresses a unique problem within and specific to the
jurisdiction of the ordinance that cannot effectively be addressed under this
section." (Emphasis added).
Although the state law is not exactly the same as the ordinance we had drafted regarding
scrap metal, there is not a unique problem that is specific to the City of San Bernardino that cannot
be effectively addressed under the state law. It is for that reason that I recommend that Item #28 be
tabled.
