STAFF REPORT
The Negative Declaration for Public Works Project No. 88-17
was recommended for adoption by the Environmental Review Committee
at its meeting of 6-16-88.
A 14-day public review period was afforded from 6-23-88 to
7-06-88. No comments were received.
The findings of need for health and safety reasons have
not been approved by the City Attorney's office, due to some per-
ceived problems. These problems are outlined in a memo dated
4-08-88. A copy of this memo is attached for reference.
We recommend that the Negative Declaration be adopted and
a finding made that the project is consistent with the Interim
Policy Document.
Comment:
As noted in the City Attorney's 4/8/88 memorandum, a potential
liability would occur if this project proceeds. However, the Mayor and
Common Council authorized this project and policy direction is sought
whether to go ahead. The Director of Public Works/City Engineer endorses
the project and acknowledges the City Attorney's concern, but feels that
easement and hold harmless agreements can be obtained to meet concerns of
liability.

It is my understanding from John Wilson that the above
referenced findings relate to a project for the relief of a
drainage problem caused by a natural spring occurring on the
private property of a Mrs. Damus. Water from the spring imparts
to a number of houses on La Hacienda Avenue near its intersection
with Camino Drive. If this is the case. I cannot approve these
findings.
This project has serious problems which must be addressed
before the City undertakes to resolve what is in fact a private
nuisance. As set forth in the memorandum dated 12-17-86. from
John Wilson to Raymond Schweitzer. the City has no current
liability for the problem. A geologic study of the area was
completed on 2-21-87. In that study. Dr. Floyd Williams
determined that the source of the water is a spring which is a
normally occuring condition of the area.

At its meeting of June 16, 1988, the Environmental Review
Committee recommended adoption of a Negative Declaration for
the following Public Works projects:
Public Work~ _No,._88,-.13 To install a 10" storm drain,
manholes and pipe in the Del Rosa Avenue right-of-way between
Foothill Drive and Bonita Vista Drive.
These Initial Studies (see attached) will receive a 14 day
public review from June 23, 1988 to July 6, 1988. Any
comments received during the review period will be addressed
by the Planning Department and the comments and responses
will be sent to you within a week of the close of the public
review period. After that, you must schedule the projects
before the Mayor and Common Council for adoption of the
Negative Declaration. Please include the Initial Study with
your request for Council Action form. The Planning
Department will file the Notice of Determination after
adoption of the Negative Declaration and a copy of the Notice
will be sent to you.

This report is provided by the City of San
Bernardino as an Initial Study for the proposed
installation of a 10. drain, manholes and pipes to
intercept and deliver existing spring water to a
storm drain channel within Del Rosa Avenue risht-
of-way between Foothill Drive and Bonita Vista
Drive.

Section 19.78.020.6 to construct a lOft drain,
manholes and pipes within the Del Rosa Avenue
right-of-way, between Foothill Drive and Bonita
Vista Drive, in order to intercept and deliver
existing spring water to the storm drain channel.

PROJECT DESCRIPTION
Location
The proposed project is located within the right-
of-way of Del Rosa Avenue. It extends southerly
approximately 1810 feet from a point south of
Bonita Vista Drive to Foothill Drive. (See location
map Exhibit "B")

ENVIRONMENTAL ASSESSMENT
4.1
Environmental Setting
The site is bounded on all sides by single-family
residential neighborhoods.
4.2
Environmental Effects
The Environmental Impact Checklist (Exhibit nAn)
identifies four areas of potential concern
regarding this project. These concerns are listed
below, followed by the recommended mitigation
measures.
1. The proposal will result in development within
the Alquist-Priolo Special Studies Zone.
No mitigation measures are necessary. The
project is to intercept spring water which is
currently flowing across the street surface
and take the flow to underground pipes and
deliver it to a catch basin. Should geologic
activity severe enough to sever the pipes
occur, the only result would be a return to
the existing surface flow condition. No
significant danger to public health and safety
would occur.

Based on Table 7-1 from the Noise Control
Office of the State of California, acceptable
levels of noise in urban residential areas are
50 decibels from 10 p.m. to 7 a.m. and 60
decibels from 7 a.m. to 10 p.m. (See Table 7-
1, Exhibit "0")
The recommended mitigation measure is that the
construction work will only occur during the 7
a.m. to 10 p.m. time period, as provided by
City ordinance. In addition, it is
anticipated by the City Engineering Department
that any noise level exceeding the 65 dB
exterior level would be of an extremely short
duration and temporary in nature.
9. The proposal could result in alteration of
present patterns of circulation. The proposal
could result in increased traffic congestion.
The street on which the construction is to
occur is a lightly traveled collector street.
The City Engineering Department anticipates
the work to last from 2 to 4 weeks with
minimal street disruption of the northbound
lane.
The mitigation measure recommended is that the
work be done in accordance with the City

and that particular care should be exercised
during the morning and afternoon "commuter"
hours.
