Subject:
Authorize the Director of Finance to amend Purchase Order No. 301959 and authorize the
Director of Development Services to execute Contract Change Order No. One with Weka, Inc.
for sewer related improvements (SW08-08), per Project Plan No. 12350.
Background:
In June of2005, the California Department of Transportation (Caltrans) proposed that the City of
San Bernardino enter into a Utility Agreement as part of the realignment and widening of the 1-
215 Freeway. The agreement, which required Caltrans to reimburse the City for all engineering,
inspection and construction costs associated with the relocation of our facilities, was signed by
the Mayor on June 29, 2005. The project consist of the following three phases:
PHASE I
I. Relocate four sewer siphons.
PHASE 2
I. Relocate an existing sewer force main outside the newly acquired freeway rights of way.
2. Improve the existing sewer lift station to accommodate additional flows.
3. Install a new sewer main in Mill Street.
4. Encase both the new and existing sewer mains in Mill Street.
PHASE 3
I. Relocate the existing sewer force main east of Ring Road and south of Inland Center Drive.
On February 19, 2008, the Mayor and Common Council approved a Resolution to award a
contract to Weka, Inc. for construction of Sewer Force Main and Colton Lift Station
Improvements at Inland Center Drive and Sewer Main and Sewer Encasements at Mill Street
(SW08-08), per Project Plan No. 12350.
Under the utility agreement, Caltrans will reimburse the City for all cost associated with the
relocation of conflicting utilities regarding the 1-215 widening project up to $4,171,365.00,
which reflects the estimated cost of construction with contingencies based upon the approved
plans and specification. In addition to this contract there were two other contracts awarded for
sewer relocation work all well under the amount agreed upon under the utility agreement.
CHANGE ORDER:
During construction of the sewer main and Colton Lift Station the contractor encountered several
unforeseen conditions that were not shown on Caltrans' designed plans, as follows:
I. On Mill Street, it was determined that the sewer main could not be constructed as designed
because the original plans did not accommodate for the lowering of the grade in Mill Street.

Caltrans redesigned the plans to lower the sewer mainline to accommodate the lowering of
the grade of Mill Street. The redesign increased the contractor's bid to $45,358.78.
2. On Mill Street, the existing sewer mainline was 0.80' higher in elevation than indicated in
Caltrans' design plans. Due to the difference in elevation the sewer mainline could not be
protected in place. It was necessary for Caltrans to redesign the plans to allow for the
protective concrete cap for the sewer mainline. The redesign caused the contractor delays,
additional survey time and hand labor to complete the concrete cap per the new design. The
additional cost to construct the redesign was $53,953.99
3. On Mill Street, the plans prepared by Caltrans indicated that the material around the sewer
main was rock. During construction, the contractor discovered that the material around the
sewer main was native, silty, clay material. This material could not be removed with
conventional construction equipment and it was necessary to remove the material using hand
labor. The cost to remove the material by hand was $36,485.69
4. On Mill Street, it was necessary to install a connection and temporary bypass in order to
relocate the existing sewer lateral to the new mainline. The lateral was not shown on the
Caltrans plans. The cost to relocate the sewer lateral was $7,377.87.
5. The additional seven remaining items of the change order include additional costs related to
hand excavating around several utilities that were not shown on the Caltrans plans, removing
slurry cement that the contractor for the freeway poured, and pouring slurry cement between
a sewer mainline and two unmarked utilities. These items totaled $18,708.34.
Financial Impact:
The revised estimated project costs are as follows:

Total Proiect Cost $ 1,474,828.17
This change order represents a net increase of 14% of the original contract amount.
There is sufficient funding available in the 07/08 ClP Budget to cover this Contract Change
Order. The reason for amending the Purchase Order is because work is still in progress and
therefore the contingency amount carmot be used.

JUSTIFICATION:
Additional Work due to Sewer Re-desil!n (see Exhibit 1)
During construction, it was determined that the 12" sewer main in Mill Street could

1-2 On Mill Street at Sta. 70+64, the contractor encountered a gas service, which was not
shown on the plans. It was necessary to hand excavate under the gas service and to
rearranl!e trench shorinl! to accommodate the "as service.
Standby and Additional Work for Re-desil!n of 36" Pine Protection
The existing 36" sewer mainline located in Mill Street could not be protected in place
as per the design. The contractor discovered the mainline to be 0.80' higher in
1-3 elevation than shown on the plans. It was necessary for Caltrans to redesign the
protective concrete cap for the 36" line. This redesign caused the contractor delays,
idle time, standby time, and additional hand labor to complete the concrete cap per the
aDDroved redesi"n.
Additional Hand Labor to Remove C1av Material from Pi De Beddinl!
The approved plans prepared by Caltrans indicated the 36" sewer main to be shaded
1-4 with rock within the pipe zone. During construction, the contractor discovered it was
actually shaded with a native silty, clay material. This material could not be removed
with conventional construction equipment and was required to be removed by hand
labor.
Survey Cost for Re-desil!n of36" Sewer Mainline
1-5 The 36" pipeline elevations changed, due to the redesign (Item 1-3). These elevation
changes required the contractor to nrovide additional survev to install the sewer main.
Remove Slurrv Backfill on Mill Street at Sta. 71+52
On Mill Street at Sta. 71 +52, the contractor encountered a utility that was installed by
1-6 M.C.M. (the contractor for the freeway-widening project). M.C.M. backfilled the
trench with slurry cement. It was necessary to remove the slurry to install the 12"
sewer mainline.

1-7 On Mill Street at Sta. 71+65, the contractor encountered a waterline (not shown on
plans). It was necessary to hand excavate around the waterline to install the 12" ewer
mainline.

1-8 On Mill Street at Sta. 71+88, the contractor encountered an 18" storm drain (not
shown on plans). It was necessary to hand excavate around the storm drain to be able
to install a 12" sewer mainline.

1-9 On Mill Street at Sta. 71+52 and 71+65, it was necessary for the contractor to pour
slurry cement between the 12" sewer mainline and two unmarked utilities.

1-10 At 760 Mill Street at Sta. 74+45, it was necessary to install a 12X4 tee and temporary
bypass and relocate the existing sewer lateral to the new mainline. This lateral was

service, which were not shown on the plans. It was necessary to hand excavate
around these utilities to install the 12" sewer mainline.

These lines were not shown on the plans. The contractor was required to hand
excavate around these lines to protect them in place, as they installed the 12" sewer
mainline.
