Description) Del Rosa Avenue, from Foothill Drive to Bonita Vista Drive Finance: Council Notes: 75-0262 Agenda Item No. S?1 CI\ / OF SAN BERNARD~...O - REQULJT FOR COUNCIL AC..ON STAFF REPORT The Negative Declaration for Public Works Project No. 88-17 was recommended for adoption by the Environmental Review Committee at its meeting of 6-16-88. A 14-day public review period was afforded from 6-23-88 to 7-06-88. No comments were received. The findings of need for health and safety reasons have not been approved by the City Attorney's office, due to some per- ceived problems. These problems are outlined in a memo dated 4-08-88. A copy of this memo is attached for reference. We recommend that the Negative Declaration be adopted and a finding made that the project is consistent with the Interim Policy Document. Comment: As noted in the City Attorney's 4/8/88 memorandum, a potential liability would occur if this project proceeds. However, the Mayor and Common Council authorized this project and policy direction is sought whether to go ahead. The Director of Public Works/City Engineer endorses the project and acknowledges the City Attorney's concern, but feels that easement and hold harmless agreements can be obtained to meet concerns of liability. ~ , .~ ES C. PENMAN City Attorney ~ DATE: April 8, 1988 . <, RE: Findings of Need for Health & Safety Installation of Storm Drain in Del Rosa Avenue. North of Foothill Drive page one It is my understanding from John Wilson that the above referenced findings relate to a project for the relief of a drainage problem caused by a natural spring occurring on the private property of a Mrs. Damus. Water from the spring imparts to a number of houses on La Hacienda Avenue near its intersection with Camino Drive. If this is the case. I cannot approve these findings. This project has serious problems which must be addressed before the City undertakes to resolve what is in fact a private nuisance. As set forth in the memorandum dated 12-17-86. from John Wilson to Raymond Schweitzer. the City has no current liability for the problem. A geologic study of the area was completed on 2-21-87. In that study. Dr. Floyd Williams determined that the source of the water is a spring which is a normally occuring condition of the area. The serious attempt land. for the City would be placing itself in a position to sustain and on-going liability it if enters the site in an to alleviate the problem. The problem is allan private The City must therefore obtain easements for access and placement of any drainage system on the property. The City will become responsibile for the maintenance of those easements. and what is now a private problem would thereby become a City problem. As indicated in the report of Dr. Williams. the true dimensions of the problem have not been determined. There are numerous springs in the immediate area. If activity should increase in one of these. the City will JFP:JFW:ss 4-8-88 .\ ';, tI . . INTEROFFICE MEMORANDUM TO ROGER HARDGRAVE, ENGINEERING, FROM JAMES PENMAN, CITY ATTORNEY. As stated California Guidelines, to: in Section 15063 of the Environmental Quality Act the purposes of an Initial State of (CEQA) Study are 1. Provide use as prepare the Lead Agency with information the basis for deciding whether an EIR or a Negative Declaration. to to 2. Enable an applicant or Lead Agency to modify a project, mitigating adverse impacts before an EIR is prepared, thereby, enabling the project to qualify for a Negative Declaration. 3. Assist the preparation of an EIR, if one is required by: a. Focusing the EIR on the determined to be significant. effects b. Identifying the effects determined not to be significant. c. Explaining the reasons for determining that potentially significant effects would not be significant. 4. Facilitate environmental assessment early in the design of a project. 5. Provide documentation of the factual basis for the finding in a Negative Declaration that a project will not have a significant effect on the environment. 6. Eliminate unnecessary EIR's. 7. Determine whether a previously prepared EIR could be used with the project. 1-1 CITY OF SAN BERNARDINO - Planning Department INITIAL STUDY - Public Works Project No. 88-li Drain, Manholes and Pipes - Del Rosa Avenue June 16, 1988 2.0 EXECUTIVE SUMMARY 2.1 Proposed Project The request is for approval under authority of Section 19.78.020.6 to construct a lOft drain, manholes and pipes within the Del Rosa Avenue right-of-way, between Foothill Drive and Bonita Vista Drive, in order to intercept and deliver existing spring water to the storm drain channel. 