Subject:
Resolution adopting the Two-Year Capital Improvement Program (2008-2010) for Measure "I"
Local Expenditures.
Background:
In November 1989, voters approved Measure I authorizing San Bernardino Associated
Governments (SANBAG), acting as the Transportation Authority, to impose a one-half of one-
percent retail transaction and use-tax applicable throughout the county for a period of 20 years
beginning April, 1990 and extending to March 31, 2010. This tax has become commonly
known as the y,-cent sales tax. In November of 2004, voters overwhelmingly approved an
extension of the v,-cent sales tax for an additional 30 years from April I, 20 I 0, extending it to
March 31, 2040.
This Y2 cent sales tax can only be used for transportation improvements and traffic management
programs authorized in the expenditure plans set forth in Ordinance No. 89-1 of the
Transportation Authority.
The referenced ordinance requires each local agency to expend funds based on a 5-year Measure
I Capital Improvement Program and 20-year Measure I Transportation Plan adopted by
resolution. The 5-year Measure I Capital Improvement Program only relates to the expenditure
of Measure I funds and each agency is required to update the program annually. The 20-year
Measure I Transportation Plan is only required to be amended if it changes. Since the current
plan expires in year 2010, SANBAG is requiring a 2-year Measure I Capital Improvement
Program covering FY 2008 through FY 2010.
The proposed 2-year Measure I Capital Improvement Program (Exhibit "A") is based upon the
first two years of the City's current 5- Year Capital Improvement Program (CIP).
Changes to the program during the year are permitted subject to approval of Amendments to the
plan year by action of the Mayor and Common Council.
This year, SANBAG is again requiring cities to provide an "Expenditure Strategy" statement.
Attached is a copy of the proposed statement (see Exhibit "B") for this year.
SANBAG prefers to receive each agency's Measure I CIP and Expenditure Strategy during the
month of September. However, in consideration of the fact that San Bernardino's 5-Year CIP
was not adopted until September 2, 2008, SAN BAG has agreed to allow us to submit during the
first week of October 2008. Other agencies are receiving similar consideration.

6 SECTION 1. The 2008-2010 Capital Improvement Program for Measure "I" Local
7 Expenditures a copy of which is attached hereto. marked Exhibit "A" and by this reference made a
8 part hereof as though fully set forth at this point. is adopted as the policy and program of the City of
9 San Bernardino relating to construction of the capital improvement projects set forth therein, except
10 for Street Improvement Project SS04-I 16, which shall be voted upon by separate motion to become
II part of this resolution as Exhibit "c" and shall include the authorization to appropriate funds as
12 indicated in Exhibit "A."
13 SECTION 2. Pursuant to the Expenditure Plans set forth in Ordinance No, 89-1 of the San
14 Bernardino County Transportation Authority by which a local jurisdiction is required to annually
15 adopt and update its Capital Improvement Plan, the "Measure I Two- Year Capital Improvement Plan
16 Expenditure Strategy 2008-2010" attached hereto as Exhibit "B" and by this reference made a part
17 hereof as though fully set out at this point, is adopted as the City of San Bernardino Capital

MEASURE I TWO-YEAR CAPITAL IMPROVEMENT PLAN
EXPENDITURE STRATEGY
2008-2010
The City of San Bernardino will continue to place emphasis on both the regional
and sub-regional arterial roadway system during the remaining three years of the
current Measure I program. At least fifty percent of our Measure I funds allocation
will be earmarked for specific capital projects that are geared towards improving
traffic flow and motorist convenience. Failing pavement surfaces will be
rehabilitated and traffic striping modified as needed to accommodate increased
traffic demand; and intersection capacity will be improved with new and modified
traffic signals.
In addition to the above capital projects program, San Bernardino will continue to
allocate up to fifty percent of our annual Measure I funds towards public works
maintenance activities. Maintenance work will continue to include the City's traffic
signal systems, sidewalk and curb repair, and pavement repair and overlay on the
local street system.

Script for Mayor and Councilmembers
1. Call Item -Staffreport
2. Mavor: Due to potential conflicts of interest which require certain Councilmembers to recuse
themselves from voting on Capital Improvement Projects located within 500 feet ofreal property
which they own or in which they have an interest, we will take two separate actions to approve the
CIP.
On the first action, all members ofthe Council may vote to adopt the Resolution and Exhibit
A, which includes all projects in the CIP, except those noted in the Resolution which pose a conflict
of interest for specified Councilmembers.
There will be an additional motion taken. On the second motion, Councilmember Baxter will
abstain and will leave the Chambers, and the remaining members will vote on a motion approving
the CIP projects listed on Exhibit C, those projects which represent a conflict to Councilmember
Baxter.
3. Mavor: May I have a Motion to adopt the Resolution and Exhibit A. I will now call for the
first vote as referenced in Exhibit A which includes all Capital Improvement Projects except those
listed which pose a potential conflict of interest to Councilmember Baxter. Please vote.
4. Mavor: The next vote will be on Capital Improvement Projects that pose a conflict of interest to
Councilmember Baxter, as identified in Exhibit C to the Resolution.
Councilmember Baxter announce his conflict:
Baxter: "Because I own or have an interest in real property within 500 feet ofCIP No. SS04-
116, I shall abstain on this motion."
Councilmember Baxter leaves the Council Chambers.