2.2 Project Impacts Impacts identified in the attached Environmental Impact Checklist (See Exhibit ftAft) are: 1. It extends southerly approximately 1810 feet from a point south of Bonita Vista Drive to Foothill Drive. (See location map Exhibit "B") 3.2 Site and Project Characteristics 3.2.1 Existing Conditions The site is Rosa Avenue, street in a Exhibit "Cn) within the paved right-of-way of Del which is a 50 foot wide collector residential area. (See Site Plan, 3.2.2 Project Characteristics The project is to install approximately 1810 feet of new lon drain and pipes with 4 manhole covers positioned east of the centerline of Del Rosa Avenue. The depth below street level ranges from approximately 9 1/2 feet at the north end to about 3 1/2 feet at the south end. 3-1 CITY OF SAN BERNARDINO - Planning Department INITIAL STUDY - Public Works Project No. 88-17 Drain, Manholes and Pipes - Del Rosa Avenue June 16, 1988 4.0 ENVIRONMENTAL ASSESSMENT 4.1 Environmental Setting The site is bounded on all sides by single-family residential neighborhoods. 4.2 Environmental Effects The Environmental Impact Checklist (Exhibit nAn) identifies four areas of potential concern regarding this project. These concerns are listed below, followed by the recommended mitigation measures. 1. The proposal will result in development within the Alquist-Priolo Special Studies Zone. No mitigation measures are necessary. The project is to intercept spring water which is currently flowing across the street surface and take the flow to underground pipes and deliver it to a catch basin. Should geologic activity severe enough to sever the pipes occur, the only result would be a return to the existing surface flow condition. No significant danger to public health and safety would occur. 2. The proposal will result in development within a high wind hazard area. Since the project is area, increased dust normal construction expected. located in the high levels resulting activities can wind from be The recommended mitigation project must comply with Wo r k_ _ _l>U1.iL_tt all ic _ c_oJ) tr 0 1 dust control. A commonly water the area, as needed, measure is that the the City approved Handbook regarding used measure is to to control dust. 5. The proposal could result in increases in existing noise levels. The proposal could result in exposure of people to exterior noise levels over 65 dB or interior noise levels 4-1 CITY OF SAN BERNARDINO - Planning Department INITIAL STUDY - Public Works Project No. 88-17 Drain, Manholes and Pipes - Del Rosa Avenue June 16, 1988 over 45 dB. Based on Table 7-1 from the Noise Control Office of the State of California, acceptable levels of noise in urban residential areas are 50 decibels from 10 p.m. to 7 a.m. and 60 decibels from 7 a.m. to 10 p.m. (See Table 7- 1, Exhibit "0") The recommended mitigation measure is that the construction work will only occur during the 7 a.m. to 10 p.m. time period, as provided by City ordinance. In addition, it is anticipated by the City Engineering Department that any noise level exceeding the 65 dB exterior level would be of an extremely short duration and temporary in nature. 9. The proposal could result in alteration of present patterns of circulation. The proposal could result in increased traffic congestion. The street on which the construction is to occur is a lightly traveled collector street. The City Engineering Department anticipates the work to last from 2 to 4 weeks with minimal street disruption of the northbound lane. The mitigation measure recommended is that the work be done in accordance with the City approved 1(0.r:15. Ar~~.. ~_r.q!fj.c_ .C.ontrol Handbook and that particular care should be exercised during the morning and afternoon "commuter" hours. 4-2 CITY OF SAN BERNARDINO - Planning Department INITIAL STUDY - Public Works Project No. 88-17 Drain, Manholes and Pipes - Del Rosa Avenue June 16, 1988 5.0 REFERENCES Person contacted: Michael Grubbs Senior Civil Engineer, Engineering Department City of San Bernardino, California 5-1 CITY OF SAN BERNARDINO - Planning Department INITIAL STUDY - Public Works Project No. 88-17 Drain, Manholes and pipes - Del Rosa Avenue June 16, 1988 6.0 EXHIBITS Exhibit A - Negative Declaration Exhibit B - Location Map Exhibit C - Site Plan Exhibit D - Table 7-1, Exterior Noise Limits csj/6-7-88 DOC:MISC ISPW8817 6-1 EX~ ,IT "A" P~l 88-17 "'" DETERMINAT]:ON On the basis of this initial study, r-tThe proposed project COULD NOT have a significant effect on the ~ environment and a NEGATIVE DECLARATION will be prepared.
